If we don't know the answer as to what is causing global warming, then there is a simple answer as to how to respond.

Look at our two choices: Do nothing. If man is responsible then global temperatures will rise. If nature is responsible then global temperatures will rise.

Reduce/eliminate emissions and maybe scrub greenhouse gasses from the air. If man is responsible for global warming then temperatures will stop rising or decrease. If nature is responsible then temperatures may still rise though we may still be able to prevent it.

Depending on how you define "free" there are two implementations though one is a developmental split from the other. In fact, how XFree86 handled developement is about the only problem X has.

The grandparent seems to a very clever troll. X by design is different from explorer.exe and Aqua. The various desktops can emulate behavior very close to MacOS or Windows. What you are used to makes for the most easy to use. Some of the behaviors of Windows are very aggravating to me though.

Why is it that when a new window gets spawned it grabs focus? I hate that, nor is thier a way to change that behavior. I suspect MacOS is similiar but don't know for certain. Most Window Managers can change the behavior of window focus though.

Actually the TFA says that it depends. In the court cases it was more that it was unreasonable to copy the database of phone number wholesale and market a competing product. If instead say a EULA on retail software forbade publishing benchmarks, it would likely get kicked out of court.

There is a lack of consideration for EULA's on retail software. Money exchanges hands before the contract terms are presented. Then EULA's take away your rights while not giving anything in exchange (I do not consider the right to use the software a fair exchange because you already purchased the right for that at the store when you bought the software). Presenting the EULA to sign on to thier servers is no more enforceable when that is the only way to play.

To use GPL software you are not required to accept the GPL, hence it is not an End User License Agreement. The GPL is a distribution License. If you want to distribute GPL software, whether you give a copy to a friend or you repackage like Red Hat, then you must accept the GPL, because otherwise copyright Law prohibits you from doing so.

See the GPl is pretty clever, there is actual consideration as you get something (distribution License) for publishing your source code.

On retail software, there is no consideration with the EULA. You have already paid money and the EULA is not giving you anything further than what you already have.

Ignore the shingle missign and you will get leaks and then structural damage to the roof and possibly the walls, and you see where this is going.
