I think that maybe, I may have an incorrect view but I'm willing to debate the issue.
I see record companies as venture capitalist. They invest their time and money for recording and promoting the artist. The artist in exchange gives up a percentage of his/her earnings. Napster doesn't give the artist the promotional value, It does provide the distribution value.
Now I would think that napster can not preview/review and promote as good as a record company. So there need is still there. How napster could play into the game is... an established artist could place there music from live concerts, napster charges.25 for the download. artist / napster / record company make money. everyone wins. people will still go out and buy the cd because the want the studio version ( the record company and artist make money ) artist & record company & napster makes extra money from there live concert performance. Promotion and distibution is still covered and protected as a revenue source for the record company and artist.

My father has a simiular problem when he went into heart sergery. They offered him a newly invented valve never tested before on humans, my father ( with balls made of brass ) on the table said to the doctors "only if I get a royalty on it" and for 2 hours they had my father on a table negociating the royalty structure.

You hit the nail on the head. But here is more of the problem. An artist needs the labels so bad that they must sign away there life in the begining ( giving up there copyright to the songs ) afterwards, if the artist is realy good they can renegociate.
An artist has to understand if they want to be popular in a short time and earn money fast they have to go with the labels at there terms. But if an artist is willing to do all there own leg work, they themselves will have the labels come to them and offer sweet deals. MC Hammer is a clasic example. He did the club sceen, self promote, and even sold his own albums from the back of his car for a few years before the labels tried to pick him up. And when they did he made them work. I understood that he was able to get very large royalties from his work and a HUGE percentage from his album sales.

I have not touched assembly type language since 1989. But the above artical points out very important issues. My father taught me to work on cars since I was 6. one of the most important aspects of rebuiling a motor was to lable all your parts with great detail so that you never had wonder ( and yes, connecting rods should be rematched towards there orignal pistons )and always sub assemble to make intalation easier. When I got my C-64 (1981) I coded the same way - Very detailed and in sub routines. I first started in basic, then I bought a Basic compiler then a bought and assembler program/compiler. I designed everything under one platform, so I was not to worried about cross compatibility. And after a while each sub routine in basic was recoded in assembler ( varible passing was pain but well worth the speed ups ) and calls to the rountines were used
Code optimizing can be best done on well documented code, that has been tested and the sub-routines optimized.
I would think that with the current state of tech, most software houses would create the program then issue "addon/upgrades" to specific operating systems ( mac os or win or linux ) and specific processors. If i recall right i think autocad did this back in the late 80's and early 90's

Corporate greed is what got us this far. Next step is the Open Source greed. it goes like this. You make it for free. I'll then package it, market it, and scalp a nice little profit off your work. I think Red hat did something along those lines.

USA were note realy due for anything major, our markets have done some amazing reorg and we now have what I call micro-mini-sectors depresions. take a good look at our markets and you'll see that the sectors of oil, food, tech, steel,... all go down in there respective cycles sometimes as much as 33% ( MO traded from 40's to 19 and back to the 40's in less than 12 months.) oil seams to revolve around a 30 to 48 month top to bottom cycle and it keeps on going on like that with different sectors. I just come to believe that americans for what-ever it might be worth put alot of faith in themselves and our neighbors to produce alot of luck ( luck = hard hard work + research + more hard work )

You know, you got a great idea there. Also the takeoff might be visable from the hubble space telescope ( i hope the point it ), given there is a chance of failure, but look at everything they have done.
Now what can we tell with the plume from takeoff and recrashing
1) the plume it might show the composition of matter it contains.
2) the effect of gravity ( we might change the orbit )
3) we could make it a homing beacon for future travel ( not a very bright one but point the panels correctly and it should transmit a signal for a long time and could be used as a backup triangulation point

Again it's all depending on how you document your time. As I said in my earlier post, DOCUMENTAION is what the IRS looks for, and as the poster above mentions "If your company did time accounting in a similar way... but it would be collected into a place where it mean something to the bean counters"
And the bean counters know how to adjust the books to show that a "loss" has occured.
an offtopic note :
For any independent consultant out there, you should have the following with you at all times. A dated log book ( manuel entry) showing the following.
start time :
a)when you get in the car write the miles down
b) travel type business or personel
c) gas bought and miles at that time
d) miles/time at the arrival to the site
offsite / on site Office time :
a) work done and billable to your client
b) sales call and presentation ( time used )
c) food expense (even if you made a ham sandwich at home make sure you that inclused it in your weekly summary of expenses releated to work
d) any and all purchases done releate towards the project ( yes 3m stik-it notes count and are billable )
3) home office ( i'm not to sure about this because I don't work form home but this is what otheres have told me
a) log start time at the computer
b) measure the amount of space used for working and total area of your home ( this percentage your account will need but I don't recall why )
c) monitor all telelphone calls that are use for business or better yet get an office line
d) keep business expenses and personal expenses on different credit cards and bank accounts. this applies to everything if you realy want to work your books to get maximum write off
4 ) general
a) log everything and anything so that when you get your audit you'll have proven documentation of all your transaction.
it's a big pain in the butt. It's also worth the extra 20 minutes a day. I saves me about 12% on my taxes over the year

Well if software sites on a shelf and is not sold, it can become a write-off. The value of the write off is cost of production per unit.
A virus has a cost associated with it. Cost of productivity. Can we write it off. Hmmm software bought to prevent it happening again, extra copnsultants brought into the firm to upgrade systems....

How the tax sytems work I don't know but I would not be surprised if some-one could claim it if there was enough proof and well documented claim.

Traveling salesman that has full account of his time in a writen ( hand ) log. He/She could put computer down time as a loss of sales and presentation for the amount of days the system was down, proratedly only for the days the computer would be used based on a historical documentation of the hand writen log file.
there was a great acticle in forbes magazine about how to manage your records for the IRS. This included those people that were gamblers and other types of people that have to keep a written log.

Well the issue here is not distribution ( i'll cover that part below) but creation.
Currently only the very big music studio's with very high quality engineer's are getting bookings for there time. Alot of studios are very worried and some have gone for sale in the past 4 months.
Anybody with about 12K can create a music studio in there home that would replicate a quality music studio. there they can master a good demo ( we get alot of demos for our show and some are very very good )
As for distibution, that's were the labels come in. Everyone has to have a distribution deal if they even want to have a chance. Discovering an artist is still a Label thing . that's why they pay a finders fee ( up to 20K ) for those that are willing to gather demos, listen to them, weed out the garbage and present to them the final fee that make it.
Our team has a different approach to this.
We have ton's of demos that we listen to every day. we weed out the basic crap. after that we tell all the lables about our finds ( we tell the artist to post there music at a web site for the label to download them. after that it's up to the label to contact the Musicians. All we ask for in return is access to their artist to place on our show. We find that by staying totaly nuetral that the labels give us more respect and better quality interviews.

there really isn't anything wrong with what there doing, but here is my results for the final outcome 20 years down the road.
1) every job applicant must submit there personal heath data.
2) every person with xyz gene, has an extra cost associated with them.

You know, you got a great idea there. Also the takeoff might be visable from the hubble space telescope ( i hope the point it ), given there is a chance of failure, but look at everything they have done.
Now what can we tell with the plume from takeoff and recrashing
1) the plume it might show the composition of matter it contains.
2) the effect of gravity ( we might change the orbit )
3) we could make it a homing beacon for future travel ( not a very bright one but point the panels correctly and it should transmit a signal for a long time and could be used as a backup triangulation point

Again it's all depending on how you document your time. As I said in my earlier post, DOCUMENTAION is what the IRS looks for, and as the poster above mentions "If your company did time accounting in a similar way ... but it would be collected into a place where it mean something to the bean counters"

an offtopic note :
For any independent consultant out there, you should have the following with you at all times. A dated log book ( manuel entry) showing the following.
start time :
a)when you get in the car write the miles down
b) travel type business or personel
c) gas bought and miles at that time
d) miles
offsite / on site Office time :
a) work done and billable to your client
b) sales call and presentation ( time used )
c) food expense (even if you made a ham sandwich at home make sure you that inclused it in your weekly summary of expenses releated to work
d) any and all purchases done releate towards the project ( yes 3m stik-it notes count and are billable )
3) home office ( i'm not to sure about this because I don't work form home but this is what otheres have told me
a) log start time at the computer
b) measure the amount of space used for working and total area of your home ( this percentage your account will need but I don't recall why )
c) monitor all telelphone calls that are use for business or better yet get an office line
d) keep business expenses and personal expenses on different credit cards and bank accounts. this applies to everything if you realy want to work your books to get maximum write off
4 ) general
a) log everything and anything so that when you get your audit you'll have proven documentation of all your transaction.
it's a big pain in the butt. It's also worth the extra 20 minutes a day. I saves me about 12% on my taxes over the year

I found this very interesting, because the drive no longer uses a landing area in the platter. It has a ramp feature. Now also it has less moving parts, that's the best thing i could hear. I have an old system that I have to whack every time to boot it up (kicking does not work, only a good slap). yes I should replace the drive but I'm to lazy. I use it for booting up old dos games that i like.

But i recall that IBM had made a discovery of High Temp superconductivity in the 80's and won a noble prize for it ( 1988 i think ).
In 1994 or 1995 they announced that they had receached 220 degrees below zero ( which I think is hotter than these cables).
Does anybody know who are the inventors or sponsors of this project besides the power company. It's interesting to note that this small advancement could forever change the way of power distribution.
Just in NYC all the power cables are laid underground. Think of all the space savings. If there ripping up the streets or relaying cable that would mean that there should be project along these pipe to place more fiber ( it's easyer to pull groups cable than just 1 strand ).
Just think, Power companies ( common carriers ) would now be in the data transmition field

Well if software sites on a shelf and is not sold, it can become a write-off. The value of the write off is cost of production per unit.

A virus has a cost associated with it. Cost of productivity. Can we write it off. Hmmm software bought to prevent it happening again, extra copnsultants brought into the firm to upgrade systems
That the way i see it.
How the tax sytems work I don't know but I would not be surprised if some-one could claim it if there was enough proof and well documented claim.
example:
Traveling salesman that has full account of his time in a writen ( hand ) log. He/She could put computer down time as a loss of sales and presentation for the amount of days the system was down, proratedly only for the days the computer would be used based on a historical documentation of the hand writen log file.
there was a great acticle in forbes magazine about how to manage your records for the IRS. This included those people that were gamblers and other types of people that have to keep a written log.

Well the issue here is not distribution ( i'll cover that part below) but creation.
Currently only the very big music studio's with very high quality engineer's are getting bookings for there time. Alot of studios are very worried and some have gone for sale in the past 4 months.
Anybody with about 12K can create a music studio in there home that would replicate a quality music studio. there they can master a good demo ( we get alot of demos for our show and some are very very good )
As for distibution, that's were the labels come in. Everyone has to have a distribution deal if they even want to have a chance. Discovering an artist is still a Label thing . that's why they pay a finders fee ( up to 20K ) for those that are willing to gather demos, listen to them, weed out the garbage and present to them the final fee that make it.
Our team has a different approach to this.
We have ton's of demos that we listen to every day. we weed out the basic crap. after that we tell all the lables about our finds ( we tell the artist to post there music at a web site for the label to download them. after that it's up to the label to contact the Musicians. All we ask for in return is access to their artist to place on our show. We find that by staying totaly nuetral that the labels give us more respect and better quality interviews.

there really isn't anything wrong with what there doing, but here is my results for the final outcome 20 years down the road.
1) every job applicant must submit there personal heath data.
2) every person with xyz gene, has an extra cost associated with them.
3) I've got 2 equal applicants. Which one do I choose. Big corporate might squew there hiring to the non-xyz gene applicant
4) everybody who is xyz positive will be discriminated.

Certain carriers have stated that thier no longer covering certain zones because there just to close to the water. The hit will be just to hard the next time around. So that person will no longer be able to live in there house ( if there is a mortage ) along the river because there might not be coverage.

We have so many cars in this state we have the 2 or 3rd highest auto rate average ( I think it's the first but don't hold me to it ). The sad thing is that I see so many out of state plates on poeple that live in this state that is makes my rates go higher becuase there are less people to cover the risk. THEREFOR i'm being discriminated.( there is a ratting number and web site I think )
