    You can buy games from distributors who legally sell them in the market for which they are intended. It does not matter what country YOU live in so long as you do not become an unauthorized distributor. You need to have a license to sell a work which is protected by the copyright of another.

    The exclusive right to reproduce and distribute a copyrighted work is a legal right granted by Congress by authority of the Constitution. You are wrong if you think that anyone can sell a copyrighted work. While the agreement between the copyright holder and the distributor is a contractual agreement, all that means to the infringer who is distributing grey market items is who has the right to sue you in the US.

    This would in no way be a breach of contract matte, the cause of action would be would be infringement of copyright.

    Violation of copyright is not dependent on a contractual relationship between the parties. If you do not have permission to reproduce or distrubute a copyrighted work in the US, you are liable for damages or at least an injunction ordering you to stop selling it.

    Selling import DVDs is a violation of the exclusive right to distribute the DVD in the US by the holder of that right. That right was paid for by the distributor to the copyright holder.

    These are what are known as "grey market" items. While not "illegal" in the sence that criminal charges can be brought against you, the holder of the exclusive reproduction/distribution rights for the US can bring a civil suit.

    Now, they generally don't go after the small fish who are selling a few in a store, the do go after those who bring in truck loads.

    It is too costly to sue everyone who sells a grey market DVD or VCD. Living in the Bay Area, I see tons of grey market stuff as well as illicit copies of copyrighted material (from VCDs to fake Louis Voutton (sp?) bags). While some is "illegal", i.e., the government can charge you with criminal conduct, much is not. Like import video games and DVDs.

    It is o.k. for YOU to order these things from over seas distributors, because you are technically buying it in another country from someone who is authorized to sell it to you for PERSONAL use.

    There is nothing illegal about importing games for yourself.

    There may be copyright issues based on the rights granted to the domestic distributor. If you were a shop selling imported games, the domestic distributor may have a cause of action against you for infringement. This would be simple copyright, not a DMCA issue.

    That depends on the laws you are talking about. I think you are confusing a free _market_ with _freedom to do what you want_.

    Laws which prevent collusion and price fixing preserve the market.

    The New Deal?! Please, that was an economic disaster almost on the scale of Mao's Great Leap Forward! Look at the data for the 1930s, you will see economic pickup well before FDRs (unconstitutional) socialist programs were implemented. However, when he started to tak over large portions of the economy, you can see the economy tanking. The Great Depression would not have been nearly so great had FDR not interfered. What got us out of the depression was the war, after which, we were the only ones in the world with any major industrial capacity.

    In fact, the markets did not recover until the 50s after we were rid of Truman, (Mr. "lets nationalize the steel industry"; Yea, that would be a good idea)

    The idea of the "middle way" has largely been dismissed by anyone serious about increasing economic activity. The Scandinavians got away with it because they were small, homogenous societies with a strong work ethic. That is no longer the case, and they have been despirately trying to dismantle their systems before they end up like a third world country.

    Norway, for example, could never support their system without their massive exports of oil and other raw materials. That combined with their almost exclusive use of hydro-electric power has provided them with a windfall to support their bloated system. However, they are now running up to the edge of what they can afford.

    Also look at France and Germany (no culture bashing here, I actually like the French. They have a natural unemployment rate of around 10%! Ours is about 5 to 5.5%. Could you immagine the American public's reaction to such an unemployment rate?

    Anyone who thinks that socialistic economies are "better" have never looked at the data. The only legitimate argument that can be made in favor of socialisim the one of equity. If you believe in wealth re-distribution, (which is a legitimate POV) the socialism one option. However, if you believe in economic efficiency and growth, the free market capitalism is the best way. Of course, as I mentioned in an earlier post, I believe in strong anti-trust laws to protect against corruption.

    Capitalism has provided more wealth and more freedom to more people than any other system in history. Lets try to address corruption. Dragging us into a socilistic morass is not the answer.

    "Capitalism" (a term which is broader than just meaning "free markets")is not the problem, corruption is. The goal should be to create a system where it is harder for corruption to go unchecked.

    In a free market economy, there is far more incentive for governments to fight corruption than in a socialist economy. The one caviat to that statement requires that the government do its job by enforcing anti-trust laws (something they have been VERY lax with over the last 15 or 20 years).

    Name a socialist country that is less corrupt than the worst of the free market capitalists. The closer you get to a command economy, the more corruption you breed.

    I never said that a mere increase in users would diminish the value of the database. What I did say was that if it was freely available at the public library, there would be absolutly no incentive for a consumer to buy it.

    Lexis and Westlaw provide very valuable services. They do not meerly post the text of the case.

    Westlaw and Lexis have a search system which make web search engines look like a children's toy. Also, theattorneys who review _each_ of these cases provide lengthey head notes and check to make sure that each case is still good law. This is all very expensive to maintain.

    If they were to allow public libraries to use these systems, lawyers would just send their clerks (who are generally students) to the local public library. How will they then make any money? If they go out of business, you are right back to using books. Not an easy task for someone who does not know what they are doing.

    Private entities, such as corporations (gasp!) and individuals are free to purchase these services.

    As someone who uses Westlaw every day, I am very grateful for its existence. It would be a shame if some whiney, "everything should be free" leftists ruined such a great resource.

    often UPS won't honor its insurance. For PCs the come up with some bogus excuse like it wasn't packaged properly. Trust me the 3 computers UPS destroyed were packaged properly. From the looks of one of them, it looks like a truck ran over it.

    It is unlikely that Bush would even _have_ to make such an order. Ashcroft would be aginst a breakup as much as the President.

    Besides, breaking up one monopoly to create two more monopolies does nothing. An argument could have been made for a breakup eight years ago, but not now. This is only revenge fueled by a few large Democrat contributors who have been unable to compete. This kind of political suit often dies after a new administration takes over.

    This whole thing has been a colossal waste of taxpayers money.

    I hate to break it to you, but there is very little difference between communism/ socialism and fascism. Historically, the first "fascists" were all former communists. They are all leftists/statists. Fascism was just called "right wing" by the communists because fascists were nationalists and believed in _some_ private property. Fascism, Nazism, and communism are very similar philosophies. They all believe in universal employment, universal health care, and universal housing. Now, who is the fascist in the up coming election?

    All you leftists are a bunch of little girls who are so terrified of life in the real world that you want the nanny state to hold you, care for you, and tell you that everything will be all right. If you need that crap, join a commune. Or at least let those of us who don't want your worthless programs to opt out of them. I live in California, and I pay half my income in taxes. I am not rich. I might be if I lived in North Dakota but not in the Bay Area. I live in a small two bedroom condo, and drive a 1987 Volvo 240. Everyone seems to think GWB is an idiot. He may be. But if you have ever read Gore's book, you would now that he is a frightening idiot. Is this a good choice? No. I would rather have a do-nothing frat boy as president than a law school and seminary seminary school dropout who got Cs and Ds all through his undergrad career. Gore will have a bloated, inept program for every perceived problem his focus groups can come up with. Just remember, do you want government to have more control over your life or less? If he has his way, Gore will inject government into every aspect of your life. If you want that, then maybe you have some emotional issues you need to deal with before you worry yourself about policy issues.
