It seems to me that this is due, in large part, to the 'hardware review' sites. They almost always compare various cards using 'quake' FPS performance. This may or may not be a useful evaluation. This reminds me of all of the database benchmarks, tp1, tpc, etc; the database vendors always tuned their products for these....

There is a *lot* of emphasis placed on generating patents; financal rewards for any employee that submits a patent application, and awards for having large numbers of patents under your belt. These mega corps view patent portfolios as business tools, both as offensive and defensive; to be used to directly for cutting out the competition and/or forming alliances with other corps through patent portfolio exchanges. In essence allowing only the big boys to play with each other (for free) while soaking the little guys.
Thats a good thought, providing a minimum download speed. It may also help increase the overall speed of the P2P network, basically shutting out sites that have already filled their bandwidth.

why is this outdated ? I certainly would not want my elected officials voting based on national majorities. This would have the effect of candidates only representing large cities where lots of votes existed and dealing only with issues associated with the large urban areas.
I suspect that congress knew that the DMCA would never hold up in a court of law. That doesn't mean that the DMCA is not a very efective tool for a corporation. On the contrary, corporations only need to threaten a lawsuit in most circumstances to acheive the desired results; the fear of the expense and uncertain outcome of a trial will disuade most people from continuing what ever it was the RIAA, MPAA, AOL, etc were unhappy with. The bottom line, in my estimation, is that noone really wants a case to go to court that may jepordize the DMCA.
