Thank you for your insight. It is well thought out and expressed. However . . .

I am very much more pessimistic than you. You state that you don't think they will win in the end. I fear that they will.

If we take predictions in Sci-Fi literature from over ten years ago they point to the peoples biggest oppressor being not the government but large corporations who have been given practical control of the peoples by the government. The trends of these literatures have been followed these predictions more than they have deviated.

Saying that they will win in the end makes me think of England just before the settlers came to America. Surely at the time the people said "How can the government dictate what my religious beliefs are or how I choose to worship." But they did. In the same way I can imagine the settlers of the new world saying "How can every piece of paper that I used be taxed and taxed again?" But it was. In the same way we are saying "How can thought stuff, ideas and numbers be so controlled by the government?"

One of the keys of escaping the previous problems was "The New World". The protestants left to go to the new world. The settlers rebeled and formed their own government (and I would not underestimate the added advantage of the land being so far away from mother England).

But where are we to go now? Under they sea? In space? In the virtual world of computers and networks? None of these are currently viable options. Sense, we have no way of escape, and open rebellion appears dubious at best, I can EASILY see how the government can empower the corporations to stop our exchange of information. Just as mother England put unreasonable taxes and countries in europe dictated how and what religion everyone must follow.

I hope with you but fear the worst.

This commment should not be underrated. I have personally become more aware of this affect on me in the last couple of years.

Example 1: I have noticed that after seeing a commercial for a fast food product a few times I start to crave the product. The first few times I see it I don't think anything of it. But after seeing it a while I think to myself "Hm, I think I'll try that".

Example 2: I have been in a store buying a product I have never really bought before (or don't buy on a regular basis). After looking at the choices I have become aware that I desire the choice that I am familiar with. How do I become familiar with one product over another without ever really using the product? I realize that I have seen it on T.V. I thought process is "well, the have the money to advertise so I hope the have to money to develop a good product".

It is only after trying different products that I might figure out that a brand not advertised is better. And if I don't really have the regular need of the product to try it guess who won that "customer battle" for me. . . the advertiser.

It's funny. I remember when T.V. shows weren't allowed to show brand names. I guess they changed that because I noticed (I think Seinfield was the first time I noticed) that brands were "back". I thought they had product placement in T.V. way back and then removed it?

I would like to point out to you how you CAN get the government officials to listen to you. I have pointed this out before and I will continue until the Slashdot crowd gets it.

YOU, yes, YOU have lobbiest who are voicing your opinions to the government RIGHT NOW. These lobbiests have (near) the same power as the corporate lobbyiest and in fact some of them ARE corporate lobbiest. And that lobbyist is contributing RIGHT NOW, just like the RIAA's lobbyist, to the congressmen for access.

Where is that lobbyist getting his money? From you. Whenever you donate to the EFF, Sierra Club, NRA, Greenpeace, MADD, Mothers against Guns or any other orginization it uses that money for lobbying efforts to further it's agenda (if it doesn't it's not a good orginization and you should not contribute to them). Lobbyists are your loud voice to our officials.

You stated that the only reason we might win this one is because other large corporations are against it. How are those large corporations getting access? Their lobbyiest. In this case their lobbyist are our voice to our government.

I get SICK of hearing that "no-one" is representing our view to our officials or that "we don't have the money that the RIAA has so we won't be listened too". This is absolutely false.

If our view isn't being listened to then GIVE MORE MONEY to orginizations that lobby for your views (the EFF would be a good one in this case). An alternative to giving more money would be to get others to join and give what they can to the orginization if they agree with you. And listen here, I am really not talking about you starving college kids who are trying to get through college. I am talking about all you folks living high on the hog from your profits of the Dot Com era (that is a little joke). Seriously, those of you professionals who own nice houses SHOULD be contributing if you REALLY believe in these issues.

    WE DO HAVE A VOICE!!!

A natural extension to this would be that I would be allowed to rip my CD to listen to it on my portable MP3 player because it doesn't skip like a CD player on my motorcycle. It is also LEGAL for me to loan my CD to a friend or even SELL IT to him if I don't want it anymore.

Don't give us your rightous attitude of "what your doing is still illegal" when IT IS NOT!!!! And in fact the very question to "Ask Slashdot" was "How can we make your fair use illegal without pissing you off."

You are wrong about more than just the fact that it isn't illegal. You are also wrong about the fact that it is the government's job to enforce civil matters. Although there are a few laws making certain types of copying illegal, with the exception of the DMCA, NONE OF USE SLASHDOT USERS FALL UNDER THOSE LAWS. All of the laws before the DMCA make it CRIMINAL to illegally MAKE MONEY off of copyrighted works.

The truth of the matter is that this is mostly a civil matter that the **AA has pushed into being a criminal matter with the DMCA. It is COMPLETELY innappropiate for there to be a government entity to enfore IP. It would be the equivilant of creating a police force to enforce patent or trademark enfringment or slander against an individual. Although you did not say anything about creating IP police whenever you make civil matters criminal you have to have police force enforcing. I don't think our currently police force has the qualifications for determining if I am violating IP so there would need to be special police force for enforcement.

Not only is what you are claiming illegal, legal, but they are trying to pass laws that make what is legal illegal which would result in the creation of a special police force enforcing what amounts to claims on mental thought. This completely against both the traditional and modern view of how this country should be run.

They blame it on the country that their people see has success (and money and FOOD).

They (the governments in charge) are upset by the fact that the Freedom of the U.S. is spoiling their little power trip by showing their people that it doesn't have to be that way. So, they tell their people how EVIL the United States is. How the United States steels money from their mouths. How the United States gets its money and power from them and that is why they can't feed their family.

Get a clue. This is propaganda pure and simple. Someone doesn't get rich by steeling from the poor. They are NOT por because we are rich. They are poor from their governments suppressive nature.

It's become fashionable to dislike the U.S. here in the U.S. It's the in vogue thing to do. So, our own media bashes the system that allows it the freedom to do so. The article tries to point out that these are so tentative that they can be used with other films. DUH. Most ALL stories these days are NOT NEW. Just like music is its all been done already.
