It may help to have wide distribution of the shareware, but when people are bothering to find ways around the splash screen (or whatever deterrent), we're right back to people who just want everything free.

...or the fact that most newbies will look at it and ask, "What the heck is this little wheelie-thing?" Most people wouldn't figure out what it does unless someone shows them how, or they accidentally notice the scroll bars move when they touch it. More likely it'll be calls to tech support saying, "My iMac is broken, the screen just scrolls by itself sometimes!"

Also, where would it go on the new mouse? Split the 'button' down the middle? On the side (where it favors one hand over the other)?

Music files don't come with little tags that say whether or not they're copyrighted.

Actually, the MPEG headers have a field, called, you guessed it, "copyright". Of course it seems that each mp3 encoder randomly decides weather to set it to 1 or 0, so its of no use, but if people actually used the field as it was meant to be used, napster could filter pretty easially.

...except that any work created by an artist is already copyrighted under law. It's just the RIAA that's attempting to retain control over their artist's work that's in question. Other artists want their copyrighted work freely distributed. Blocking by the copyright tag doesn't do any good.

Gee, that wasn't hard, was it?

Not at all. Now let's just block all of the files with this song name...

But wait, these aren't all the same song. Some of these are by other artists, some aren't even music! Well then, we'll just block everything under a RIAA artist's name...

But wait! This one's a bootleg of a concert. Didn't Metallica say they wanted concert bootlegs to be distributed, just not their recorded material? And isn't this something from this other band's garage days, before they were even on a label? Darn. So, we can't block by song name, or artist...

Well, let's add a new MP3 tag that says 'bootleg' or 'non-copyright', then we can block anything else that isn't in this new genre tag.

But wait! Won't people just set all their MP3's to 'bootleg'? Darn.

Now what? Any other easy suggestions?

This ban is not what Metallica asked for, nor was it what they wanted. Lars has stated this publicly again and again. Metallica basically asked for a filter to be applied to Napster searches.

If they had done this comparatively simple task, Metallica and the people that Napster alienated would be on the side of Napster instead of against them.

This was not a "comparitively simple task". How is Napster supposed to tell the difference between a 'Metallica.mp3' file recorded at a live event, and a file with the exact same name that contains recording studio material? Even a file named "Enter Sandman.mp3" may be ripped from a CD, recorded from a concert, or a children's lullaby recorded by a folk artist at a public event in the '60's.

The only way for Napster to comply with Metallica's request, or the injunction, would mean Napster would have to have a copy of every song on every RIAA-controlled CD ever produced, and then do a waveform comparison between their copy and any copy on any user's shared space. This is nowhere near technically feasable, or even practical. In both cases they had to take the only measures they could (blocking 'violaters', closing the service) in order to comply with the laws.

I've used a scroll-wheel mouse at work for nearly three months now, and I must say I still prefer to use PageUp/PageDown on my keyboard. I know you can adjust the wheel to increase or decrease the number of lines it scrolls with each rotation, but I prefer the snap and even paging that the keyboard buttons provide.

So far, I like my Logitech Wingman Gaming Mouse better than most other offerings. Just a regular 3-button mouse with no scroll wheel. It works great for games and gives me plenty of functions in the MacOS. The drivers are a bit unstable, but hopefully the 4.0 version coming out soon fixes that.

Not everyone has much of a choice. Sometimes you live in a suburb because it's the best you can afford near your current job. Either you can't afford the housing costs in the city, or the job is in the suburb.

then, you tacitly accepted membership in a community which doesn't care about mass transit -- another choice.

The problem is you're ignoring the problem. I currently don't have a car because I'm in college in a small town, and most of what I need is within walking distance. However, to get to the nearest airport to visit my parents I have to take a car to get there, because there is no bus service between here and the airport. Would you say that the fault lays on me for choosing a college in a small town that lacks adequate bus service?

Well, it wasn't much of a choice. This was the only college I could afford.

Going back to living with my parents... my father worked for a local grocery store for most of his life. If we wanted to visit my grandparents across the river, what was our only option? By car. Getting to a shopping center? By car. Even getting to church required a car. Our options were limited to traveling by car because of where we had to live based on our income and employment.

From the way your post reads, we should all pick towns with mass transportation no matter our job availability, income, or needs. Otherwise, we have no reason to complain.

The author does take certain aspects of the UI to task, and I really don't blame him. He is fair about it, rather than some reviewers who choose to do nothing but flame and complain. His arguments are well thought out and written, and he brings out certain concerns that, frankly, make sense. If you only read one article (or series of articles) on OS X, this should be the series.

The rest, with the human batteries, 'The One' and such, was annoying.

As to the violence... eh... if you're going to be ultra-violent, you'd better show the gore as well. Like you said, people don't just fall over when shot, it's very messy and not guaranteed to kill them. If you've got an R rating already, you might as well use it for some realism. And maybe that will get people to realize this isn't quite as glamorous as it's made out to be.

Finally, Neo should have stayed dead when shot. I personally thought it would have been a better ending that way, leading to them discovering the real hero in the sequel (and maybe a better actor as well!).

I am attending college here in the USA at the same time as my sister, who happens to be a German language major. We've discussed this, and talked with her professors, and it's a fact of life in Germany that certain freedoms are restricted. I'm sure some of you in the gaming community have noticed that sometimes gamemakers mention they have to make special versions for German customers. Unreal Tournament had to release a German version in which your opponents are clearly androids so that there is no blood. A similar thing happened with Myth, and Bungie eventually added a 'No Blood' option when they released Myth 2, causing all opponents you kill to disappear in a cloud of stars, a-la Mario Bros. One of the more interesting things is that Nazi propaganda is expressly outlawed in Germany. Unlike how the article reads, they aren't trying to cover up the Holocaust... however, swastikas and pro-Nazi symbolism are flat-out illegal. While it is still considered free speech to have and share such views, it is illegal to openly display them. German WW2 products cannot have the swastikas, feature (obvious) SS officers, etc. Just last week, a group of Neo-Nazis marched through Berlin to promote themselves. The government allowed it, though it did arrest a few individuals before the march began because of their display of said materials. Before they reached their rally point though, the ~200-300 Neo-Nazis were met by nearly 2000 protesters coming the other way. Needless to say, there were some rocks (and even bicycles) thrown, and many more people were arrested. The entire point behind these restrictions is to prevent such a thing as the Holocaust from happening again. Admittedly, it strikes me as overkill, but the German people tend to be very formal and reserved in public situations or with people outside their immediate friends and family, and used to doing things in a certain manner. Restricting such things isn't always popular, but the majority simply take it in stride because it seems necessary. What does any of this have to do with the article? The German public is already used to having certain restrictions placed on their freedom, even if the results are dubious at best. However, the use of the Internet has expanded rapidly in the last few years there, and certain factions will be lining up on both sides of the issue there, just as they are here on the issue of sex on the 'net. It would be a long, hard struggle to kill such legislation if it came to be in Germany, and I'm not sure there would be enough people worried about MP3s to stop it.
