Responding to an AC I know but in this case I believe Zurich has a case. Sony's was warned at least three months prior to the incident that led to their outage that their system was at severe risk.

It would be like me leaving my car parked in a public parking lot with the windows slightly down and the keys in it. I let it sit there for months and several concerned individuals drop by to tell me there are undesirable elements in the hood and they have been stealing cars. I ignore these naysayers and go happily on my way until one day the car isn't there anymore. Then I go to my insurance company and ask them to pay me for a new car. They will say I was negligent and therefore they are not liable for my replacement costs.
I had to do the same with my wife's Cliq. I was told when I bought the phone it would get 2.1 in less than 2 months. I told them I wouldn't get it if it wasn't going to get the update. 10 months later and Motorola is telling me 2.1 will not work because it only has 256 Mb RAM. Well XDA and Simply-Android to the rescue. I was rocking Gingerbread in no time and with a little tweaking the phone is stable and fast. Somebody handed me a stock G1 yesterday and I'm thinking it's just not fast enough or enough RAM. 2 hours later I have it rocking a custom Gingerbread ROM and it is quite snappy. My son replaced his dumbphone and is enjoying Android goodness via WiFi.
I will grant you that the ITU did get tired of US carriers crying and has allowed them to use 4G in their marketing despite their networks inability to actually meet the 4G specification.
Actually the s in the 3Gs was for Security as it was the first iPhone with hardware encryption (which was circumvented in less than 15 minutes IIRC). But I wouldn't put it past Mr. Jobs to re-purpose the s for speed this go round.

It was TOTALLY their intention to imply it was "faster" just like every current implementation of 4G out (LTE included) is not in fact 4G. 4G has not been deployed commercially anywhere yet. Companies spend millions figuring out ways to convince the consumer something about their product that isn't true. It will make them more desirable, less of a failure, more confident, the list goes on.
