    because someone in Google wrote the algorithm to suggest that - if the no 1 result for "Lyonnaise de Garantie" was a negative page that is defensible but if your algorithm suggests something you are liable you wrote that not a third party!

    And then Lyonnaise de Grantie goes after them for contempt of court - bullying people who have won a case against you by weasel words like "chilling effect" is also an offense - this is just what the tabloids and broad sheets did to people like Max Mosley and threatened to do to those that exposed the NOW hacking.

    Google was insane or grossly arrogant in claiming that just because the " algorithm" did it they are off the hook. It took me 5 seconds after seeing auto complete to understand that this is a legal mine field.

    That was because he was a male white first world citizen - there are may poor people imported to do the menial jobs (navvying etc) who are treated very badly.

    Deciphering decades if not hundreds or years of legal precedent and laws and then coming up with a line that will persuade the jury or judge isn't a puzzle.

    Constructive dismissal is when the master (aka the employer) treats the servant (the employee) so badly that he is constructively dismissed. Though its much harder to prove constructive dismissal the penalties for the employer are not capped as they are in standard unfair dismissal cases.

    . I suspect given the provenance of the employer that the role was a mobile grade though I suspect moving your job to the north pole would not be covered :-) - though as ex public sector they might be in for some grandfathered in juicy ex pat benefits

    Actually the UK isn't a right to work (a dubious legal fiction in my view) how ever you can be let go in your first year of probation (the Condems are trying to put this back to 2 years)

    In practice the employer holds all the cards and there are tactics to force people out Poor performance and so on.

    never heard of constructive dismissal have we ? and companies do illegal stuff though cock up and malice regularly - I have only just finally sorted out my tax from my previous employers going bust not having paid my NI stamp Its taken 2 years.

    Hes a HR bunny and a recruiter at that, HR 100k jobs are very rare unless your a very senior HR/IR guy in very big (FTSE 100) companies.

    yess from my back ground in BT I can imagine the unreconstructed nature of their senior management - "Hairy arsed engineers" who think that HR is for girls and pooftas.

    I think they are going to lose as its custom and practice to use linked in for networking and putting your CV on linked in is part of that process nowadays. And as he was a recruiter he could argue that that tick box was for people to contact him who might want to work for BG.

    Will have to look out for that one on xperthr at work.

    no He is claiming constructive dismissal they didn't fire him he is claiming they forced him to resign (there is no cap for constructive dismissal as opposed to a bog standard unfair dismissal.

    Actually for toy sites it might be but doing it right for a multi million page site built over the course of several years and using multiple CMS its actually bloody hard work!

    And how brave of you to hide behind a pseudonym - I see my job as protecting all the stake holders IE including the the poor bastards who will be laid off if the company messes up a transition on a website.

    BTW last year I found a single mistake that had cost one small part of the company getting on £1/2 Million in less than a week.

    as a "SEO" expert (ie Matt Cuts knows my name) working for a big company no way would I our my colleagues ever suggest this - the risk is immense and if any one in our group of companies did this I would be lobbying the MD to have the marketing people involved fired.

    Matt C should be at the next Google board meeting demanding someones head for this.

    Why hell should the union provide training that is the job of the employers/industry? What is the Trade union issue here brother? The only training a union needs todo is to train its activists and officers in their specialized needs eg employment law and dealing with cases.

    Unions have a role in lobbying for things like industry training levies making sure that state funds go to vocational courses and not to run bogus sports departments like all the American universities do.
