...while such trades may be legal under the first-sale doctrine of U.S. Copyright Act...

That's just because it isn't software. On more than one occasion I have been told by software companies that selling your used copy was illegal, even if the sale included all packing material and an affidavit that you wiped your harddrive of the product. They argue that the First Sale Doctrine does not apply to them because the software was never sold, only licensed. They have shut down eBay sales of software and sent cease and desist notices to yard sales.

All the DVD manufacturers need to do to stop Peerflix, is to slap a license on every DVD. It won't be legal, but that hasn't stopped the software industry or its lapdogs in the judiciary.

Not in the least. This is something you can tell. If it was choreography it was the best damned choreography ever, because they managed to sync up the mistakes to the sound track. This was a *LIVE* concert, not a studio-perfect recording played back. What were the live violinist, trumpetist and saxophonists for, if everything was a recording? How did they manage to sync up Joe Walsh's reaction to the audience so well if it was Memorex?

If you think that the Eagles lip synced to a recording, you obviously don't know the Eagles. Sheesh.

While the Wikipedia "definition" is technically correct, it's obtuse enough that you think it means the opposite of what it really does. Here's the dictionary.dom meaning, maybe it will help: "Appealing to personal considerations rather than to logic or reason."

When you say "I do not believe arguments from Exxon, General Motors, and conservative think tanks when it comes to global warming" you are in effect making an ad hominem argument.

Ad hominem arguments suggest to me that the arguer is unable to formulate any rational and cogent case that is distinct from the hominem. Attack the idea, not the man. In this entire thread you have not once presented an argument that did not rest on an ad hominem attack.

    Here's your core argument distilled:

    1) TCS says hurricane magnitude not related to global warming
    2) TCS funded by Exxon
    3) Exxon is evil
    4) Global warming thus causes larger hurricanes

People used to go to concerts, too, but my last concert was $95/ticket for an fairly-unknown electronica band -- the crowd was thin.

My last concert was only $10 higher, and it was the Eagles doing a three hour set! The band was in great form. Freaking awesome! The enclosed stadium in a mid-sized city was completely filled.

Of course, it's "old fart" music, so it probably doesn't even register in your tiny little world. We "old farts" are the ones still listening to radio. We "old farts" are the ones still buying music. We "old farts" are still packing stadiums.

Not all blogs are amateur. Not all blogs are posting frequently. Not all blogs are hosted at blogging portals. Not all blogs have syndication. Not all blogs have comments.
