We do know that Megaupload claims they signed contracts with everyone involved and own the rights. If the artists signed mutually exclusive contracts with both Universal and Megaupload, then again this is a contract dispute.
This isnt difficult; if the request is bogus as Kim claims so vehemently, all he has to do is counter-file a claim under the DMCA. At that point, if the video truly is infringing, it is on Kim to defend and take the heat, not Youtube.

The only thing the artists can contract away to Universal is a promise not to appear in a video production not sanctioned by Universal. If they did it anyway, it's a contractual dispute between Universal and the artists, not a copyright issue.
If one or more of the artists have clauses in their contracts preventing them from taking part in a commercial, then it's a dispute between Universal and the artists. It does not give Universal automatic copyright over the video, nor does it allow Universal to use the DMCA to have it removed.
I also find it highly unlikely that the producers where dumb enough to use samples or other material under copyright ownership by Universal or any other third party without permission.

So where EXACTLY does that leave them an alternative? They need a product RIGHT NOW this very minute, they don't have time losing share as quickly as they are to dick around for who knows how long to get MeeGo up to snuff, and NOBODY like Symbian for anything other than dumb phones.
And how does a panic switch to WP7 help them now? Since it's a totally new platform to Nokia you can count on it taking them at least 12 months to get their first Windows phone out the door.
And with Symbian oficially declared dead you can count on their smart-phone market share dwindling even faster reaching exactly 0 in the mean time. Talk about loosing market traction, getting any market for their WP7 phone is going to be a uphill battle.
With MeeGo they have the device in the works ready within short, who knows it might even be ready as promised since November last year and Elop delayed it for tactical reasons to make his switch to WP7 seem even more justified.

No it wouldn't benefit Microsoft becasue if they drop old-Windows and introduce this fantastic new new-Windows it doesn't matter how good it is, since they are forcing their customers to upgrade to a completly different OS said customers may just as well evaluate all OSes on the market since any OS can run old-Windows in a VM.
How many do you think will opt to run old-Windows on top of Linux or OS X instead of betting on Microsofts unproven new-Windows, especially considering their track record on their previous offerings?/greger
