    The sad part is, that they think they can sell *protection* with that...

    ie - they try to sell you their live onecare service... If they know their operating system is that vulnerable, why not try to *fix* it - and not with some flaky "would you like fries with that? [ yes ] [ no ]" piece of shit system that *all* the end users who allowed crap to be installed in the first place will *always* answer yes to - that just makes things worse.

    Application call-outs are restricted by default using Comodo... no applications are trusted by default. I have to authorize or deny each connection request. It's a pain, but yes, I do prevent that from happening.

    Actually, in many cases, breaking the seal on the package (at least according to the writing on the outside of the package) is enough to be considered agreeing to the EULA, which you cannot read, UNTIL you've broken the seal.

    Now, I get around that most of the time by not breaking their *SEAL*, I merely open the package in other ways - like through the center of the box, without touching the seal/sticker/etc.

    It is still irksome that they feel they can enforce that kind of agreement on users, so turn-about is more than fair.

    I have an SPLA posted on the front of my computer, very clearly labelled, and in big bold print.

    It basically states that by allowing your software to be installed on this hardware, you (the software provider) agree to the following.

    1) Your EULA is null and void.
    2) Your software cannot make any changes unless I agree to them beforehand.
    3) Your software cannot call home unless I authorize it, every time (this is enforced via firewall rules outside the box).
    4) Your software cannot interfere with the operation of any other software on the hardware installed to. (prohibits viruses, malware, adware and automatic disabling software)
    5) Any violation of the above terms can constitute a cyber attack against the hosting hardware, and treated as such, and dealt with using the strongest legal measures available at the time of attack.

    Granted, my SPLA will hold up in court as well as their EULA, but it is posted, and yet their software installs - so they are as bound by my terms, as I am by their terms.

    No, this is sales tax - ie - when you register the car that you've just bought, you pay the *SALES TAX*, plus the registration, then it's just registration renewal every year after that.

    Where I live, it doesn't matter *where* you bought the car, it's where you register it that sets the tax rate.

    So unless you registered it in a county that you didn't live in (which this state disallows), you'd have to pay your local county tax.

    Print a mini-contract on the back of the check used to pay the bills with said company.
    Essentially state that by cashing this check, the payee agrees to release the payer from any and all contractual gag-orders or other stipulations that would limit the payers ability to counter problems that payee's product / service / support may give.

    Then when an issue arises, wave the cashed check as the contract. It's as legal as the hodge podge the vendor tries to shove down the customers throat.

    Better yet, photocopy the contract, and release it to the public (before signing it).

    That's the problem... (which apparently you spent ZERO time researching) XP has NOT been discontinued. Hell, they finally just discontinued Windows 3.11 last year.

    It's still being produced (for certain OEMs and embedded markets) and government contracts (which refuse to go to Vista, as do most corporations who have site licenses - so sales continue there as well).

    Sorry - as long as they sell it *ANYWHERE* then it needs to be available *EVERYWHERE* otherwise there's potential for lawsuits like this, which should win every time.

    It's already in use by people pissed off at others - fake license plates attached to your car (usually with someone you hate's license plate numbers and tags), covering their plates, then run red lights, speed through intersections, etc...

    Now it will be used to avoid tolls...

    oh - and as for scriptable? *Everything* in ESX is scriptable - you can run 100% from command line if you want (I prefer command line for most operations).

    It's the only way I know of to tweak things like ESX firewall settings as well.

    So - something that's out - right now, is pretty much the king of the hill, or hmmm - wait for something that's *going to be friggin awesome man*...

    Sorry, I'll go with something that works now, has all major vendor support (IBM, HP, Sun) and is rock solid, and continuing to evolve.

    RedHat anything has left me yawning (from lack of sleep) due to inconsistent installs, things that work on one system, don't work on the next identical (all hardware the same) system, using a standard kickstart installation so that the same packages, drivers, etc are all installed. So far, we've stumped RedHat support more than they've helped.

    Maybe in 10 years it might be something, but for now... not.

    I'm currently working with vdm and Sun's SunRay Server software...

    It's very nice, and since the virtual desktop machines sit on the ESX cluster, hardware upgrades are too damned easy...

    Install the new hardware, load esx, add to the cluster and migrate running VMs as needed (or watch them migrate automatically if any of the old cluster members are overloaded)...

    They continue to make money on UNIX (Solaris / OpenSolaris is still UNIX) but they make it in services (Support, Customization, Configuration, Installation, Maintenance) etc...

    They make money on integrated devices - like their new openstorage platform, based on Solaris x86 and ZFS.
    They make money on hardware that is able to run multiple OSes (Solaris x86, Linux, Windows (bleh) to name a few).
    They make money on hardware / software combinations that stack on top of other vendor's products - like Sun Ray devices and Sun Ray Server - integrated with either Windows Terminal Server or VMWare's VDM (which rocks btw).

    With a wide range of products and services (wider than any that RedHat can offer - sorry - RedHat doesn't make their own hardware), I can't see how anyone can claim declining for Sun, and increasing for RedHat, when RedHat's product line is so narrow.

    The only way to get the federal, state and local spending down is as follows...

    Quit giving handouts to the lazy and incompetent (this includes 99.9% of all politicians right off the bat - that's why they became politicians...).

    Make the lazy and incompetent politicians fiscally responsible for any overages in the budget.

    Make it a death-penalty offense to touch Social Security in any way shape or form (once it's removed from the general budget, and all funds that were illegally stolen from it are paid back with 999% interest.

    Restrict all elected offices to 1 consecutive term in office. You can get re-elected as often as you like, just not consecutively.

    Re-write the laws in layman's terms, using "If you do this, then this is the punishment" terminology.

    Restrict businesses from having a voice (ie - people who work for or are given funds by companies cannot lobby). This one is important, as it would only allow individual citizens who see a problem to speak out for a company or corporation. No one who could gain financially or otherwise would be allowed to speak out on behalf of a company or corporation.

    Restrict running for office to people with IQs over 135. Restrict voting to those with IQs over 130.
    Chemically sterilize dead-beat dads, and welfare moms until they are paying their child support, and/or have a job that pays more than they earned on welfare.

    Remove the insurance companies voice in what doctors / hospitals can charge for services.
    Disallow corporations from running Hospitals and medical clinics. Require they all be not-for-profit.
    Disallow frivolous lawsuits - if you fucked up, you deserve what happens to you - this includes, but is not restricted to - spilling hot coffee on yourself, slipping on the ice when running into a store, falling on your ass because you're too fat to walk.

    Require renewal of handicap tags every 6 months (requiring doctor certification) - make new tags that *fade* to blank at 6 months. Push up fine for parking in handicapped spot to $5k per occurance, one occurance gets your car towed, smashed into a block, and placed on your front lawn. Same thing happens on first drunk driving offense - only on Drunk Driving, you lose your license for life - no chance for reprieve - you get to take the "I'm a fucking drunk driver bus", which you have to pay for - at least $1000.00 a month to ride on.

    Hmmm - I'm sure I'll think of something else while I'm in my ranting mood...
