    The article mentioned donations. Are there any charities seeking donations now that are involved in this kind of work?

    My iPod's battery died. Luckily, it was still under warranty, but I was less than impressed with the prospect of having to mail the player back to Apple for a damn battery. So when I got the iPod back, I sold it and bought a Zen. So far, I've been happy with it. It can hold the same amount of music as my iPod for less money, the music sounds the same, I don't use the iTunes store, so that's a non-issue for me, and I don't really like the touch pad anyway. I think the Creative is the better product, and can definitely compete with the iPod.

    If society breaks a law "at such an extent that it requires an automated process to identify and punish those offenders", then the law in question is most likely flawed. In this case "society" as decided that it's not the worst thing in the world to download a song-at least, you shouldn't get sued for thousands of dollars for doing so, when stealing the physcial CD would get you community service or something for the first offence.

    In addition, I have a feeling that, proportionatly, the cost to this is much more "inordinant" to the people getting sued than to the execs at the RIAA/MPAA.

    Even excluding the cheapie Chinese MP3 players, you can get a 512 MP3 player, with voice recording and an FM tuner, for $91.99. So what's the big deal about the iPod Shuffle?

    Am I the only one who thinks that the penalty for this type of copyright infringement (not theft) is way out of proportion with the gravity of the offence? The people they sue tend to be people like grandparents, 9 year olds, and college students. These people do not make money off their copyright infringement like bootlegers do. Why not make the fine just a couple hundred, like a speeding ticket?

    Maybe this ruling will finally convince people to use freely avaiable encryption. I PGP as many messages as I can (I don't have anything to hide, I just don't like the idea of people snooping on me), but not many of the people I email use PGP.

    Because with people not having medical insurance, people sleeping on the street, a war in Iraq, and violent crime, I can't help but think there's a better use for the money. Let the software companies enforce their own copyrights, like before the DMCA and NET Act.

    I never said I bought from ITMS. I said that if I did, I would have to jump through more hoops than I'd like to put the songs on my non-iPod MP3 player. I get my music in MP3 format from allofmp3.com, because it is faster than P2P.

    I am a college freshman (philosophy major), so my high school days are not too far behind. From this experience, here are some suggestions.
    Make the lectures more interesting-sort of like Bill Nye the Science Guy. Sometimes, the hardest task in math class was staying awake.
    Relate the lesson to something. I want to be a lawyer, not an engineer. How will I use (for example) slope?
    Teach logic before math. As a philosophy major, I had to take a logic class. For some reason, I understand math a little better now that I understand logic.

    Why? if you dont like the itunes licence, don't use it. There are other ways of getting music online either legally or illgally.

    You're right! And if you don't like the Windows license, don't use it. There are other operating systems.
    And if you don't like the DVD license, don't use DVDs. There are other ways of getting movies either legally or illegally.
    And if you don't like the CD license, don't use CDs. There are other ways of getting music either legally or illegally.

    I really don't see what's wrong with Playfair. All it does is allow people to use music they legally pay for. I have a non-iPod MP3 player. So, if I want to listen to ITMS songs I have to first burn them to CD. How is it not fair for me to skip that step, and put the songs I paid for directly on my MP3 player, without having to first burn to CD? How is this program different from DeCSS? If this were any company other than Apple, they would not be getting a free pass on this.

    I agree, why are people getting upset about someone going to jail for breaking the law?

    I can't speak for everyone, but the reason I'm getting upset about this is that I think copyright infringement should be a civil offence, not a criminal one.

    The issue, at least as I see it, is not whether or not copyright infringement is right or wrong. The issue is whether or not people should go to jail and get lifelong criminal records over it. Because this is not a violent offence, and copyright violations are usually civil matters, many people here believe they should not go to jail. That doesn't necessarily mean that we think what they did was right.

    By giving Apple a credit card number through the iTMS, an iTMS purchaser accepts a contract with Apple Computer.

    But...I thought /.ers didn't like click thru EULAs. Oh, wait, I forgot-Apple's on the Good side, and is exempt from all the stuff we hold Microsoft and the AAs to.

    The types of people who own iPod like devices tend to be tech-savvy, the same kinds of people who are resistant to music rental schems.

    Slavery doesn't pay several times minimum wage, provide full benefits, offer social esteem, or provide a trained career path. You may not enjoy every moment of it, but military service is a far cry from slavery.

    If the military service is not voluntary, it is pretty clearly "involuntary servitude", and as such a violation of the 13th Ammendment.

    I think the real solution to this problem is stopping BS lawsuits before they even go before a jury. To this end, I think that the US legal system should institute preliminary hearings for civil cases. In these hearings, the plaintiff would present his case and call his witnesses. The defendant would be able to cross examine the plaintiff's witnesses, but not call any of his own. The judge would then determine if the plaintiff had enough evidance to procede with his lawsuit. If he did, the lawsuit would procede with no penalty to the defendant. If, however, the plaintiff did not have enough evidance, he would have to pay the defendant's legal fees. I think this would go a long way towards reducing frivolous lawsuits of all sorts, not just malpractice suits.

    According to the article, EB did indeed break the law. Michelle should have gone to the police, not the media. She still can go to the police, and with this article she has even more evidance. EB could face some sanctions-and maybe the owner of that particular store will have to do some community service or something.
