Aye. My wife has a G1... it's neat, but it's not as fast as I'd want my phone to be. I'm waiting for the next generation of Android phones, stuff that'll run 2.0 and have a faster CPU and such.
It doesn't even have the capability to make life on earth pretty miserable. It has the capability to make life in very specific, strategic places exceptionally miserable. Which is the whole point.
So if I have a sign by the front door of my store and I write on it "No refunds for any reason", and I give you a product that doesn't do what I say it does in exchange for your money, I'm perfectly right in keeping your money when it doesn't work?
Why would 3D virtual worlds be the future? It only puts limits on how we can perceive things. We'd actually think things are "far away" because of our perceptions from meatspace, and that's not really conducive to free communication and thought. 2D web, I click on something and I go there. 3D? There would have to be walking time to get from A to B, a cognitive "switch". Not to mention it's just a lot easier to get information via reading. The 3D web is the "future" maybe only for social gatherings. A replacement for IRC possibly. But it won't replace IM, it won't replace the text web. Those are too efficient at what they do, and 3D interaction adds nothing of value while at the same time imposing all kinds of additional restrictions and patterns that aren't there now, controlling avatars and the like.
If you have a dark room, or a room without direct sunlight that you watch TV in, I have a 61" DLP with a beautiful picture, awesome contrast, and it uses all of 170W.
Carrying things on my back and walking places is much more dependable than driving a vehicle which can break down. I'm still not gonna start hauling everything in a backpack.
Not a safety issue? Have you ever been in an airport with significantly delayed passengers? It's a bit of a powder keg when you get enough people trying to find seats in the terminal to wait for their "slightly delayed" planes, fight for power outlets, talk on cell phones...
Have you tried using Photoshop with multiple monitors? MDI is a horrible pain in the ass with that, IMHO. I much prefer just using a virtual desktop for GIMP and having multiple windows.
Bang them over the head? I'd go for the kneecaps and extremities. Hitting someone over the head to get knowledge out of said head seems a little foolish...
They can also re-license the old code under a new license. It doesn't have to be a new release. The only thing that they cannot do is rescind the previous licensing terms.
Unavailable? You can buy a Radeon 5870 right now at Newegg. Stock probably won't last since it's popular as hell, but you CAN buy one, and you won't be on a waiting list.
When you have an EULA for every device that says effectively the same thing, no matter from what manufacturer, do you really have a choice?

The Blender GUI is great. Once you learn it. Too bad the learning curve is something like a profile of climbing the cliffs of Dover...
