I wonder if you could claim that the letter was a gift.
In the UK you are allowed to keep unsolicited gifts and do as you wish with them. As before you received the letter it is likely that you had no contact with the law firm this may be an avenue of attack.
I represent Infinite monkeys Inc. As you may be aware our company has bean attempting to recreate the complete Works of Shakespeare.Unfortunately we are still several melenia away from the conclusion of this project.
However our research has turned up all variations on Cease-and-Desist letters. And therefor we claim copyright on all such works.
Novell's latest court fillings state that they want all the money that the judge decides that the contracts are worth to them. That SCO should forgo their 5% as SCO breached their duty to Novell. Novell also want 7% compounded annually as punitive damages. I'm not sure of the status of damages under bankruptcy but the rest of the money comes before the creditors.
SCO being bankrupt, even under Chapter 7, does not make the cases go away. The BK trustee may try to settle, however IBM proberly wants Darl's head on a pike and has already files counter climes that go after him and the other directors personally.
Unfortunately for Darl and Co. The first thing the BK trustee will do is read the court transcripts and the second thing he'll do is ask to see the documentation showing transfer of ownership of the UNIX copyrights to SCO.
When SCO say Wot. S/he will probably file to be removed as the trustee with the BK court and recommend a Chapter 7 filling.
So in this case I could happly distribut the code with the flag switched on for the M/S patented code and it does not become a problem untill someone tries to import it into the US.
Humm... Have I just descovered a way for Novell to get MS patented code into the Open Source code base?
You could get around that by having the game drop the windows system into hibernate mode. Run loadlin against the disk and then reboot back to the hibanated system
They will simply say, 'OK. No windows for you. Enjoy the rioting.'
It's certaintly possible.
However I think at best MS could say is 'No more windows for you'.
They might try and cripple all the windows boxes in Europe with a windows update, however most large enterprises don't allow MS to automatically update the boxes. And large numbers of home users don't either.
I suppose that MS could try and recall all the boxed sets of windowes they have in Europe and disable windows activation, however I dont see this helping as the EU would just impound them and issue their own activation codes.
So the worst I see is Europe not getting Vister and games manufactures not writing games for Vister as they would be writing for only one third of the windows market.
And as I sed above, the rest of the world will be watching and probably ditching windows as fast as lightning.
Have you any idea of the level of fear that Billy G turning of Europe would cause to the rest of the world. Every other country would be scrambeling around for an exit plan from M$
Except having it set up is how most people receive windows
Since the US Government threatens a tax audit?
Except all it does is get me in the habit of copying and pasting the whole document to see if they have screwed up again.

Sophos is a private company. they dont have a stock price that needs raising.
IBM's counter claims include Lathem(sp?) Act claims. I believe thats where it gets personal :-)

I think it was the day after the Americam people sold their sole to TV.
Except I doubt that even MS can stick to the standard.

What happens if I add this code in the UK, where s/w patents are invalid?
Does that mean I can't distribut my code under the GPL, or do I have to put in geographical if statments.
Why does this remind me of the 32/128 bit encription fieasco all those years ago?

Shouldn't that be
while (!dead()) {
work_8_to_7();
if (total_hours_worked_this_week() > 40) hourly_rate=0;
}
The EU can make law, but only in thos areas surrendered by the individual states to the EU.
Europien compertition is one such area

But before we all bash them too too hard -- where, again, are the usable Linux desktops that we'd like to have to replace Windows???
One of them is running on my PC at home
The EU gets a caught order to seize Microsoft assets to the value of the fine.
+ Intrest
+ Court costs
+ Recovery fees
True but the EU has allready started to ratchet up the fine.
.5M euros.
If MS arn't in complience by the end of the month then the fine goes up another
The EU can start bumping up the fine as high as it wants now it has aggrement with the member states.
I think this would only work if you got the side with the more expensive legal team to subsidise the smaller team.
The most wanted, and therefor the most expencive .xxx domain is going to be free.xxx
This domain will of cause lose all its value the moment some scammer pays for it.
