    IBM's investment in Novell under these circumstances makes me a bit uncomfortable because part of the discovery that IBM and Redhat is doing with the SCO case is to ferret out who is the man behind the curtain in funding SCO's war of terror on Linux.

    An unsubstantiated assertion came to light recently that Novell has the power to overrule SCO to force it to make a licensing exception in the IBM case. If this is true, this investment could be seen as a Quid Pro Quo and SCO could use it in their defense. I hope IBM is smarter than this.

    heh, we haven't seen anything yet. My take on all this is that American economy has depended on massive demand for American Dollars and the parking of money in American institutions e.g. banks, stock markets, real estate etc. instead of in home countries. We stoke this demand by fomenting political and economic instability in various parts of the world. Wealthy people just "feel safer" parking their money in the USA. I see this changing over the next several years. Already the Japanese are seeing an increased need for resources at home and are pulling investments from America. This along with the maturing Euromarket will cause the US Current Accounts to go negative (they already have) and this will affect exchange rates causing the cost of imported goods AND Capital to rise. We will have double digit interest rates again. You think its bad now with 3 million jobs lost and some permanently to offshore. When there is actually a capital squeeze we will have famine and conditions not seen here since the civil war.

    I'd like to point out that media consolidation that you are so concerned about was inserted in to the bill at republican insistance. The democrats, allowed it for a variety of reasons including, some democrats are as money hungry as their fellow republicans, and 2) it was the only way to get the rest of the bill passed. And if I recall, the Republican's controlled the house at the time of the passage of this bill...

    Not to mention Bill Clinton LOST HIS COPY OF NUCLEAR CODES!!!! He never found them. That's not a little thing.

    This is not possible. The POTUS NEVER carries the "football". Its carried by a an airforce non-com who is generally within 50 feet of the president at all times.

    Why is it only recently? This was pretty apparent that the Republican's only look out for the Wealthy even in Eisenhower's day.

    The general public like sheep think that electing a "father figure" that tells them what is best will protect them when in fact they are being led to the slaughter house as the sheep they are.

    Another generation got duped by the Reagan era and now we have George the II who is busy reshaping America back into the 1950's horror of privileged classes and ordered decorum and invisible minorities and McCarthy style gestopo patriotism.

    I guess its really true, we get the best government we deserve...

    If I'm not mistaken, I think AOL licensed TIVO for potential use in future applications. This is probably one of them. TIVO wins either way.

    Further, just like DIVIX, I think the consuming public would not be fooled by a device that locked them into limited behaviors and features.

    Based on anecdotal evidence, I beleive that the various phone companies are hording number exchanges. Here in Chicago, there are many prefixes that are not available in adjacent area codes. It goes along with the general take no prisoner's approach the various ILEC's take in dealing with competition.

    I found it puzzling that the "Entertainment" division lost money. I think if they separated the "X-box" from that division, and then reported the revenue and P&L numbers of their pc games I think a nice profit would be revealed there as well. By lumping the xbox in with it, they effectively mask profits.

    What puzzles me is that most online stations are already licensed by BMI and ASCAP. Seems like they would be providing the Artists with the same royalty structure as over the air. So whats the big deal????

    The Atkins Diet is not a fad as it has been around for in excess of 40 years. And Dr. Atkins is eminently qualified in his field. So who are you calling a quack? Further, if you've read any of his writings on the subject, it isn't a simple matter of eating less because if your body doesn't process carbohydrates efficiently, then it will try to store what little you eat as fat. (Insulin resistance) There are poor saps that eat like a bird, and exercise and still gain or maintain more weight than they want. I can honestly say that an Atkins style diet in combination with increased activity has helped me significantly both in weight loss and in diabetes control (I was able to stop taking medicine for that!) and blood pressure reduction.

    Considering that phone companies and ISP's and content providers are merging (nee AOL/TimeWarner) your ability to connect over traditional access points could be hindered. I think to circumvent this, a grassroots network of wirless connections should be developed that anyone could tap into and other than government control, no one could monopolize.

    I read the SeattleWeekly article and according to it the Judge ruled that "free speech" was not the relevant issue it was harrassment. The guy had a fool for a lawyer (himself) so what else could you expect.

    Being a journalist of any stripe does not excuse libeleous or slanderous behavior or speech and he certainly seems to have been throwing it around rather thickly.

    With reference to the Home Owners Association By-Law this is similar to placing these restrictions in land covenants or deeds. There is a prinicple in law that says contracts that run counter to public policy are unenforceble. A business receives a license from the political subdivision be it state or local municipality/county. Each of these counties must uphold statutes and legal precidents including the result of Federal legislation prohibiting discrimination.

    Basically a business cannot discriminate in selling to someone based on a "protected class". So, if you try to run a Black person out of your store simply because they are black, you could loose your business license and be subject to a civil lawsuit. There is a federal law prohibiting discrimination in housing and accomodation. Retail establishments fall under the accomodation aspect.

    There is some precident in law for consequential damages for software particularly when malice is applied. If it can be shown that the software was designed to cause damage to the PC then a case could be made.

    I think however, the most effective case to be made is with the pocket book and not buy the damn junk. Also, we need to start rattling our congress critters to curtail the DCMA and other legislation that gives far too much power to the media conglomerates.

    Which stands for "Community Antenna" TV which in its very beginnings were "cooperative" ventures to provide tv signal to fringe areas. Broadcasters only benefited by having its audience enlarged without added expense to itself.

    Its only greed and opportunity that turned what was a free or modestly priced service into the basis for a multi-billion dollar industry that is vertically aligned with broadcasting and content development.

    I think its interesting that its gone from this being a service to us to we, the tv viewer/cable consumer are now a product that is sold to the content developers.
