    The work by Engelbart (from PARC) directly led to the advances at Xerox PARC. Several people went from SRI to Xerox PARC in the early 1970's (where I worked).

    The Xerox PARC team codified the WIMP (windows, icons, menus and pointers) paradigm, first pioneered on the Xerox Alto experimental computer, but which eventually appeared commercially in the Xerox 8010 ('Star') system in 1981

    Has anyone been by the Turtle Beach booth yet and taken a look at the new Media Tron? There was a post on the AudioTron mailing list regarding the new device, but I havent heard anything since. Post any info you got!

    That is not correct. Unless you have entered into a legal, signed contract with Microsoft (as I'm sure K-Mart did in this story), the software is covered only by copyright law. You are free to do with it whatever you please (including selling it) as long as you are not violating Microsoft's copyright. It is no different than buying a book.

    Actually he is correct. You are paying for a LICENSE to use the software. You do not OWN the software. You can only do what the license allows you to do. You cannot do anything you please.

    It is not like buying a book. You actually buy the book. Whereas, with software, you are merely licensing it.

    Go pull out your EULA that came with the software that you just "licensed" (not bought!)

    I don't think it makes much difference in most countries if you infringe a patent deliberately or negliently (or because of ignorance).

    Actually it does. In the US if you *willfully* infringe, you are liable for treble damages from the moment you first knew of the patent. If you did know of the patent, you are obly liable form the moment you found out about the patent.

    Once most people find out about a potential infringement, they will obtain a noninfringement opinion from a law firm. This way they can rely on the law firm's opinon that they dont infringe until a court says otherwise.

    C) The type of program (Archived/Looped/Live)
    D) Date of Transmission
    E) Time of Transmission
    F) Time zone of origination of Transmission
    G) Numeric designation of the place of the sound recording within the program
    H) Duration of transmission (to nearest second)
    I) Sound Recording Title
    J) The ISRC code of the recording
    K) The release year of the album per copyright notice and in the case of compilation albums, the release year of the album and copyright date of the track
    L) Featured recording artist
    M) Retail album title
    N) The recording Label
    O) The UPC code of the retail album
    P) The catalog number
    Q) The copyright owner information
    R) The musical genre of the channel or program (station format)

    And a listener's log listing:
    1) The name of the service or entity
    2) The channel or program
    3) the date and time that the user logged in (the user's timezone)

    7) The country in which the user received the transmissions

    There has been alot of commentary on this subject. The Gartner group put out this commentary about the "Tech Wreck" coming to the SF Bay area.

    They claim that a city will do well if they install a broadband communications network that connects citizens, local businesses and the global marketplace.

    The whole point of Open Source is to be free. If they want to commercialize SlashDot and make it a pay system, then thye should get rid of the OSDN label and get rid of the .ORG domain name.

    Then they would be a commercial site and charge for it. I just dont think its fair for someone to speak highly on the virtues of open source development but then charge for access to information regarding the open source development.

    I would be happier if they charged for a printed publication or access to a "members only" section, but charging for the front page is not within the goals of open source.

    Like I said 5000 times. A copyright doesnt have to be granted. You obtain a copyright from the moment you fix your work in tangible medium. So the Govt never has to grant anything to me.

    I understand that the govt is granting you the right to have a copyright. and they can take that right away.

    But the original point was asking if the Govt can take away your copyright. And the answer is NO. They cannot

    What I'm afraid of is that if I, for example, send an email message to a local contractor talking about replacing some of the old, drafty windows in my house, the email will pass through some Microsoft server, where my use of the term "windows" is noted (and the fact that I'm considering paying someone other than Microsoft for them), and I'll be facing an infringement suit.

    So regarding Lindows. There is confusion of source. People may think that Microsoft is putting that out when ,in fact, they arent.

    Lesson on law: A trademark designates the source. To be guilty of trademark infringement, there needs to be likelihood of confusion. Also, you need to confuse consumers (and it must be in commerce).

    Now apply that to your scenario: Are you talking about Microsoft Windows? No. You are talking about your house windows. So there is no confusion of source. And whoa re you talking to? Are you trying to sell windows. No. You are asking about your windows to your house. So there is no confusion in commerce or to customers. And finally... Is there likelihood of confusion? No. No one in their right mind would get your house windows confused with Microsoft Windows.

    How funny. Actually you are wrong.

    As I said, a copyright cannot be revoked. Since it is never granted. If I never apply for a "copyright" I still have one. The message I am typing is copyrighted just by me fixing it in a tangible medium.

    So back to your comment.... Even if you stifle competition, you cannot ever ever have your C taken away. They may require you to share it or require that you allow other people to use it.. But like I said. They can NEVER take it away.

    No, it is not possible. A copyright is granted from the moment the work is fixed in a tangible medium. It is not like a patent where have to be granted something. You have a copyright by just putting it on paper.

    The only way it would be taken awy is if you stole it or it doesnt belong to you (e.g., an employee saying a work is his when, in fact, he assigned his rights to his employer.

    And by the way, why would you want to take a way the MS copyright? They do own it you know.

    NuSphere may not be 'obscure', but the mysql.org website seems a little deceptive. If I didn't investigate it more, I wouldn't have known the difference between mysql.org or mysql.com just by looking at the front page of the website.

    MySQL.org presents their website in a manner that does not give credit where credit is due.
    For one, if you go to mysql.org you will find that it doesn't say whether it developed the software, it just says it's got mysql software available for 'free' download. But the mysql.com guy is correct, in that you cannot download any software without registering with mysql.org first. That indicates to me that it's not 'free' because now mysql.org has customer data to use to market their product to. Plus, it doesn't say: "Hey, we didn't write the software, mysql.com is where you can find that info. We just improved upon it." Besides, I don't think .org websites should ever be for-profit businesses as that is not how that domain was intended to be used.

    The XEON chip started shipping bacnk in January. The Prestonia server chip is made on the 0.13-micron process. Intel cancelled the .18 micron process last year to focus on the .13 micron process. That is amazing!!!

    Alot of people are giving reviews for the new XEON chip

    It will revolutionalize the embedded sector quite a bit.

    Becuase, believe it or not, some things are more important than money... I know this is a difficult concept for those in the recording industry to understand.

    Maybe in your "perfect world" but in reality you need to make money to live. And no matter what anybody says, artists that make popular music played on the radio need to make money..

    Would YOU go to work (even if you absolutely loved it and couldnt wait to go back the next day) for free?

    Holy Hannah, the labels and Pressplay get 91% of the revenues? I want in that racket. And think, after 1000 downloads, the artists will have a shiny 2 dollars 30 in their pocket...reasonable compensation.

    Are you being serious? Cuz I do think it is reasonable compensation. Artists get just as little each time their song is heard on the radio. There is a parent organization that collects royalties from all radio stations and pays out to the artists. It will add up to many many thousands of dollars. I mean, how many visitors did Napster have? Like 6 million or something??

    Purchase tickets for their concerts, they recieve very little in the way of compensation from CD/tape sales.

    Do you think that the artists charge too much for their concerts?
    I work for a large concert production company and over 40% of all sales go to the recording industry anyway. So by buying tickets you are actually putting even more money into the recording company's pocket anyway.

    In other words, why would an artist give his/her music away for free when they can make money using pressplay?

    Think of pressplay as another broadcast source. Just as each time an artists gets dinore when their song is heard on the radio, they will get money each time their song is downloaded from pressplay.

    I think that once the kinks are worked out so that the artists feel as if they are getting their "fair share," this system will become very very popular.
