I'm not sure why "someone" would call them on it, It's not really anybody's business except the authors and the developer's of "Software Project A". If I wrote the tidbit, and somebody "discovered" that it was stolen and told me, the deal would still be between me the copyright owner and the alleged violator, not any third party. Not every project needs to have the entire application "open" Like slashcode? Most of slashcode is GPL but as I understand it, the karma system is closed. Anybody can use everything, except the karma system which is what make slashdot unique. Don't get me wrong, running amalgam through waste water reclaimation where the sludge is burned in a fluidic-bed incinerator is very bad for the enviroment because it results in toxic organo-mercurial compounds being formed but that's different than the half pound that might end up settled to the bottom of a landfill after a century or two.

No, artists are supposed to recieve a royalty every time there song is played on the radio, jukebox or DJ, but you can imagine how often the lables are forgotten to be paid for the above, and how often the artists are forgotten even when the labels are paid.

Last time I was in the Jury pool, the presecuter went to very long lengths to explain the difference between "preponderance of evidence", "reasonbable doubt" and "any Doubt" blurring the differences tends to get you excused from jury duty. The truth is once the FBI gets interested in this guy and supeneas ISP logs, they can start looking at what he's actually downloading, when the pics are downloaded, when the 'puter was accessed through the subseven backdoor and what the timestamps on the illegal material is; the guy going to be toast anyways. I'm sure his logins quickly got transfered to the "special server" that does a more meticulous job of logging than the "normal servers" do. Imagine the task faced durring discovery when the prosecution sends over 5 or 6 DVD's of server logs of everything that came out or went into your clients computer. The Gov can throw a lot of resources into a prosecution and even an ER doctor is going to get bled dry by expert witnesses at $300.00/hr to counter the governments experts.

how about ReiserFS, ghostscript, and our favorite lightning rod for flamefests MySQL? I was actually looking at namesys's and an average joe can even contribute code to the project as long as every submition contains an legal agreement which I assume allows them to dual license.

Elemental mercury really isn't a problem; combinded to form a organic-mercury compound it's very toxic and most people confuse the two.
