  1. Re:State and Federal law books on Pick Up A Piece of Enron · · Score: 1

That's honestly all they are probably good for now. The law changes so much that I have seen literally whole bookshelves worth of books thrown away and replaced. Basically, if you need shelf decoration and want to look smart, that's all these books are worth.

Oh, by the way, IaNAL yet, but I only have to pass the bar. :)

  2. Blew southbridge on Your Most Damage-Resistant Hardware? · · Score: 1

On my AMD mobo, i Had a blue ORB fan attached to the southbridge. Anyhow, one of the IDE cables hit the blades, snapped it off, and the blade got lodged in the cooling fins. It jammed the remaining fins, which jammed the motor, so it actually created heat, rather than dissappating it. Needless to say, the southbridge burnt out soon enough after that.

Quick speculation to any lawyers and law students. Do you think that if personal jurisdiction would have failed, the defendant would have had a credible claim on venue. Venue is not a constitutional issue as much as personal jurisdiction, but it's hard to see a California state court claiming that venue is fair to the defendant in this case. I can't help much since I only really know the lovely FRCP.

They actually tried to do this two years ago, i think. It was supposed to be called SimsVille, but it turned out that they could never get it to be stable apparently. They canned the project. It's a shame too, looked really cool. Do a google for Simsville for it, I think there are probably a few news articles around.

  5. You actally like the Play test? on Virtual Simerica · · Score: 1

Have you even played it? A lot of people are complaining that the game is not balanced is more of a chore than actual fun. Then again real life is a chore too.

  7. Article is a little incorrect on Organizing Sim Protests · · Score: 2, Informative

The article notes that this McDonald's object is currently in the public beta. I played the beta last night, and unless they have placed a patch in today, the McDonald's kiosk is still not in the game yet. So no real point in protesting, yet. Of course, they haven't put in any of the job modules either. So my Sim goes around and plays carnival games in order to make money for his home. He also basically lives and sleeps in the house next door which is owned by my friend. Talk about replicating real life . . .

  9. Re:Frequencies that cook food? on New Lighting Technology To Wipe Out Wi-Fi Access? · · Score: 1

Well one thing is that the frequency used in the microwave ovens to cook food works by having an exact frenquecy to the resonant frequency of water. This makes water vibrate faster, which produces heat, which cooks your food. Other devices dont use this exact frenquecy, which is why there don't act in the same way as your microwave. It isnt so much a matter of power as it is the exact frenquency.

  10. Ethics Code on First, Do No Harm - A Hippocratic Oath for Coders? · · Score: 1

For some reason, an ethics code with doctors seems to work better than with other professions. I think it may have to do with the very real feeling of holding someone's life in your hands. Anywhere else I have seen ethics codes, there are more like suggestions.

Lawyers have a enourmous ethics codes. THey will actually go to court about violating ethics codes. There is an ENTIRE FIELD OF LAW devoted to lawyers violating ethic codes.

True, these are probably the absolute ends of the sprectrum as you can get, but it seems like ethic codes are more suggestive nowadays than anything. Especially in computer fields, where the objective is to get the machine to do things that were unthinkable months ago. When was the last time there was a class of coding ethics asking not whether you can do something, but whether you should.

  12. Re:Judging before interestest become vested on 321 Studios Plays It Safe Against the DMCA · · Score: 3, Informative

Ir sounds like a good idea, but I don't think it will work for two reasons. Take this with a grain of salt, because I am still a law student, but it's my two cents. What 321 is doing here is asking for a declartory judgment, because they know that they could be sued by the software on the basis of the 2600 case. This is a direct contrversy which the court can actually adjudicate against. However, if a company like Napster tried to obtain a declaratory judgment back in 1998 when it was just first starting, it wouldn't be able to because there would be no existing claim or contraversy, and the court would not be able to adjudicate. Courts, unfortunately, are inheriently limited under Article three to only adjuicate claims and contraverises. Secondly, merely a lack of legislation does not preclude a trial later on. Once legislation banning the software goes into effect, it automatically creates the cause of action necessary. The amout of previous adjudication does not matter simply because there was no existing violation under the law because it did not exist, and now there is a violation.
