Say I download the GIMP, make some local changes for 'freaky new feature 2000 (tm)', use that to make some images. Am I obligated to release my changes to the GIMP. I don't think so, it in fact seems absurd, thought other output is the same in principle. I agree that it goes against the community spirit of the GPL though.
Your typical baseball bat weighs 30-34oz. (around 2lb) and it takes a fair amount of effort to swing one with any great speed. So I'd imagine that anything substantially more heavy would present problems. Granted, a sword is more balanced for smooth motion. Also, in the measurement of kinetic energy ( k = mv^2) the velocity plays an increasingly greater role than mass as each increases. So it would be in the interest of the user to get a faster blade after a certain break-even point.
From the look of this game, the 3d models, applied textures, and artwork in general appear to be a LARGE portion of it. So open-sourcing the engines is not such a big deal. It's the same as Quake II, where there are several games using the Q2 engine but with varying results.
Still, this is a good thing, and it does not fit the model of what is logical to fully open.
Eventually there will be no more money for the herds to throw at the stock market. Then we're in for it. And the CEOs and higher-ups who make out on the IPOs will be laughing all the way to the bank.

It was originally going to be a 'fsck the man' sort of thing where individuals could register for low $$ and corporations would have to pay big $$ for their.sux domain. Then we figured there's already a word for that, extortion, so we dropped the idea. We kept the TLD though, and domains can be registered here
The DOJ angle is not neccessarily applicable here, since the 'ownership' is merely a side effect of what seems to be a merger that makes sense.
I could see the DOJ, as part of a settlement, forcing MS to divest this holding for two reasons.
1. Part ownership of a competing app suite
2. Part ownership of a big distro of a competing OS
Since those are the two biggest areas of complaint against MS, having them own a stake in the competition, whether intentionally or not, could cause problems.

It directly kills very few (those who were really on the edge) but the most devastating effects are against the strong and healthy. The victim's own immune response is responsible for their death in many if not most cases. That cuts out your HIV argument, since an individual with a comprimised immune system will not be able to have a deadly powerful immune response. This premise is illustrated by the fact that said 1918 flu had its worst effects among otherwise young & strong soldiers participating in WWI.
