Its the things that he doesn't say but implies that are the real sneaky bits.
    1) Fair use isn't about making personal backups (I'm talking putting the song on your favorite player not copying for your friend).
    2) CEA is self interest, but the RIAA is better than that..

Also he never said that fair use rights "must be respected" he acknowledged they exist. But the RIAA and MPAA have shown disdain in the past for research and other fair use rights when they require breaking encryption to achieve them.

These extra tax breaks don't mean as much to the smaller employer who simply can't afford to shell out $600+ a month per employee for health insurance, while its a small amount of money for a large employer who can afford to shell out that kind of money, which of course forces prices farther up.

Well about half of them did forbid any type of social contract, while many states only specifically banned "marriage". I noticed one state (I guess it was Virginina) who like you said banned recognition of any union outsize of marriage, which is odd because commonlaw marriages have been around for a long time.

Whos going to take their software and modify it for their clientel for free? Noone.

I'd say to original question, feel free to open source I if your in an obscure area its not really going to hurt you, you can still sell your programming and support services. But if there is no good reason besides wanting to incorperate other already freely available open source code I'd say don't bother, its not worth the risk.

Now if your clients are requesting source code for the software you are selling, if its a custom app, thats another question entirly, but most development places are willing to do this.. For a price.

There is huge amounts of legal room to argue the actual constituationality of this.
