  1. Re:Yes and no. on Is RIM's Centralized Network Model Broken? · · Score: 2

Remember their devices from yesteryear? You know, the business-only, no bullshit phones that would be totally useless for Joe Consumer?

Actually, I remember their devices from yesteryear as one of the first two-way pagers. AFAIK Motorola was the only other company doing two-way paging and they didn't have the back end to allow the kind of messaging that has been the hallmark of Blackberry devices from the start.

I believe the upcoming BBX handsets are going to address the consumer market and Blackberry Balance will be used for convergence. RIM has always understood the needs of large infrastructures to exert a certain level of control and the BES allows enterprises to place as much or as little control as they wish. It's a stark contrast to the Pied Piper strategy Apple employs or the cat herding that Android (or OSS in general) tends to engender.

Except the rule sets the limit based on the data that the 85th percentile will be traveling 10 miles over the posted speed. So if they want you to only go 65 MPH (105 KPH for non US residents) they will set the speed limit to 55 MPH (89 KPH) to ensure the 85th percentile will be going 65. BTW many states have a law that you must travel at the average speed of traffic for safety meaning if there are over 50% of the vehicles on the road doing 75 in a 55 and you are only doing 55 then you are breaking the law as much as they are. You are just breaking a different law.

I'm guessing you are not familiar with the actual history (The facts) since the case would still be in the courts if Microsoft hadn't settled. The truth according to me is that Jobs was a visionary with decent business acumen while Gates was an average coder who became a very shrewd businessman and marketer. Had Jobs had the forethought (and ability to allow someone else to make decisions besides himself) to get some shrewd businessmen/lawyers/marketers Apple would most likely had a much larger footprint by 1990. Instead he trusted Microsoft to honor their contract and got burned. Which I believe ultimately lead to Jobs acting more and more like Gates.

No, just like with murder charges wilfulness is important.

When you put someone on trial for first degree murder you're saying "we think they commited murder, but specifically we think they did it entirely wilfully and planned ahead" (give or take)

They're saying that in the event that the basic charges are found to be true, they'll assess whether it was a simple fuckup on Google's part or whether they knew what they were doing and did it anyways.

not a lawyer, all that jazz.

Which has always struck me as odd. How can we (United States) claim that our justice system is blind when we turn around and categorize levels of a crime based on intent (willfulness)? I'm not saying I disagree with the practice just that our system isn't nearly as blind as it is portrayed.
