    I would love to see a Special Ops unit bust down the walls of a spammer's house, beat him, gag him, beat him again, send him to Guantanomo Bay for eternity, and than C-4 the spam servers.

    Everyone should write their congressmen requesting this.

    When a deputy CIO of the Dept. of Labor and than Homeland Security Department has bogus degrees and has never been officially questioned about her educational experience (or lack thereof) for years, its not hard to see how gov't IT could be atrociously run.

    From other articles about her, she was notorious in promoting her cronies, many of whom were also incompetent while passing over for promotion and bonuses those who knew what they were doing. Apparently Laura Callahan had a reputation for going ballistic when the occasional techie caught on to her and questioned some of her decisions. In hindsight, its rather obvious why she was so insecure.

    didn't Nike have a billion dollar failure using i2? So much time and money for a project that they eventually had to toss - it wasn't even close to performing for them as needed. Most out of the box packages end up needing so much customization that it seems to be easier to come up with a solution from scratch. At least that way your company will own the code and (hopefully) know what it contains.

    The federal law makes wiretapping an interstate transmission illegal. What you type on your keyboard and gets sent to your computer is not going to be an interstate transmission. With the exception of maybe someone who lives on the border of two states. If your keyboard is in New Hampshire while your machine is in Vermont, I supposed an argument can be made that that is an interstate transmission.

    You missed the point of the article entirely.

    The federal law makes wiretapping an interstate transmission illegal. What you type on your keyboard and gets sent to your computer is not going to be an interstate transmission.

    If the wiretapping device had been between say, the computer and router - than the wiretap act may have been properly invoked.

    So you criticize the judge without reading the article or understanding the issue at hand. The judge may be old but he's certainly clever, understands computers, and picked up subtleties which you didn't even know existed.

    Yes there are clueless judges. Doesn't look like this is one of them.

    But district court judge Gary Feess disagreed, and last month granted a defense motion to dismiss the indictment. Feess ruled that the interception of keystrokes between the keyboard and the computer's CPU did not meet the "interstate or foreign commerce" clause in the federal Wiretap Act, even if some of those keystrokes were banging out e-mail. "[T]his court finds it difficult to conclude that the acquisition of internal computer signals that constitute part of the process of preparing a message for transmission would violate the Act."

    "The network connection is irrelevant to the transmissions, which could have been made on a stand-alone computer that had no link at all to the internet or any other external network," Feess wrote. "Thus, although defendant engaged in a gross invasion of privacy ... his conduct did not violate the Wiretap Act. While this may be unfortunate, only Congress can cover bases untouched."

    you'll have an advantange over your opponents is a great way to get yourself into trouble. yes, brains are definitely an asset but they're no match for experience - particularly against those who've read up on the theory of poker and what not. A PhD who thinks he's smart - rightly so - and who sits down at a 10/20 game believing his intelligence alone will make him a winning player will get educated very quickly. If ever there was an example of "street smarts" being better than "book smarts" existed, poker is it. Having said that, almost all top poker players are brilliant people - but intelligence alone won't cut it. Nice thing about poker is that to make money you don't have to be good. You can actually be pretty bad - just need to find players worse than yourself.
