They thought it may be related to a bad batch of GPU daughterboards from ATI, even though the machine fell slightly outside the list of affected S/N's. The machine was shipped out, a new daughter board installed and a new DVD burner put in ("when we opened it up, we just didn't like the way it looked") and was being booted on my kitchen table before New Year's Day.
On a machine 10 or 11 months out of warranty. No optional AppleCare.
They both have the same processor, same amount of RAM, same GFX capability, same battery life (7h according to the manufacturer) et al.
A difference of $90? That difference is more than made up by the extended coverage cost, on the same pages you linked: $190 for 3 years (Apple) vs. $299 for 3 years (ASUS).

One problem is that California has a large enough enthusiast community that there are workaround laws, rules, and procedures in place that other states do not adopt when they pick parts of CA to follow.

That said, I'm wondering if Samsung and others with FRAND patents and so forth have changed terms with chip makers (Qualcomm) to prevent the exhaustion idea from being a successful defense in the future. Investigating that would be more useful than the bloviators discussing every little move in the ongoing bits of various lawsuits.
Should obviously be secured by soldiers, since there is no private company that can invest enough in training or maintain the highest level of discipline. Of course there would probably end up being photos on the internet of the soldiers peeing on the nuclear warheads or shooting the nun from a helicopter...
