The only thing to take away from this story is that YA idiots are in charge.
Blacklisting spammers is not a bad idea, making sure they are actually spammers is the problem. I mean from this guy's story looks like someone went into DMCA-mode. That is ban first and only as questions if someone has a big enough budget to threaten a lawsuit.
At some point ISPs are gonna get an anvil on the head labeled responsibility.
MS seems to have the most advanced and pathological form of 'not invented here' syndrome. Otherwise known as (re)invent everything here.
I mean were do we begin on things that have been reinvented instead of enhancing other things? WAV, BMP, activeX, directX, an intended competitor to pdf (cocoa?), an intended replacement of java (also called cocoa?), their own implementation of java, their own implementation of mpeg4. I dont know what else.
Indeed what is the motivation. For instance, Garmin GPS wont work on the MacOS. Someone offered to write the drivers and app for free and garmin refused. The USB adapter wont even work under VPC (as i understand) it checks if its running under VPC.
You work out the reasons cause i sure as hell cant.
I just have a bad feeling that some jackass company is going to make some spurious DMCA claim that the driver were licensed only for use under windows and using them in linux in any form is some kinda non-existent copyright violation.
I vaguely recall in the annals of history of being something similar to this happening but i just cant put my finger on it.
Perhaps legislators and law enforcement will finally wake up and stop accepting the lie of 'legitimate business' that 'direct marketing' does. Its all spam, its all lies, its all fraud.
Well lets think about this quote for a second. If we assume that Fox news is actually concerned that its viewers will confused a cartoon like the simpsons for a real news broadcast , it really says hat FNC thinks their viewers are in fact incredibly stupid. Particularly if you look at what went by on the news ticker.Who other than a fox news viewer would think those headlines were real?
Ive been starting to wonder about SCO's massively brain damaged antics lately and im wondering why. Im starting to think its all a scheme to shuffle as much money as possible to someone's law firm before the company implodes from planned stupidity.
In other news, i hope SCOs investor wake up and realize that SCO itself is now willfully violating the law.
Talk about being conflicted, I have used x10 stuff and i liked it and always thought it was cool. A fried told me about them, not some annoying online advertising. The make a useful product that works. Any number of conventional advertising scheme should have gotten them bunches of customers, but they had to go the annoying popup windows and such. Its sad really in its own way.
Let hope the spammers learn a very valuable lesson here. *do*not attempt to legitimize your crap, you will end up with discovery proceedings. This will ruin hem, and possibly get them killed. The shady operators they work for dont want to be found the ISPs the contract with dont want to be found. they dont want the systems they hack to be found, they dont want to get nailed for tax evasion. In short.. dont ever stand in front of a train again. Next time you are gonna get plowed down.
Compensation, im smelling civil lawsuit blood in the water. The fact that the Da screwed up, but Tornado must have pushed it also to deflect blame from themselves. I wonder how many false statements the made to the FBI? There is potential for some nasty fall out here boys and girls.
Speaking of NIH, some MS apps dont work with Winshade X because they dont make system calls to draw windows. Of course it doesnt work on apps running as root either. I hope over time there will be less and less need to run apps as root (privlidge elvation)
So tell me which administration is this happening under? I dont see jimmy carter around anymore.
Since The white house is in charge these things are happening under the bush administration. and legitimately so, regardless if the article says it or not. The guys at the tops are still responsible for the actions of the minions.
Also which truth are you insinuating isn't being portrayed. Put some money where your eating orifice is instead of merely adding your own hearsay an opinion.
Vivendi dropped DMCA charges. IIRC they refiled under copyright, or something.
Your point on Gentoo is well taken. i didn't actually said they sued tho:)
Well, if anyone tell honestly tell me that in good faith they did the scantest of research and determined that GenToo was distributing pac-man, then i would have to say that both that person and the Entertainment Software Association are a pair of grade a fools. And making such a 'good-faith' claim deserves to have the book thrown at them. Its the grossest of abuses of power.
Point is this is the track record, and its not going to get better.
Actually, I am of the opinion that less an less investigation is going into cases before suing someone. I don't wish to go on ad-neasueam here. But please recall the alleged (then dropped) DMCA charges by Vivendi against bnetd, the group alleging that GenToo was distributing PACMAN. Please recall that DMCA allegation are made under the onus of perjury. If you make a DMCA claim you are stating that you believe this to be infringement. if its not you have perjured yourself. Then we have the whole SCO circus who aren't even following established practice as to stop the alleged infringement.
So in short, no I believe less and less companies are researching before they file suits.

What a great suggestion.. let get rid of all of those different flavors of windows and all those pesky multivendor PCs. A corporate wide upgrade to all new high end laptops for everyone including your servers will save *huge* amounts of money!

Does anyone recall about how SCo said it was not their goal to get bought by IBM?

My guess is more likely DDoS and spam hackers. Looking for ways to get in and grab more things to attack with.

Not to worry he'll be fired shortly for criticizing people with lots of money.
