    States ONLY HAVE TO COLLECT when they do "local" business to their operating location. So Joe Cheesesteak who has a store in Trenton and sells nationwide via EBAY only has to collect tax on sales to NJ which he is already set up to do.

    Well, since they can only tax you if you live in the state, write your legislator, or vote it down. I don't like paying 8.xxx percent tax on local sales, but I don't have an income tax, and the state has to pay certain of its bills, so no big deal.

    Actually, all states have that law... and most states have procedures to reclaim taxes paid in that state for items "used" out of state. Check your local law. In Theory, you are required to pay "USE TAX" on all items used in any location, MOST states empower merchants within that state to collect the USE TAX and refer to it as SALES TAX.

    This only affects people who live in CA and buy from California merchants. So this isn't going to affect the rest of us. Personally I don't see what the big deal is... California can't charge sales tax to "non-residents" because as yet the constitution still identifies interstate commerce as non-taxable.

    Ok, no-one ever died from lack of power, uless they didn't plan in advance. and if you are burning your furniture, that means you dodn't plan in advance... Advance planning means backup heat(wood doesn't need a backup, neither does an underground gas line) and sufficient food. And don't suggest that you might run out of food because your fridge loses power... well its really freaking cold outside... throw the perishables in a cooler. Oh, and keep a faucet or two running... or you will freeze your pipes.

    Or at least not as we know it. Here on earth, life is so all encompassing that there isn't a place we have gone that we haven't found evidence of life. It doesn't matter whether you go to the deepest ocean, or the hottest volcano, there are either living things, or obviously formerly living things. So either life on mars has not reached any sort of detectable level, or died out long ago.

    OTOH, personally I believe that life was created on earth and not elsewhere, but I believe that it is our responsibility to explore to build and to discover.

    Will the Big ISPs buy in?? Otherwise it will never be particularly usable esp since AOL is two of the largest ISPs in the country. I think that we will be more likely to be using whatever the AOL Earthlink consortium come up with.

    The answer is really very simple. If an artist uses a sample, then they should be obligated to pay royalties. That is how the law is written today. Now, perhaps that should change. But why?
    So that people who can't play instruments can "borrow" other artists work
    I don't think that is a good plan.

    Here is a better plan. Fix copyright back to 70-100 years Max.

    OTOH, if two artist independantly develop the same riff, then both are free to use it, However if there is a significant gap between the first and second. The second is and should be obligated to acknowledge influence, or prove that it is not a derivative work...

    One example that comes to mind was the first time I heard the new Madonna song... some crap about life in America and yoga and pilates. Anyway I was immediately reminded of Falco's Rock Me Ammadeus.

    Simple, Subpeona the billing records for the lawyers listing the total hours worked on that case. THEN, determine an appropriate hourly cost based on "industry scale charges".

    OK, I read that. Doesn't answer any of the questions I asked. 12000 is rather alot of money. and for 12000 its possible to hire sufficiently competent representation to fight, win, and possibly retrieve damages for malicious use of the legal system.
