    I'm sure there exists in the world a successful businessman who has never had an original idea in his life. There exists a talented programmer who wouldn't have the slightest idea of how to make the money from his art.

    Shawn Fanning may be neither of these two. But don't judge his intelligence purely on the basis of his ability to make money with it.

    In a decentralised system (as the Internet is), there are only two possible ways for it to be properly regulated. Either:
    • Every national government agrees to the terms of the regulation.
    • The accepted protocol changes to allow for regulation by a single, central authority.
    Neither of these will happen. Under IPv4, there will always be regions that do not entirely comply with any given authority. Any protocol change would have to be universal for the latter case to occur. If a protocol provides for the possibility of a central organisation with the ability to effectively censor material, it will not see a universal uptake.

    The governments of the world need to recognise, right now, that there now exists a system that is immune to effective universal censorship. It's not going away. The rules have changed, and they're not going to change back.

    Deal with it. Most of your citizens already have.

    Something I've been curious about for a while now is exactly why it is that more often than not, when a industry-prompted bust like this goes down it's the operator of a website that is the target.

    I mean, who illegitimately downloads music from the web? If it happens at all, it can't possibly be a significant problem to industry when compared with the likes of KaZaA, etc.

    Nice theory, but Douglas Adams has already revealed the origin of "42" as the answer to life, the universe and everything.

    In one of the small tales in the Salmon of Doubt collection, he states something along the lines of that he was looking out into his garden, mentally shrugged and thought, "42 will do". A number out of a hat, more or less.

    The fact that this particular variety of tea, with this particular number, may well have been a favourite of the late Mr. Adams, well, that's just another example of what happens when you mess around with improbability drives.

    Okay, that's a valid suggestion given the "mythological beast" motif the team is going for. Just one problem, though: "Bennu" doesn't sound nearly as cool as "Phoenix" or "Firebird".

    I mean, yeah, when you're explaining what it means to your uncultured IE-using colleagues, you'd get to use phrases like "flames of Heliopolis" and "soul of Orisis (sic)"... but they're just going to go, "Benoo, huh? Ah think ah'll jez stick with me Explorer, or mebbe see what all the fuzz about this Firebird thingy wot I heard about is, it sounds tootin'-good. You can keep yer Benoo, college-boy."

    The article claims that Microsoft is "inching closer -- at least in spirit -- to the GNU GPL" with these license tweaks, but it doesn't look that way to me.
    I'd say this is pretty clear-cut. Is not having to send MS any changes made to the code more or less like the GNU GPL? More, you say? Doesn't it follow then that the license could be said to have "inched" closer to the GNU GPL?

    I know /. has a vested interest in polarising people around these issues in order to keep people emotionally interested and the readership up, but if you're going to make illogical editorial commentary like this, how about posting it in the comments instead of the article body?

    Yes, but there is a degree of difference here: the law itself isn't necessarily unjust.

    Put simply, the law itself may be just, even if there is no just means of enforcing it. The fact that it's not reasonably enforcable doesn't necessarily mean that it is unjust.

    I don't think that fact that a law is unenforcable by reasonable means necessarily implies that the law itself is unjust. It is only the actions taken by those attempting to enforce the law that are unjust.

    It could be said that a law that can only be enforced effectively through unjust means is inherently unjust itself, which I think is what you are saying. I don't think that this is the case: people do (and should) obey laws on an "honour system" basis, not just because there's a threat of punishment!

    The justness of a law hangs on a lot more than enforcability.
