Have you been reading the recent slashdot stories about the Linux kernel becoming big and unstable?
Linux is a good OS but
1)Solaris is mature and runs old unix software. 2.) More stable and hell of alot more reliable since Linux is going down 3.) Scalable galore 4.) Has had mature clustering for almost a decade 5.) software for enterprise is still not all ported to Linux 6.) compatiblity games with older versions of Linux and gcc libc5/6/gnulibc is not acceptable for any corporation who does not want to upgrade or can't (closed source apps)
In many situations where *any* downtime is unacceptable, Solaris or IBM as/400/AIX are the only alternatives. Think of a wharehouse?
Windows folks here do not take reliability for granted and it shows.
Solaris is a real OS for any situation where the server can not go down.
Also if your pc is supported (mine is because I buy quality parts) then its a great mature OS with little bugs.
The link is biased. Its by the equal opportunity commission.
This person was a secretary who was not qualified to be a senior manager. Nothing too it.
I admit I am biased too because I side with my brother who works for the company.
But I would be furious and angry too if I were an HR director and found out about this. Either find someone with managerial experience or get your degree first. The company has a right to demote someone unqualified to a previous position. She was not disciplined like the article looked but just told "We made a mistake" go back to what you were doing.
But it is illegal to cut people's pay in most states so in my opinion I would fire the director who hired her in the first place.
The director himself resigned after the incident and claimed the workplace was too hostile. Of course the chick had dirt from someone high up because the director was this chicks boyfriend.
My guess is the director backed up every allegation so he could get some of the settlement. F*ckin prick.
But yes the story is %100 true and the name of the company is FedEx.
They are appealing the case and because the director gave nothing but high performance reviews for the secretary so it showed there was no evidence to fire her. It must be because she was hispanic right?.. rolls eyes.
But lawsuits are very common in any corporation and yes they are out of control. Walmart has something like 250+ lawsuits agaisnt it at the moment and most of them deal with labor issues from inside the company.
I have seen workers who were fired outright for poor performance and not showing up for work only to complain to HR for sexual harrasment so they get rehired. Sadly it works.
I work at Busch Gardens right now in the traffic department and I see lawsuits occur almost on a weekly basis for all sorts of silly things. For example someone crosses the street outside the park and ignores the signs for the park entrance and gets hit by a car. Its the parks fault pay me a million dollars. Or someone hits another car in the parking lot. Oh, its not the drivers fault who happens to be using a cell phone and drinking a beer while leaving. Its the parks fault because someone needs to be in each parking lane observing and controlling traffic. That prick won the case too and cut our whole budget and we had to fire... you guessed... traffic controllers so the park is now less safe. Pay me money. Funny I do not see trafic controllers at the local grocery store lot soley to prevent collisions? Why here?
I mean where does it end?
Even if a lawsuit is not likely most hope for a chance for another chance at the job or hope for a settlement.
My brother works for a fortune 500 company which will remain nameless. This company opened a call center in Orlando for customer ordering and customer service calls.
The call center manager found a new job and gave the 2 week notice that he was quiting. The director chose his secretary to replace him?? Not only was she not qualified to be a secretary but she got the position from banging the director on the side.
Eventually the VP of HR found out about this and written up the call center director and threatened to fire him and he also fired the secretary who was promoted to manager.
The secretary then sued because she was hispanic and discriminated agaisnt. She won 1.3 million dollars!
Now tell me how frivilious lawsuits agaisnt wrongfull termination are not out of control?
I am not saying gays and lesbians should not have equal rights. I am only saying the more laws try to help the more lawyers will use them to hurt the people they are supposed to help.
For example I have aspergers which is a mild form of autism. Many employers wont hire me because I could sue the company for wrongfull termination. In other words the Americans with dissabilities act helps me in alot of ways but hurts me in the liability obbsessed corporate world.
I could see a lesbian or gay employee rightfully terminated but using a bs case like the one stated above to try to sue Microsoft. If you have a good lawyer more than likely you will win.
Just because they have a policy to protect gay and lesbian workers does not mean they can not be sued friviously.
Had a similiar problem with my asus A78X ethernet controller.
I just ripped out an old netgear nic from my older pc (worth only $30 to replace) and used that.
FreeBSD provided support for the broadcom ethernet card first then Linux supported it in 2.6 under a generic module. I too had a driver for redhat 7.2 but it only worked with the kernel for that distribution.
What a joke.
Nvidia solves this by providing a wrapper that can be compilied with future kernels and libraries. Why can't other device drivers do this?
That is grounds for a major lawsuit. You did not sign anything did you?
Hell my brothers employer got sued for promoting a secretary as a manager for a call center. A position she was not qualified for and got it by banging a director. She sued after she was terminated because she was a hispanic.
SHE WON! 1.5 million dollars.
If frivious lawsuits like the one above can happen then you have a fighting chance to sue your employer back. I mean your case sounds very strong.
Perhaps Microsoft wants their good performing gay and lesbian employees to have the same benefits and morale as their straight counterparts?
Maybe they want their workers who are gay to be happy and as productive as their straight counter parts.
Employement is a dual edged sword. The employer just wants results the cheapest and best way possible while the employee wants the best work environment, pay, and benefits for their family. Lower performance and job terminations happen when the needs are offballanced.
My hunch is lawsuit prevention might have changed Microsoft's mind on this. Any termination no matter what the cause can be turned into a "poor old companyX fired me because I am gay boo hoo".
out-migration? Strange terms indeed but I guess most marketers are into that.
Anyway you bring up the point that Microsoft and IBM loves to do. Play silly compatibility games to force vendors to stay with proprietary versions of their products in order to create lockin.
Redhat is extremely oppossed to the LSB for this reason and explains why ISV's are ignoring it. Redhat wants Oracle to only write OracleDB for RHAS. Microsoft only wants vb apps to run on Windows. This way they can charge an arm and a leg.
SuSE is trying to be LSB compliant but Yast overwrites many of the files if you ever run the configuration tool. This is of course is a way for them to claim they are LSB ready to help unseat RedHat but at the same time ensures vendors write to yast specific settings and not LSB.
Proprietariness is what commercial software is all about. Its about hiding things and preventing competition at any cost.
Not to mention Stallman started this whole GNU thing long after Linux got its name. Its too late.
I can call my car a XenotronT but would others know what the hell I am talking about? Same principle.
Linus calls it Linux so its Linux and gnu is not Linux nor is it a distribution. Gnu is run as well as possix under FreeBSD. Is it now Gnu/FreeBSD? All Linux distro's include non gnu software so its not gnu in any sense.
Funny these tar files 90% of the time wont work on FreeBSD or versions of linux with different versions of glibc.
Its broken.
Its like saying.zip is a perfect container because somje.exe program might install it for you. Meanwhile many (older)apps wont install on Windows2k and vice versa under Windows3.1.
But at least under Windows setup.exe in the zip file will copy the appropriate dlls and the OS can manage dll conflicts perfectly by having smart dynamic linking with multiple versions of dlls. I have not had a dll problem since the 1990's under Windows9.x
Even under a consele linux is waayyy tooo bloated. Most of it comes from glibc. KDE and GNOME are bloated as well but take up less memory on my FREE and NETBSD boxes.
If you put NetBSDS on your boxes you would certainly notice a difference in performance and memory requirements for that reason.
A kernel should not be more than a few hundred k in size at the MOST. I am not including device drivers which take up the majority of the kernel size.
USerspace should take up all the requirements and the kernel should always remain tiny since it only does basic operations. Algorithms and not wastfull lines of code is what brings scalability and performance.
NetBSD is a fine example of this and it scales very very well even on SMP sytems.
You will be surprissed what kind of quick boots and performance gains you will see. Especially if ram is limited.
That is the whole problem and why the BSD's are gaining popularity. Everything is designed and not grown and is simplier..... with the exception of the FBSD 5.x kernel.... ducks.
Places like Philly offer the wifi for $16 a month to pay for the infastructure.
So do we take away water and sewer next? After all why should I pay for your sewage? Why don't we sell it for the highest possible bidder to monopolies instead?
Unless apt-get improved since 2000 when a co-worker had this happen. Also I remember the debian team in linuxworld 99 in NewYork had the problem on some sparcs.
Maybe there are some settings now which can dig and find potential problems that could cause a problem with an existing library.
Many apps will work with older libraries but break with newer ones. The switch from libc to glib caused many problems with debian users and rpm users alot at the turn of the century if I remember.
This is why I went to FreeBSD with the ports. However similiar problems can happen there too.

Worse the libraries of libc5 and glibC were not compatible between the 2 compilers.
It was a very very big hassle and pain in the ass. Also gcc 3.0 was not fully ansi ready and had bugs.
gcc 3.2 became finally stable enough.
VC++ could compile STL code in addition to older code for years before it become ISO certified to the latest version. Then porting was not a problem.
Linux suffered a big problem due to compatibility issues with apps compilied with different versions of C and C++ and libraries. It was awefull.
Linux become more bloated as a result too since libc5 was much smaller. The BSD's handled the transition alot better.
Dumb question?
Isn't woody still based on 2.95?
No offense but its hard not to make fun of debian. Good lord.
Debian user?
The director himself resigned after the incident and claimed the workplace was too hostile. Of course the chick had dirt from someone high up because the director was this chicks boyfriend.

Nope RMS called Linux gnu linux somewhere in the late 1990's if I remember.
Its Linux and always has been called Linux.
I am not anti gay but let me tell you a story?
My brother works for a fortune 500 company which will remain nameless. This company opened a call center in Orlando for customer ordering and customer service calls.

You can sue for quite alot of money.
That is definitely non frivilious big time and if people can backup your claim then you have a major lawsuit.
Did you call a lawyer?
That is grounds for a major lawsuit. You did not sign anything did you?
Hell my brothers employer got sued for promoting a secretary as a manager for a call center. A position she was not qualified for and got it by banging a director. She sued after she was terminated because she was a hispanic.

This is why they are now agaisnt the bill.
It serves Microsoft's own corporate interest to protect themselves if any gay or lesbian employee files a suit agaisnt there company.
Believe it or not the Americans with dissabilities act and non discrimination laws are being used in almost any lawsuit dealing with job termination.
Many employers now prefer not to hire anyone with a dissability or member of a minority race for that reason. Its gone out of control.
out-migration? Strange terms indeed but I guess most marketers are into that.

Yep
From a business standpoint the conclusion statement is correct.
On WIndows or Solaris I can run a 10 year old app. Can I do that under Linux? Will it run 10 years from now?
It keeps changing. Old libc programs wont even run because the dynamic linking under anything non mac/Windows is too limited.
Funny these tar files 90% of the time wont work on FreeBSD or versions of linux with different versions of glibc.
.zip is a perfect container because somje .exe program might install it for you. Meanwhile many (older)apps wont install on Windows2k and vice versa under Windows3.1.

Like these managers would let them go to the US.
I bet these workers were searched to make sure they would have no passports so they would be forced to stay under slave labor
Go try a BSD?
Even under a consele linux is waayyy tooo bloated. Most of it comes from glibc. KDE and GNOME are bloated as well but take up less memory on my FREE and NETBSD boxes.

Try NetBSD
Also glibc is the culprit for many bloated apps in userspace.
KDE and other other apps take up less memory on FreeBSD than on Linux for the linking reason believe it or not.
NetBSD with Windowmaker will run quite well on that old laptop for hacking.
Try NetBSD on your box?
You will be surprissed what kind of quick boots and performance gains you will see. Especially if ram is limited.
That is the whole problem and why the BSD's are gaining popularity. Everything is designed and not grown and is simplier..... with the exception of the FBSD 5.x kernel.... ducks.
How does this relate to end of this trial?
I want to see sco fail and then go bankrupt like everyone else, but I just want this sore/wort to finally go away and McBride get his prison sentance.
So far all I can get (I am not a laywer) out of this is motion is that SCO wanted to file more compliants agaisnt IBM and the judge denied it.
Educate yourself?
Places like Philly offer the wifi for $16 a month to pay for the infastructure.
So do we take away water and sewer next? After all why should I pay for your sewage? Why don't we sell it for the highest possible bidder to monopolies instead?
Yep parent poster is correct.

But apt-get is a big improvement over rpm.
