Regulation is explicitly the job that the executive branch is for. Knowing the difference between regulation an law seem to me an important prerequisite to discussing regulation and law.

The actual problem was Nigerians who couldn't get access to *any* instrument at all, i.e. they didn't even have one basket to put anything in, so now they are guaranteed at least one. There is nothing here stopping those who can get something under more favorable terms from doing so.

a) If they let you install then people will complain that Apple is deliberately showing their machine down to try to force them to buy a new mode, even if there is no measurable showdown. This is not a theoretical scenario, since it already happens with systems that are in the "artificial restrictions". b) If they try to be more precise in their definition of an upgradeable system then people will complain that they couldn't figure out if their system was upgradeable or not.

The problem isn't that the motor can't withstand more heat but that that it CAN withstand more head then is stored near other items before ti has cooled.

This is the down side of the great work done by the private launch outfits: they are free to NOT compete for certain missions. NASA still needs a craft for those missions so the traditional built-to-order model is still necessary but for fewer cases which could have amortized the fixed costs. Now you have either makework or are stopping and restarting the line, making the per-mission cost grow.
