    It is government's job to assign the real cost of carlessness back to the folks who allow the problems. I am not for big gov't regulation, but requiring disclosures of security procedures, and a penalty for each customers' data that is lost would get the attention of management quick.

    Depends upon who you are talking about. We know that MS does not have this issue to deal with.

    It's FUD. You're correct on the technology pace, which has a parallel in the GPL vs proprietary software battles. It is not a coincidence.

    It makes sense to you, me, any many, many others.

    But, it doesn't make sense to those that have an agenda. And they certainly found a group that would provide 'ammunition' for their agenda.

    The questions are framed in terms of privacy issues, not freedom of expression. Most of the respondents likely didn't even think about how it could affect themselves personally if and when they would want to express themselves on a blog.

    This is slippery slope stuff.

    The kernel development process *has* already changed. The 2.6 series (vs 2.4) really was able to use BK effectively in conjunction with those 'control model' changes. Linus has already said that he doesn't scale. So, the way it's being handled now is the way it will likely remain. He's not likely to change his behaviour because of a tool problem. He will find a new tool.

    No, the government's first and foremost duty is to uphold the Constitution *regardless of the will of any group arrogant enough to call themselves 'the people'.* If 'the people' don't like that little fact, too fucking bad for them.

    Except when 'the people' are no longer upholding the constitution.

    It's up to the Judiciary to 'uphold the Constitutuon' these days, because the other branches of the U.S. government are not.

    The Forces Of Evil are now attacking the Judiciary via Tom DeLay:

    "We have unaccountable, out of control judiciary. We are after them," DeLay said.

    "The Constitution gives us (Congress) the responsibility to create courts. If we can create them, we can uncreate them," he said.

    This is truly scary stuff folks. All I can ask is that the current judges wake up and stop this blatant attack on the constitution. These people have no bounds.

    Well, sure. They can try to sue you. But by your own experience, how could they prove that *you* (psychophysically) are the 'you' (named defendant) that is also 'you' (named plaintiff)?

    And if you sue yourself, can you actually win a judgement?

    This may be more about defending attacks on Tivo than fending off competition.

    Indirectly, it then also becomes a defense against attacks on Linux.

    So, it may actually make sense that IBM would sell these patents outright. They have more utility being used by Tivo than directly by IBM.
