If you are one of the few people who will use this device to listen to recorded music this might be great, but for the vast majority of us who intend to use it to trick people into going outside to shut their windows and return to wonder why their wine is rippling it is not worth it!
Suppose they provided a physical switch. You would still have to trust them that it did not simply get read through software. You can't open it up and verify that the switch physically disconnects anything. Trust will always be an issue. Period.

A correct analogy would be do they prefer a lock that is easier to use and trivial to bypass over one that is slightly harder to use but nontrivial to bypass.
