  1. Re:Distinction without a difference on Microsoft Launches Its Own Open Source Foundation · · Score: 0

    Definitely agree with you.

Innovation is one thing... Marketing is another.

Apple didn't invent Mp3 Players. There where many. Apple just sold their design better. They did the same thing, iPod even performed worse than a few (I loved my Zen Jukebox :P)

Microsoft has done it's fair share of innovating. There is a reason Microsoft Office has caught on more than Lotus... (I have Lotus Symphony on my laptop :D)

The Zune HD is a very impressive piece of tech. Also, the new WinMo OS isn't a "clone" of any other OS. It's a one upped version of their last. Same with Xbox. Oh wait! Did they copy Atari? This could go on and on. If a company was not innovative they wouldn't still be around.

OH! And how about Microsoft Surface? Doesn't look like they just did a straight copy of anything there.

Let me repeat myself: Is it not violent to be shot in the head just because you are willing to be shot? This is not a strawman; you said that rape must be violent because the victim is not willing to have sex, and I am asking if, by that logic, a being shot is only violent when you are not willing to be shot.

Just because we argue one fact doesn't mean that the opposite would hold true.

Any non willing act is violence, not all violent acts are non willing.

There are a lot of these hypotheticals. How many times does this actually happen? Also, age of consent in Illinois is 17. So even if you are 18 it's legal, it's a way to blur that line to prevent the scenario you described above. I think a 16 year old would be taken advantage of if an 18 year old convinced them to give consent to have sex more often than not.

    Your argument is just...

Yes. I think we would claim that he was killed violently. It was a violent act, albeit suicide is usually consensual.

Rape is violence. If it wasn't it would be sex. Get the picture? It's the whole point of having a separate word.

If someone forces sex either by means of coersion, physical force, threats with a weapon, use of drugs or alcohol or other incapacitating substance or takes advantage of someone who is otherwise unable to give consent (ie. underage like a child), then it is assault and it is rape.

Since sexual assaults and molestation by their nature stem from social interaction, banning them from social networking sites seems like a very good idea. It's just like the argument in the article said, we limit their physical distance and we should limit their distance on the internet. Seen "To Catch A Predator?" Lots of perverts do it.

This is just so outrageous. This was from the article from an ICE agent âoePiracy, counterfeiting and other intellectual property rights violations not only cost U.S. businesses jobs and billions of dollars a year in lost revenue, they can also pose significant health and safety risks to consumers,â he said. What? There are LOTS of reasons to mod a system that do not cost any jobs, any loss in revenue or any health and safety risks to customers. To backup a copy of a game I bought, I shouldn't have to buy it again. To create homebrew software to run on a system (It's just a computer in a fancy case) I shouldn't have to open a huge development studio, to learn about how circuits work and possibly be the guy who develops the next gen system, you shouldn't have to go to jail. The DMCA has been twisted in to all kinds of garbage. Its original purpose is good and all, to prevent people from illegally distributing digital goods, but the things it's been used against customers is appalling. I'm already boycotting the RIAA, Microsoft Xbox, Nintendo and Sony will follow.

Yes. There are many reasons for that, not just for safety. Keep in mind it doesn't prevent you from speeding. Many speed limits are far below the top speed of a car. :D I guess what I'm getting at is that it is possible to do poorly with a product no matter what. If you buy someone's car and use it as your getaway car or to commit some other crime then the car company should not be liable. It'd be a different story if the car was built with the intent to be used as a means of criminal use. This is what would have to be argued against TPB in my mind, although it's impossible to prove the intent. There are many legal uses of torrents as well. Linux community probably knows that well.

Hmmm Ok. So if you're saying that PirateBay should be liable, then how about car companies? If I get a speeding ticket in my Nissan, should Nissan get busted too? They sold it to me! They gave me the means to speed. How about if someone got in an accident and, god forbid, passed away? Does Nissan and the dealer who sold the car get charged too? How about the guy who delivered it to the dealer? The guy who put on your tires? So how far down the line does the blame game go? Users should be held responsible for their actions. Since these companies know that they'll never be successful in prosecuting the users they are just trying to cheat and prosecute the website. It's bogus. Do your job and get the right people.

I think you're on the right track. As much as I dislike windows and prefer other operating systems, I don't think that they are doing anything other than trying to help the user on this. Think: Why would M$ care if you use IE or FF? They already sold you a $200 operating system. Would you rather them SELL IE as a separate program? So that way when you need to navigate to a webpage that requires it you're out of luck? Windows is THEIR software. They should be able to include whatever they want. As long as they don't keep the users from downloading any alternatives then it's perfectly fine. The general public just wants their computers to work. That's it. It's the whole reason Macs sell so well. The whole Apple policy is: Use all of the Apple Bundled software!!!!! It's what the consumers WANT. Doing this isn't helping anyone except Opera and Mozilla and they are being selfish.
