If you buy one copy of an audio book, and copy it 100 times, whether your audio book started as a cd or an mp3 file is irrelevent. You have violated copyright either way, and the publisher only got paid for one copy.

In reality, there are 5 major labels in competition with songs for you to hear, as well as hundreds of smaller labels, and large numbers of garage bands. There is no monopoly on music. In fact popular artists often start on smaller labels, and then, sign with the one of the big 5 when they make it big (REM for instance). Yes, the internet is a good tool for exposure for unknown artists, but why does/. portray healthy competition as some sort of good vs evil thing. There's room for everyone to compete, and consumers ultimately decide (for better or worse) what's popular.

This has nothing to do with the DMCA. Apple doesn't have a case any more than SCO has a case against Linux. Real reverse engineered Apple's DRM without using Apple source code. Real is not using this technology to circumvent any copyright protection.
