    If somebody wants a Louis Vuitton handbag, but the actual bags are too expensive, but the guy at the market stall has them for a quarter of the price, then this is great, right? Win win.

    That is true, but how is it relevant? Parent is concerned that by purchasing apps, he is sending money to apple. I'm pointing out that many apps are free, and he can purchase them without sending money to apple. And all the default apps are already great, so you can make phone calls, send text messages etc right out of the box.

    It will limit customer choice in the short term, but in 6 months a diverse phone ecosystem will bloom. Winning.

    Week that's the issue in a nutshell, isn't it? People like the iPhone for iPhone features. Another company wants to make their own phone with iPhone features. But this is illegal. So apple sues and wins. If another company wants to make an iPhone killer, why not just design a better phone? Just a thought.

    How are they cheaper? Apple has phones at $100 / 200 / 300 price points. This is pretty standard across the board.

    How does it limit customer choice? Samsung will go back to the drawing board and come out with some killer features that don't infringe. Wouldn't that be more customer choice?

    I think you can get an iPhone 3GS for free with contact... So you can meet your criteria but also have an iPhone. Alternatively, if you buy an unlocked phone on Craigslist or whatever, then no worries about the money going to apple.

    My intuition is that this bump is not due to people switching from apple to Samsung. I wouldn't be surprised if they picked up a couple people who would have otherwise gone htc, moto, etc.

    I take it this is a typo... surely they meant 2", as in, Kindle Fire 2", Finally, a kindle fire that you can fit in your mouth!

    they might have been sold out, but the understanding at the time that more stock was on the way... apple never said "we're not going to sell the iphone any more!"

    He has a reasonable point about travel. You need. Drivers license to drive. You. Need dl or passport to fly. I suppose being a passenger or riding a bus or train is ok. But for all practical purposes, if you want to travel in US, then you have to be prepared to show id to cops and expect to be put into a database.

    Dude, no worries, this isn't a big deal. These days, the cycle is innovate, get acquired, cash out, and innovate again. Wash, rinse, repeat.

    I think it's awesome that you want to innovate in softwAe. A good role model might be the guys that did that draw anything pictionary game on iPhone, thA were snapped up by zynga, or the guys at ngmoco thAt were snapped up by ea. or the guys at posterous that were picked up by twitter.

    There are plenty of great role models for what you're trying to achieve. Good luck!

    Flip side: tesla innovated just fine, building a new generation of electric vehicles. Teyre now a public company and on the cusp of rolling out a new model. Clearly patents did not hold them back.

    I'm sorry, I disagree with you. Your PC differs from the Mac Mini in several key aspects:
    * operating system. Mini runs osX, and can run Win XP/7/8, unix under virtualization or on boot. This is a superset of capabilities of your PC box.
    * input devices. Mini works with a multitouch trackpad, and OS is built around multitouch commands. PC is not.
    * connectivity. thunderbolt.
    * form factor. yes, this is a big deal to some people. this includes size and aesthetics too.

    You may not care too much about these four bullets. but some people do, and some people are worth paying more for them. however, there's no way you can argue that the PC you got is identical to the mac mini.

    I work best when throwing ideas around and talking through challenges. don't like working alone in a cubicle. so it works really well for me! doesn't hurt that my programming partner is a cutie (girl, to be specific).

    let's get specific. here's some brainstorming. I think there are infinite ways to solve these problems; the ideas below are just a sample. I'm going to be generous with the scope of apple's patents, to bolster my argument.

    slide to unlock. how about circle to unlock? spin a wheel? face recognition (like samsung)?
    rubber band. how about slowing the scrolling to zero as you approach the edge? you could call it friction scrolling. or the glow effect that android has.

    look and feel of hardware ("rounded rectangles"). I think this description is unfair to apple and the description is more comprehensive than the actual patent. still, face value. look at the nook - it has that neat cutaway in a corner that you could attach a carabener to. kindle has an offset screen, with either a full keyboard or other physical controls.

    look and feel of software. look at win phone 7, webos.

    so, you see what I mean? there's an assumption that there's no way around these patents, because they're like convergent design, but I think that's lazy. the world is full of infinite ideas, which is why it's so great to be human!

    umm, no... you're right, to build a phone you need patents for 3g, etc. these are standards essential. you can buy them on frand terms. but design patents are just one way of doing things.

    if the rubber band bounceback is patented, then figure out a different visual cue. i've seen some nice ones elsewhere. if slide to unlock is patented, then figure out a different way. circle to unlock? spin a wheel? there are infinite varieties.

    the OP's point still stands... if you use a little creativity it's no problem to skirt these patents. and it will make for a more vibrant marketplace.
