This was a huge issue when I was applying for a Linux job through a head hunter. This is fair use. I bought the CD. I'm converting the music to another form for my personal use and convenience. I do not share my MP3's. I do not get MP3's from other people. I am personally quite offended by the notion that I'm guilty just because some people break the law.

Agreed. When I moved to this city, I intentionally chose an apartment close to a bus stop (no light rail or anything), with the intention that I'd ride the bus to work every morning and not have to mess with parking, etc. The plan was that my family would get by with one car and more than pay for the bus from what we saved on gas, maintenance, insurance, etc.
It took about 15 minutes to drive downtown, but busses only ran on a 75 minute cycle, so in order to be downtown by 8:00 am, I had to catch a 6:50am bus, ride 15 minutes, then kill time down town. Same thing in the evening: I got off work at 5:00, but couldn't catch a bus home until closer to 6:00. That was WAY too much time to waste waiting on a bus. I bought the car and haven't ridden the bus since.
The funny part is that when the new city administration took over, they decided to address low ridership on the bus system. Rather than doing something silly like running more routes (smaller busses, more routes, quicker times, would help), and especially more routes in the poor areas, they reduced runs to the poor areas (citing security concerns!), and renamed the system.
    Pitiful.

One day my throughput dropped to ~ 1 K/sec, much slower than my modem used to provide. I contacted the ISP and once I finally got up to someone who knew something, I found out that the national ISP had brought a new bank of modems on line between me and their main office. They planned to get me up to 128kbps (twice 56k speeds) in 6-8 weeks.

  22. Re:violate fair use? on CD Copy "Protection" in California · · Score: 1

Fair use, as I understand it (and I'm not a lawyer), is more of a general principal to protect the consumer from an over-reaching copyright system.

In general, if what you want to do can be naturally assumed to be the intent, it's fair use. Also, in general, if you have the right to use a copyrighted work, you also have the write to put it in a different form for your convenience (so you can copy LP's to tape to listen on your walkman). Academic study is also generally considered fair use (which is why libraries have photocopiers even though everything in there is copyrighted).

This doesn't imply any responsibility on the part of the copyright holder to make that easy for you, however. Just that they can't sue you into bankruptcy for making a copy of that article you're using as part of your term paper research.

So the question comes down to this: is Canada Post (or whoever) contractually obligated to continue the service indefinitely for free? You'd have to read the terms of service and/or contract to know.
