  1. Clean Room on The Linux Kernel and Software Patents · · Score: 2

    In the long run the Linux Kernel, is probably Ok, much as the *BSD kernels are probably ok. While SGI might hold a patent, in general if one can prove that their implimentation was developed without knowledge of the or assitance from the patented stuff...its OK. Thats why we have the PC environement we have today. In general replicating function is OK, its the outright theft of code thats NOT ok. We have record in the LKML that the rmap stuff has been developed based on ideas in the *BSD kernels if I remeber correctly. I think that Puts the Linux Kernel in the clear.

    The solution to the problem is the answer to the problem, the way out ois the way in in otherwards....

    Ok, it probably doesn't make much sense, but it should. ICANN's job should be to manage the rootm servers end of story. Is the power on? Yes, good we did our job today. They should be a non-profit organization paid by domain registration fees to keep the power on. Then the registration should be openned up so anyone can act as a registrar of domain names or any and every common TLD, with perhaps the exception of ccTLD's the managers of which should act as mini-Icann's for their country. DNS management should be combined with domain name registration management, and route publishing as well. A simple web interface mansged by ICANN could ben be used to check or the existance of a name, registration of a name, attaching DNS servers to that domain, and then the DNS server does the rest. Domain disputes...gone I got it first I keep it...

    Lets go more basic...
    Alot of the music being released and pushed on the airwaves sucks....
    There have been a few good new bands, Disturbed, Non-point, Nullset, Trust Co. and a few others that escape me currently(which shows how memorable they really are!)...but of the bands I really like Rush, Metallica, Dream Theater, Queen, Van Halen ... there have been precious few new discs in the last few years, only Dream Theater being really active with 2 in the last 2 years...Rush came out with a new disc after 5 years(ok there was a live disc 3 years ago, but new music wise)...Metallica is missing in action...Van Halen can't get along with a singer to save their lives, and Queen is in never never land now...I lived Pearl Jam, but then they got wierd, Creed held my interest for 2 discs but they blew it on the third. More often than not each new band I give a chance only manages to keep me interested for one disc, then the next one tends to be so radically different it just plain sucks....or I will make the mistake of buying a disc for that on song on the radio, and the rest of the disc is completely different in nature(Usuall the liner notes tell the whole story that one song has a different writer, producer, engineer etc, from the rest of the disc) a few off the top of my head in this catagory....Big Wrek, Carolines Spine, Linkin Park, Dust for Life...

    Add all that together with a decline in the economy and no wonder CD sales are declining.

  4. DFCA---Support the Digital Freedom Continuance Act on Doctorow on the Demise of the Digital Hub · · Score: 2

    I propose the (DFCA)Digital Freedom Continuence Act.

    "1. Congress Shall Pass no law restricting your ability to do anything digitally that you can do through handwritten, and or other Analog means.

    2. Congress shall not allow the granting of a patent for any device that would knowingly impinge upon your ability to do anything digitally that you could do via handwritten or Analog means.

    3. It shall be unlawful to distribute technology which would knowingly violate the Free Speech and Fair use intentions of the Constitution of the United states of America.

    4. It shall hence forth be understood that once "content" is purchased, it is the purchaser's right to do what ever they choose with that content, and shall have the right to do as they have always been able to do via handwritten, or analog means.

    5. Congress Shall repeal the DMCA it does not serve the people of United States in any fair way shape or form. It abridges the freedoms that are set forth in the constitution.

    6. Congress shall pass no law which prevents fair use of media, nor shall it support any initive which would do the same.

    6a. It shall be illegal to develop technology or any other means which would prevent fair use of media.

    7. It shall be illegal to attempt by means of contracts take away the rights of the author of a work. That is, copyright can not be transferred, and the creative person or group thereof behind a work _always_ holds the copyright.

    8. There shall be established reasonable copyright limits on created works, that are equivalent to a period not to exceed the reasonable financial lifetime of the work. 8a. Each major version of software (ie. v1 v2, etc) shall have a copyright period not to exceed 6 years past the time that version is not longer available for sale. In this time the software publisher will have most likely published a newer version, ceased to exist(how can a company which doesn't exist reasonablely hold a copyright anyway), or abandoned that line of software.

    8b. Films and audio recordings shall hold a copyright for no more than 20 years from their original theater/video(for direct to video releases only) release date. New editions and releases of the film which change the content of the film through adding or deleting of material shall be covered by their own copyright period, and shall not extend the copyright period of the original work.

    9. If there does not exist a method of using media for a particular harware/software platform, and the publisher of said media does not make a reasonable effort to provide a viewing or conversion method then I shall be legal for a third pary to create a method, by whatever means required to do so, and distribute/profit by it.

    9a. In the case of new distrobution/storage/playback/viewing methods which become available in the market(hardware or software) the original publisher shall enjoy a 2 year grace period during which to make their works available via this medium."

  5. How to Introduce a Bill, a theory Question on Doctorow on the Demise of the Digital Hub · · Score: 2

    This brings up an interesting question, that actually makes me somewhta ashamed to ask...as an american. But anyway...can anyone introduce a Bill in congress or just or legistators....If I wanted to write and introduce a bill which would act to put into law the concept that "Hollywood" can't ask for laws mandating the control they want...how would I have to go about it...? can i write such a thing, and then request an audience per se with Congress and say hey I had this idea that the land of the free, should stay free....or do I need to get a congressman in my pocket, to make such a thing happen....?

    I am willing to sue the RIAA, to gain the rights that we should all have. If we can find a way to attack the suit, and reason in support of it.

    Goals should be:
    1. To establish that once a CD is purchased it is mine and I may do with it as I please.
    2. Establish RAND fees for streaming music that fair to the artist who recorded it.
    3. Prove the RIAA is a Monopoly and should be taken apart piece by piece.
    4. Prove they have controlled the music industry for far to long...and have done a piss poor job of it.

    The RIAA, and MPAA both need some old school trust breaking justice visited on them. These f***s are organized and legalized crime at its best.

    I have always thought that the solution to alot of the patent problems we are seeing lies in the details. Alot of Patents that get granted seem very open ended. "A process for doing X with Y", but they many times seem to lack detail and are very openended in how they can be viewed. It seems to me that the public would be better served
    if Patents were granted on ver specific fine grained processes. "Specific Process for doing X with Y by using Z in combination with A, B, C, to achive K..." Would you agree? Why or why not?

    I too have been running ext3 since it became part of the kernel, actually since it was fairly stable before it got into the kernel proper, around 2.4.12 I think...I have not once had an issue with since I began using it, and I have the machine go down when power goes out at least once every month or two...ext3 even saved my ass, when after installing a new drive and then having the controller decide on the first boot after install that it didn't like the drive. I had already put a large amount of data on the drive before that boot...the ssystem came up spewed errors, all over...I rebooted put it on a different controller in the system, all came up well, ext3 recoved from the journal and all was well, NO data loss...I asked a firend if the same would ahve happened with ext2 and he said he doubted it...the journal was the saving grace in this situation.

    I am pretty sure that Ultraedit is about the only shareware I have ever paid for as well...and its definately been well worth the money I paid for it...I am getting at least double the amount done that I used too..and the automatic .bak functionality has saved my ass more than once...the only feature I would love is being able to keep multiple revisions vms style....

    I used to use ICQ, and ICQ was good, but then came AIM, and well. most people I knew were on AIM. So thats the way I had to go it wasn't fair of me to ask my non technical friends to use my system, and then have to deal with more than one client. AOL is the 800-pound Gorilla of IM these days. Non-interoperation is also a business matter for them. Their control of the client is important to them because of that little window on the top of the client...they get advertising dollars for that little window. How can they insure in an inter-operational cleint that window is appearing? Suppose that they allowed inter operation large scale, and someone had a client (ignoring for the moment the ones that do exist already) that has a slicker interface and is more fuctional than theirs. We all move to that client, using their network, but not displaying the ads they are getting paid to display...? Its a business problem folks. They might be a big company, but someone has to pay them in some way to operate their FREE service. Perhaps if the alterate interfaces would be willing to make sure they display those add windows properly..? But still what assurances would they really have that this is actually happening?

    I had 2 Omnibooks, that all snapped hinges and clasps, several times and that was just from the activity of being in the laptop bag....screens went bad alot too...
    4100, and 4150 model.. Lets not even talk about dropping them accidently.....
    I have droped the CPxJ twice from 4+ foot hieghts and never had a probelm...once it was even running...(don't ask long story)

    Inspirons are consumer models, they are actually expected to be moved less and opened and closed less, and remain in docking stations for more than 75% of their life according to the On site DELL guys here. The Latitude series on the other hand is built to survive a nuclear war...(well figuratively anyway)...I have had three, all of which lived with out a hitch for 2 years plus without a hitch...

    So here is my question. It relates to the "Measure of a Man" episode of ST:TNG. In the episode we are confronted with the idea that at some point AI, will have to be recognized as a life form. If we do not then one could say that we have simply created a slave race of robots. Do you agree with this concept, and at one point would you think that AI's stop being property to do and at as we will, and instead become "life" to do and act as they will?

    yeah I wasn't quite lucid this morning, and I was listening to RUSH, so that was the word that came to mind, but I ment cygwin....
    The trouble is what cygwin does and how it modifies and changes things. I built a test box with it once and as soon as the server team looked into it, they panned it and wouldn't approve loading it on the system.

    What I was really saying is that tools which would make NT act other than its out of the box intention such as getting Unix behavior through cygwin, or even emulating unix in a vitual box under VMware is a no no here....

    However I could sell a tool such as CVS...if it ran as a native NT service and didn't require other tools to be loaded on the machine like Cygwin...Jrun on a web server doesn't even pass muster around here....

    My largest problem with most of these revision control systems for Open source is the Lack of the Windows based Servers...I Know I know...but unfortunately most of the development I do is for the company I work for, and I just don't have a choice in these things. I have to develop for windows here, and I have to use windows systems, NO Linux, BSD, etc allowed. However I can't stand most of the Closed Source systems, I would love to be able to use one of the open source systems at work. Before you get tofar down that road of thought, Cygnus(or VMware, etc) is not the right fix here either, the server team does not allow that sort of software on the servers.

    Convince the local Cable company to install the needed infrastructure for cable modems. If they local Cable company sucks get the region to change providers. I have Charter Cable In Auburn, MA...these guys are great 3 different speed offerings, the also offer 5 static IPs as a Business Class service, and they have recently added SOHO Class which is 1 Static IP....At any service level they pretty much don't care what you do with the line, servers ok!(Hell they send my mail to the account I have on the mail server I have connected their cable line. And they know its there!)

    I thought after all the discussion and backlash last year, that I was pretty clear that the internet community, wants insternet standards to remain free. Any Proposal that even mentions that any web standard could be brought to to being, as not free should be immediately rejected. This extentions crap is just a dodge, where some company say "Big Evil Corporation" here to refered to as M$ could intoduce a new standard as "core" and freee get us all hooked on it, then introduce "extentions" that are the really good most desired functionality, and fill there coffers. This stinks of M$ "embrace and extend"....I hope this proposal like last years get as universally rejected and the community sees the forset for the trees here....
    The Internet and the standards which make it work, and grow need to remain free....

    Not directly related to the cars themselves, but wouldn't it be better to eliminate the long distance driving all together. Save on Gas an energy all around.

    First Mass Transit baby, more trains. Give me the ability to ride my bike to a train station and then take a train to the general location where I work, and then ride the bike the last mile so to speak...

    Trains run on Electricity. Generate that from natural sources, wind, water, solar got a building going up require it to have a certian surface percentage covered in solar panels. Put wind turbines on tall structures like industrial Chimmenys, and radio towers. Stuff like that....

    Seriously I would love to drive a fuel efficent, or completely alternate fuel vehicle, however the current selection the cars are just to damned small. I am a big guy(not fat just widely built, I don't need extra airplane seats or anything), and the size of this class of vehicle is just to small for me to be comfortable...
    I drive a Regal because I am comfortable in one....
