(Yes mods, I know this is starting to veer offtopic - sorry but this deserves an answer) Let me add one to your seried of events: #0 Asshole lops you on the head and takes your gun instead of your PDA. #0.1 Asshole sees you put up a fight and shoots you.

The first rule of being street-smart is realizing that carrying a weapon merely puts a weapon into play. It doesn't always mean that you control the weapon. This, of course, can work both ways as well.

My case, like someone else noted, was random. Neither of us were armed. If there were a weapon in play one of us would have been hurt a lot more than black eyes and a bruised head.

Sacramento, CA - Oak Park/South Sacramento to be specific. Not the greatest place. The guy got a PDA by chance. It was in my pants pocket and he pulled it out after a few blows to the head.

"Petty" crime like this doesn't mean that much to law enforcement anymore. No real profit in it without over-spending on manpower I gather. Easier to patrol, pull people over and randomly search. One guy getting mugged at a gas station doesn't warrant the press making them get involved either.

You know, last week I was mugged. I was beaten about the head pretty good and had a $300+ item stolen from me at a gas station near my home. According to the Sheriff, "strong-armed robbery" is a misdemeanor. They didn't even want the security camera footage. Now if that same asshole had "stolen" a song, game or movie via file sharing he would have gotten an investigation, time, fines... hell - even a C&D would have been better! Maybe it's time the papers realize that re-printing their content online and requiring everything down to maternal shoe size for access is not a great business model. If some large paper, say in a big city like... um... New York had beaten Craigs to the punch or tried to compete in a similar manner instead of being stagnant in a dynamic medium, this wouldn't be a problem. I guess the old way didn't translate very well into a new medium.

There's an eloquent way to seperate the religion from the science: Science is there to try to explain the how (How does a rock fall? How do we procreate? Fact based questions.) Religion is there to explain the why (why does the rock fall? Why do we procreate? Theology.). The trick is to make the seperation - something we as americans are no good at. School is responsible for the science as there's a common denominator of provable fact. Parents/gaurdians are in charge of the religion as it's more subjective and faith oriented. The folks fighting for schools to teach the theological are shirking the responsibility of teaching it themselves. Damn convenience based society!

The first one that comes to me is to convince the Admin at work that there is more in the world than an MS solution. I think I already mentioned that. Second is being able to do better traffic and load analysis on our IIS (I know, save the speech) web server without actually installing Cygwin, which can be a security risk. The fewer usable binaries living on a production box, the better - that we both agree on. Since I have no choice about the server software we're using, I can at least use some alternative tools and not leave them hanging around on a production box should someone root it. This means that I just eject the CD and they are gone. Admin happy and cracker sad :D

I hadn't really thought of Cygwin as a "portable" solution until this came out. Many other posts have also included instructions to roll your own and put it on a flash drive. Now that I'll be playing with the idea, I'm sure I'll find more uses.

    Consider these ideas:
    • Take a CD to work and use X on any machine with a CD drive
    • Use this as a framework to add more applications like dev tools, auditing tools or desktop apps (probably forking the project, but interesting)
    • Use it to prove to the ill tempered that *Nix is not all bad and quite usable
    • Find a way to port it to Flash drives and such
    • Another valid use of BitTorrent :D (the download of this iso that is)
Remember that this is an early version. The best uses are to come probably.

Where do you get the information about lawsuits from? There wouldn't need to be any spying. All it would take is some eBay searching and a compaint to the eBay VeRO Program. They don't have an "About Me" page on the VeRO information, but that doesn't mean that they aren't involved. eBay will bend over backwards to help them as long as they don't file a suit against eBay itself, like Tiffany did.

eBay isn't the only auction house on the web, and even assuming that they hire a largish tech team to spy^H^H^Hwatch many sites, they can't see everything.
It wouldn't take much to whip up some bot scripts that troll various auction sites for keywords and such. Sure, sellers could try the whole 1337 writing style stuff that spam has become so notorious for, but that will just make the items less likely to sell due to seeming fraudulent or at least unsavory. Yes the eBay alternatives would be harder to track than eBay, but the customers won't be as plentiful. eBay is sure to help them out citing copyright and trademark violations.

I think Blizzard has a good chance of severly curbing auctioning or at least making a royal pain in the ass to do. If they manage to make it almost as hard as actually earning the item, then they have won. The final word being Blizzard's of course. They can can/ban you for anything they feel like and not care much about false positives if they so choose.

For example, surely it wouldn't hurt Microsoft if they GPLed Windows 95.
It would hurt them for a couple of reasons:
    • Everyone could see where they may have cut corners, written needlessly redundant code or were just plain sloppy. Not good PR. Especially in their eyes.
    • They still have patents (and other IP) pertaining to lots of stuff in Win 95. In their view, GPLing such code would be exposing those patents to unnecessary risk of infringement.
    • People would fork it and not get the next release of their products. They would rather see you buy a copy of XP or 2K.
You may want to scream FUD at me, but I think in some ways they would be justified in believing these things. You may think differently (hint), but their legacy code is part of their legacy business model.

Win 95 was a multi-layered beast with parts of DOS and Win 3.x, so saying "GPL Win 95" is actually saying that they should GPL a combination of things. Perhaps it would be easier to hope they would GPL bits of it, like say the FAT driver.
