    Halo was never Mac exclusive, it was being made for windows as well. They did that with every version of myth and even had a windows version of Marathon 2.

    Bungie *was* primarily a Mac company, but they haven't been Mac exclusive for a long time.

    It would be an interesting precedent.. but..

    (2) In a case where the copyright owner sustains the burden of proving, and the court finds, that infringement was committed willfully, the court in its discretion may increase the award of statutory damages to a sum of not more than $150,000. In a case where the infringer sustains the burden of proving, and the court finds, that such infringer was not aware and had no reason to believe that his or her acts constituted an infringement of copyright, the court in its discretion may reduce the award of statutory damages to a sum of not less than $200. The court shall remit statutory damages in any case where an infringer believed and had reasonable grounds for believing that his or her use of the copyrighted work was a fair use under section 107, if the infringer was:

    (ii) a public broadcasting entity which or a person who, as a regular part of the nonprofit activities of a public broadcasting entity (as defined in subsection (g) of section 118) [1] infringed by performing a published nondramatic literary work or by reproducing a transmission program embodying a performance of such a work.


    She wasn't making any money from the sharing, and technically speaking, her leaving the p2p app open could be construed as "public broadcasting" of the music, since she didn't have any prejudice when it came to who she shared with.

    Why would/should it be illegal?

    If I'm allowed to look at someone talking to me and hear what he/she has to say, am I not allowed to record that transaction?

    Where do you draw the line as to recording?

    No Video?
    no Audio?
    No Photos?
    No Drawings?
    No Writen notes?
    No Mental recollection of the dialog?
    No Remember the persons face?

    The whole concept of denying someone the right to record personal transactions is ludicrous. If I run a website and someone access it, I have every right to record that person's IP address and hold it for as long as I want. Same goes for any personal transactions I have.

    (this does not include making this information public however, that becomes a gray area)

    So if I leave my front door unlocked, suddenly my house is considered "public property"? You're delusional, accessing a webserver is accessing private property.

    Remember, the server is no soliciting you for information, you're soliciting the server for information, and in the process offering (freely) your IP address as well as user agent information. At no point are you ever required to give either to this private server.

    It should be assumed.

    Do you walk in to a store and complain when you find out that your face has been recorded by a CCTV camera? Visiting a website is the online equivalent of going on to someone else's private property.

    Why doesn't this implied warranty exist for open source products? Many OS projects sell such warranties. Just because the product has no price, doesn't mean anything.

    Microsoft has been trying to switch to the service model forever. If they had an online version the could charge either a per use fee, or a monthly subscription. Right now they're 'stuck' with their one time sale that doesn't provide MS with the money they feel the deserve.

    If they sell you a product that has a warranty that states it will not cover iphones with 3rd party apps on it, then they don't have to service the device.. there's absolutely nothing illegal about that, in fact, apple has NO obligation to offer ANY technical support on their products once sold. If the device is DOA, then there might be a case, but if it was functional and you installed 3rd party apps, they are no longer responsible.

    I keep hearing people talk about ron paul, I'd vote for him if it wasn't for the fact that he thinks a completely free market is the way to go. Imagine what would happen if there was no such thing as an anti trust lawsuit..

    INAL but, form what I understand, it basically sets a precedent that makes it very easy to have any future applications of the law in court invalid. If someone sues the state for illegally wiretapping their phones, they'll only have to cite this case and they can show the law is unconstitutional and win.. which makes the law pretty much useless.

    You'll notice however that unlike in the past, the Patriot Act was (by it's backers at least) hoped to be a permanent new set of laws. The Patriot Act's original wording might have made it temporary, but that was quickly amended. This was never about being for the war, this was just a power grab, and it worked, despite having just had a part of it overturned.

    Think about it like this, if it took 5 years to have a piece of the Patriot Act thrown out.. what's to stop another identical new law from being passed and taking ANOTHER 5 years to have it thrown out, all the while being used to illegally wiretap? The only way to stop this from happening again is prosecute those who did the illegal wiretaps.

    While you're right, the problem is that we're focusing on Iran because of the people higher up want war with them.

    Why not take a look at all the other horribly run countries in the world? China is acting far worse towards it's people than Iran is.
