So the main problem with open source software is it is hard to figure out who to have a law suit against? Sounds like a problem for lawyers not open source.
Linux trys to run on a variety of motherboards, with serveral different CPUs, it is real-time, embedded, it is a real OS. A real OS should try to have drivers for as much hardware as possible. Some may say we are only talking desktop here, well my desktop is hooked up to a dance, dance, revolution game pad, a Rio 500 MP3 player, a joystick, an epson printer, a n50 nostromo speed pad. I run Windows, which I consider a real OS, because it like Linux tries to have drivers for all available hardware and has an open PC architecture. When OS X runs on a variety of platforms and has a better variety of drivers I will check it out...
SCO thought Linux was a great idea until nobody wanted the flavor they created. This is what will sink them anybody can see they are flapping in the wind here it is fodder for the bashers of Linux...

I don't know if the file format needs to be open, but one would think that a future version of a product should always be able to open past versions of documents for that product at a minimum.
That being said it seems like laws are being pushed because some don't think certain software models will win in the free market system. I do not like this use the power of the goverment to beat my biz opponents, I know it is done constantly I just like good old competition.

Digital Camera's are killing Kodak film sales, it would be like a razor that does need blades to Gillette or the Internet to the record companies, I guess there really was a revolution in the 90's. Times changes and some bizs will fade just like it always does, it is called creative destruction and it is part of capitalism. Ebay destroyes classified adds and no newspaper even national ones can figure out how to fight back, typerwriters are gone, etc. Very common situation, most of the time entertainment does well in a bad economy, look at video game and movie sales for a more accurate picture. DVDs and video games are a much better entertainment value than a basic CD, however a two disc set like the Matrix Reloaded sountrack is on the right track, it was the first CD I bought in a few years (I bought some internet CD from mp3.com) the thing that pushed me over the edge was the two disc set a better value...

It is interesting to note that most people here view MSFT = bad and Linux = good, but really both provided computing power to everybody at a much lower cost than some (Orcale, Sun, etc.) would like...
