The only REAL problem here, is that in the US, this kind of corruption is perfectly legal.

Not in this case. This is a case of "What else can a state do?" States have limited options on how to encourage business in their state. Generally 'job creating' measures really mean 'taking jobs from other states'. The net jobs created in the US are 0, and the different states fight over some job relocations. In this instance the state legislature is trying to look good to their local small businesses (ie car dealerships) by enacting protectionist legislation. Even if they didn't get any campaign donations, they can use this act at "I protect local businesses" in their next campaign.

Where's the incentive to improve the software on a subscription model?

You have to attract new customers and keep the existing ones. With an online subscription a customer didn't sink tons of money upfront to get the product, it's a monthly cost. So if a customer sees someone else providing a better monthly ROI, they would just switch who they get their subscription from. Plus there were lots of "cloud" companies that really struggled with the recession; while it was easy to sign up new customers pre 2008, once budgets were tightened, cloud service were being dropped right and left. So the incentive is to provide a higher monthly ROI, or else you'll get dropped.

But the main reason why isn't to save power, some people just like starting over every day. The reason why hibernate was removed was because people are getting so much RAM that it's taking way too long to write it to disk and read it back for it to be a performance advantage. End users have a much better experience if they sleep their computer, and then the computer goes from sleep to hibernate after a few hours.
