    They should be in the right to do what they want. You can refuse a hick because they aren't wearing a shirt. You should be able to refuse a hick because they are a hick. In fact, it is perfectly legal to refuse someone's business because they are 5' 11", when you require clients to be 5' 10" or shorter or 6' 0" or taller. Nitpicking certain things, like religion, sex, race, orientation, etc... is just stupid.

    By the way, you can refuse on anything except race. You CAN refuse business because of gender.

    In fact, both are subjective. You are only arguing about how thin or thick the client will be. It is not a black/white scale...it is grayscale.

    I just now went a read that part, and it doesn't offer a reason. It offers reasons for all kinds of other things, like how it was considered as a tax instead of a fee or penalty. It even cited the case.

    In this case it is just:

    Even if the mandate may reasonably be characterized as a tax, it must still comply with the Direct Tax Clause, which provides:“No Capitation, or other direct, Tax shall be laid, unless in Proportion to the Census or Enumeration herein before directed to be taken.” Art. I, 9, cl. 4. A tax on going without health insurance is not like a capitation or other direct tax under this Court’s precedents. It therefore need not be apportioned so that each State pays in proportion to its population.

    If this isn't a direct tax, what is?

    They want to access a tax on people who do not do X. It doesn't matter what X is. They can tax you for not saying "America is the best country in the world." Tax gets around all other laws, as it supersedes things like the 1st amendment.

    Generally, this is correctly ruled Constitutionally...that is until you realize that a direct tax is illegal per the Constitution. Does this not qualify as a direct tax?

    The SEC regulates "public" companies. The FSA regulates trading. Tax-break accounts (401Ks/IRAs) cause more investing than a free market (unbiased taxing) would otherwise have. 401Ks contribute to passive trading. All of these are government manipulations on the market. Just because you can't identify a regulation on a specific trade doesn't mean that it isn't directly or indirectly regulated already.

    They why do we have quotas on how many immigrants we take in? We decided to put quotas in place to "protected American jobs" in the early 1900s. Now the story has changed and jobs are just outsourced. But rest assured, people will complain that a legal immigrant is taking their job.

    Didn't Obama just say that he won't enforce illegal immigration laws on young people? Picking and choosing. Andrew Jackson was actually acting on a bill in the books of Congress. He didn't just say "I'm going to do this against everyone's wishes".

    It sounds like they need to upgrade the software because of a license, contract, or support reason. Since there is a major change, it could make things more stable or less stable. The posting wants to make sure he gets the best dollar out of the upcoming refresh.

    Actually, I see the protectionist culture more in the midwest, than the northeast. A more accurate statement would be classified by urban, suburb, or town/village family living. The culture is VERY prevalent in suburb living. Not so much in the inner city or rural lifestyles.

    I have lived in NYC, Columbus OH suburbs, rural PA, and Northern VA. The most protectionist was in OH and Northern VA. The other two would drive those people nuts.
