Unless the code Linus actually wrote has the SCO's code in question - they have no case.
This whole case is lame.. If you asked a few thousand OS coders to write an OS, wouldnt a few of them get a couple lines the same? Even if they never talked the entire time coding was being done?
This whole case feels like SCO just wanted some attention - I hope they get the crud sued out of them.
Why are we running Operating Systems on Hard Drive

Why are we running os's on hard drives? They will soon be on encryption based
embeded chips that can only be flashed with updates through authorized M$ locations if
you want a new OS. If any part of the startup procedure finds an unverifiable chip on your M$-only hardware, all chips in the system are disabled until you go to a M$ authorized location. Modems would not be supported - only broadband connections.

ALL user side commands would be generic and would not give away internal command structure within the code - and the internal systems would not reply to anything but the generic command structure. Only the chip designer and Bill Gates would know the internal commands - not even the programmers, as they would only be given the 'generic commands' the OS would be permitted to use. Chips would the chip's designer would manufacture all chips personally, in-house at M$.
I wish it were that simple. People are being extradited to stand (quiet) trials for (larger) scale legal cases all the time.
Just advertise the x-box and ps2 chip's for sale on your site, from manufacturers in your area and if enough sales takes place that are monitored on boxes that enter the US, you will find out just how slanted our American laws are becoming.
As an American I'm not proud of the laws our Government is making but let me assure you 'We The People' are not cowering in any respect - we are however being gagged and shushed from the public eye because they want us snubbed out and forgotten.
I guess they forgot about the bloodshed for 'freedom' that this country fought for and want to adopt a more totalitarian approach to Government - Its coming time for leaders of this Country to be impeached/removed from office before they devastate the entire purpose of 'America' with their own lunacy.
True - now isnt it interesting that they are producing a product they claim has no legal purpose? They are attacking mp3's while developing more hardware to use the technology..
The RIAA needs to get their story together. Either they feel mp3's are evil or they support them.
I can understand your point; however, the point is they have lowered production (they had always been making too many cd's and not been able to sell them) and at the same time their 'true' sales number have held in virtually every respect but they claim to have 4 billion in losses every year as their ammo to attack us. Here, read this: http://www.azoz.com/news/2002stats.html as a good review of the math the RIAA isn't able to do.
You may not like it, but just the same - we are losing a lot of rights - faster than you can jump and click your heals.
This is just another M$ attempt to make a new 'xbox type' technology. They can't stop us from modifying them although it is illegal to. All this will do for pc's is give MS the right to sue you for making an overclocking device. Not to mention if they make all proprietary parts, they can use their monopoly focused interests to manufacture new parts that are only compatible with 'their' boxes and only approved suppliers may make parts.
Don't worry the fair use laws are here to protect you.. Oh, no wait - that's only if your a company...The end users don't matter and should go to jail for using hardware they bought in a way they want to... Wait a minute... NOOOO!!!! When did the US become a dictatorship??
I believe Jesse Jordan's point to be the same as mine and many others hosting p2p-type networks, searches, etc.
MP3 trading has not hurt sales of anything but music singles - do that math (since the RIAA obviously cant) and you'll see they only handle 4 billion a year in total cash flow, so unless they intend to show entirely different numbers reflecting a 100% loss in revenue I suggest they get a new story.
Jesse Jordan is awfully brave though to admit he intends to bring his search back up in the next couple days. Not the smartest thing to say but at least he was honest about it.
People have forgotten what 'fair use' means and the BONO term of copyright length is insane - the 14-year with one max 14-year extension for ALL works makes sense and is what our founders wanted. As for fair use, as long as we are not making a profit I don't see the problem, heck - music sales are holding strong when most other business markets are struggling so give me a break.
This is the old VHS fight all over but this time we don't have big business on our side. They are more than willing to make mp3 players for us to use but if we go to jail or have to fight for our right to use them, too bad.
So, I say to you RIAA/MPAA - Are you afraid to attack the big boys again for fear they will shut you down again? Come on, lets have you attack Sony or RCA or any mp3 player mfr and see how long it takes you to get smacked down.
I'll just keep hosting my p2p hub thanks.
ROTFLMAO
Oh well, I guess they didn't need fair use rights anyway, right? Soon enough we'll have to fly over there and bomb the RIAA out of Iraq because they have established their own cruel Governmental system.
In my opinion - If I were a Country trying to defend myself against any military force today that depends on technology, I would attack the orbiting satellites immediately upon the onset of war.
If the AV applications can detect modified versions, then the specifications
for the file WILL be included in the AV data or it couldn't filter it
out..... Gee, if you really want to tell me the file is 847bytes and is a.com file
(or whatever) how hard do you think it will be to locate on computers?
Or am I just wrong and this just makes everyone that much safer?...
but really... safer from whom?
Let's just lay all of our rights down on the table one at a time and under the
guise of public safety remove them one by one until we are the
new Russia? Extreme I know, but look at the last few years and tell me, have your rights and freedoms increased or decreased? ... Now ask why...
It's starting to feel more and more like the movie Matrix in format to rules
and to the bottom line, control. Soon, we'll have to go back to BBS
boards and access to them being restricted to only those people you know in the real.

Beware - soon we will find people who sell overclocking devices going to jail for violating DMCA.

Just my 10 cents though.
Ugly formatting but interesting story just the same. lol
