    Today, SCO filed a lawsuit against SCO for selling Linux based solutions with Unix properietery code that it had contributed to the Linux development project.

    The lawsuit is for irrepairable damages and seeks an award of $10,000,000,000 and legal fees. The CEO of SCO had this to say, "We expect a quick settlement to this case."

    He also added that "With the settlement money and our recouped legal fees, we can move on to other Linux / Unix distributors, such as Santa Cruz Operation or Caldera."

    As an astute poster pointed out on OSNews, they cannot collect on any damages anyway.

    They distribute(ed) a version of Linux under the GPL, a licence that legally permits people to copy and branch the code assuming they put it under the GPL. Unfortunately for SCO, whether or not they knew they were distributing their own IP under the GPL or not is irrelevant to the rather compelling argument that they did put their IP under the GPL, and now that they continued to distribute linux after they found the alleged infringements means that no court would declare that licence invalid.

    They have knowingly distributed what is potentially their own code under the GPL for nearly a year now. The GPL licence should hold, infringement-free.

    This has been posted before but they can not collect on any damages caused, as they have not published the allegdedly infringing portions.

    Not telling the world what the code is, is a legal blunder of the first order. This means that they have unclean hands, as they are supposed to try and mitigate the damage in order to receive compensation.

    You can't knowlingly add to the damage and then ask for compensation incl Punitive damages based on same. Any suit against Linux vendor in the future can site this as an Affirmative Defense" and pretty much get the suit tossed on that account alone

    Gentlemen,

    Computing is a fast-paced field. What was cutting edge yesterday is as
    outdated as a pet rock today. Newer, more efficient technologies are
    always being developed. The 8" floppy gave way to the 3.5" floppy
    which was later replaced by the CD-R. The acoustic modem eventually
    yielded to the DSL/Cable modem. Unix was overtaken by Windows XP. And
    so on.

    The same technology also applies to programming languages. C yielded
    to C++ which gave way to C#. However, the time has come for a complete
    paradigm shift in programming. I propose a de facto migration towards
    a relatively new, but promising language known as assembly.

    Most of you are probably unfamiliar with this langauge. I know I was
    until I chanced upon it in my community college while completing my
    MCSE. So allow me to give you a little background on this language:
    C++ and Java do not allow the programmer to directly access the
    hardware. Instead they compile into a "bytecode" which is then
    interpretted by a virtual machine. While very portable, this limits
    the speed of Java and C++ programs.

    Assembly, however, was designed to allow the programmer *direct
    access* to the hardware! This makes for *much* faster programs.
    Furthermore, assembly is the same language "spoken" by computers.
    Because of this, you may sometimes see assembly referred to as
    "machine code".

    I fear that without the support of a large corporation (the way MS has
    pushed Java, or Sun supported C#) assembly will fall by the wayside
    like many other interesting languages (Python, I'm looking at you!)
    Thus I hope to start a "grass-roots" movement to support assembly. I
    would like to see the FSF release a GNU-based assembly compiler
    (although they can keep the bugs that have plagued the 3.0 release of
    gcc which caused people to switch to Visual Studio for their Linux
    programming.)

    I would love to expound on the superiority of assembly over C++/Java
    but I'm late for my "Intro to TCP/IP" class. Those of you familiar
    with assembly, please feel free to educate the many ignorant
    C/C++/Java users on the glory of this superior language.

    This should be taken with a grain of salt. 'Planning' and doing are 2 entirely seperate things. The fact is, (ans I'm going to be modded down by the linux crowd) is that windows is cheap. Why?

    You don't have to train your users over again. You don't need expensive unix/linux admins (MCSE's are a dime a dozen - and most are good, too. Don't let elitism clud your jusgement). More software works on windows (WINE is not always the answer).

    Linux is nice, but it isn't ready for the desktop quite yet.

    My PhD dissertation was on the very subject of veganism. Through my
    studies of the health and lifestyles of vegetarians, vegans, and
    normal healthy eaters, it became clear to me that eliding meat from
    one's diet is a surefire way of shortening one's lifespan and causing
    irreversible developmental retardations in children. We humans are
    designed to eat meat, and the consequences of not doing so are
    numerous:

    * It is impossible for a strict vegetarian diet to provide all the
    essential amino acids necessary to develop and maintain a human body.
    A vegetarian can eat all the beans and nuts he likes, but he still
    won't get his daily requirements of lysine or glycine. The
    consequences can range from muscle atrophy to development of diabetes
    and other severe disorders. Vegans further exacerbate this problem by
    avoiding nutritious milk, eggs, and other animal products.

    * Vitamin B-12 does not exist in vegetable matter, and can only be
    absorbed from animal products. This vitamin keeps your brain and
    nervous system in working order, and is absolutely essential to
    infants' growth cycles. Unfortunately vegans are so tied up in their
    dogma that they would rather kill their own children than let them get
    this essential vitamin.

    * Vegans and vegetarians almost always live more decadent lifestyles
    than healthy omnivorous eaters. Almost 90% of the vegans I interviewed
    classify themselves as Wiccan or Neo-pagan. Followers of these cults
    are infamous for their unhealthy behaviour. They often foster
    unhealthy "polyamorous" relationships which spread venereal diseases.
    They are known to be aquaphobic and avoid bathing or showering, under
    the pretense that filth makes them "closer to the Earth." These
    delusional habits are very likely tied to brain damage caused by
    vitamin B-12 deficiency as explained above.

    I seriously urge all vegetarians and vegans to reconsider the health
    implications of their lifestyle, especially if they have or plan to
    have children. While veganism may be merely unhealthy for a grown
    adult, it can absolutely cripple a child whose development depends on
    a well-balanced diet of both meats and vegetables.

    Hi, I'm concerned about the narrowm view of the world 'hard' science students have these days. I think the problem starts at college - There's a culture that somehow science is more rational and usefull then the humanitities. Lecturers encourage students to joke about arts students, and humilaite them whenever possible. This encourages eliteism, and I for one am sick of it. Let's tell it like it is. 'science' is just as much about opinion as the humanities. Research simply follows the fad of the day. Take dieticians for example. These men and woman believe that just because they have degree in medical science that they are all knowing. Why, what they recommend one day may kill you the next! (see the DDT story for more information.) Science is 95% opinion then facts, lets face it. What about astrology, the most rediculious of the sciences! But I degress... Another example is music. We know what sounds good. Everyone aggreed that Valves for instance sound great. But knowitall engineers use trensastors with inferious sound quality just to save a few bucks. They argue with numbers. Hey, I don't want to do maths just to listen to music. I know what I like. You cannot apply objective reasoning to a subject which is intristically subjective. But try telling those recent grads with their useless piece of paper that and they go all mightier--then-thou. The problem with you technical guys are that you are all so eliteist. Whilst you want to trun collage into a trade school with yore narrow minded views that collage should be a job training centre, humanities are focused on making you a well rounded person who is auctually interesting to be with, not a boring focuesed geek. Really, it makes me so mad when people say "oh, he's doing a humanities degree, that's easy". I have to read *3* *books* *a* *week* on average. Not picture books either I assue you. It is a lot of work, but the upshot is improved grammer and spelling skills that are lacking in the technical. As for those that say "you will be working at mcdonalds" , I'm going on to so a PhD in socialolgy where I'll be line for tenure where I have a much more rewarding job then beeing a science freak or an engineer.     Throughout history there have been examples of writers of childrens' stories inserting more adult themes into their works. Many childrens' stories and Disney movies contain sex and drugs, but most of the adult themes have more to do with politics. Authors as a whole are an opinionated bunch, and every once in a while they secrete their beliefs and propaganda in seemingly innocent works. Frank Baum filled The Wizard of Oz with references to the gold or silver standard debate of the time. Mao Zedong's Little Red Book reeks of Communist beliefs, as does the Communist Manifesto. But after extensive research, I have discovered what might be the most frightening example of all. Hidden in the words and pictures of "Green Eggs and Ham" by the beloved Dr. Seuss is a veritable allegory of Communist ideology. From every innocent tongue twister springs a hidden meaning or anagram, and every plot twist shows the "struggle" against Capitalism.

    Though the characters seem innocent and pure, just under the surface lurks a deeper, redder truth. The name of the main character Sam is also the initials of the secret Socialist American Militia. Coincidence? I think not. The main character remains nameless because he represents the nameless millions that have not been "saved" and converted to Communism. When Sam brings in all the possible dining companions, it is not difficult to see through the happy childrens' book to the darker underlying meaning. The mouse in the house represents all of the little people who have been converted and now happily toil in equality. The fox shows that smart and clever people have joined the Communist side. The goat is a representative of the agricultural interests that enjoy the benefits of Communism. As you see, this is not just a childrens' book.

    The locales were also not chosen by coincidence. The house shows that everybody will have a roof over their head, while the box is representative of manufacturing. The car is just an example of the luxuries people would be able to afford in a Communist world. The train shows that the world would still be structured and happy. Just like in Mussolini's Italy, where the trains ran on time. The darkness represents Capitalism, the "darkness" that is overcome when they exit the tunnel. The nameless Capitalist is nearing the end of his journey of conversion. The boat that is his last locale is an example of the powerful navy under the Communist world, able to destroy everybody else. But the good doctor does not stop here.

    Even in his images, Dr. Seuss is pushing his Communism on impressionable children. It is no accident that the only sad person throughout the story is the only Capitalist. Nor is it mere happenstance that the sad wretch is reading a Western newspaper. And the ham that looks like Russia? Nothing between these covers is accidental, down to the red hat on Sam. Even when they go in a tree, it is obvious that Seuss understands that accepting Communism is going "out on a limb." From the red flag the boat is flying to the look of joy on the nameless Capitalist (after sampling Communism, of course), every image is calculated to subliminally drive Communism into the minds of impressionable children. They show Seuss' convoluted image of right and wrong to the world.

    When Communists tell other adults to give up their ways, the Capitalists know to just ignore them, but our children, our future, have not been trained yet, so it is very easy for them to fall for Seuss' evil words, especially after seeing the joy and hearing "I do so like green eggs and ham! Thank you! Thank you, Sam-I-am!" (Seuss 62). My research centered soley on "Green Eggs and Ham," but I am sure Seuss used other books to spread his evil. We must protect our children from Seuss and his kind, before it is too late.

    Hello Everyone, Why don't people use hex in everyday math? Logically it makes more sense. It's far more efficent, requires less concentration to use and is extremely fast. The only reason we use decmial is for legacy reasons. Sure, the majority of people have ten fingers / toes, but basing our entire default number system on that is horribly offending thoses without the prereuqiesit number of digits. That's besides the point though. If we were brought up on hexadecimial instead of decmial, just think how easier life would be! No having to change the default radix on out Zilog assembler. No trouble converting to binary and back. No problems memorising ASCII codes. I for one vote we take the final step and move towards a true standard numbers system. Combine the waring factions of roman and arabic and use hex and the worldwide standard. This would be a big step towards settleting the differences between that idiot bush and italy for instance. Really though, The Roman empire may never have fallen if they had joined the trojans and adopted base 16 as a symbol of peace. Just think of the economic benefits this may have today! I strongly believe that us, readers of technical newsgroups have to intelligence and resourcenessfullness to band together in germany as a bastion of hex, and gradually take over companies that refuse to follow us. I of couse would be leader and you my loyal followers but as hexians we would truly suceed! We would rule with an steel fist!

    Lets talk about Jon Carmack. Jon is the legendary programmer of such classic PC games as Wolfenstein, Doom, Duke nukem 3d, Quake 1, 2, and 3, unreal, and the upcoming doom3. Jon has single handedly created the genre known as the first-person-shooter. He has also popularized the OpenGL 3d format over Microsoft's competing DirectX format, as well as caused public interest in 3d cards when he first released accelerated quake for the s3 virge chipset. Jon carmack has redefined gaming on PC's.

    Now stop for a moment and think, What would have happened if Albert Einstein had worked creating amazing pinball games instead of creating the theory of relativity? Humanity would suffer! Jon carmack is unfortunately doing JUST THIS, using his gifts at computer coding to create games instead of furthering the knowledge of humanity. Carmack could have been working for NASA or the US military, but instead he simply sits around coding violent computer games.

    Is this a waste of a special and rare talent? Sadly, the answer is yes.

    Unfortunately, it doesn't stop there. Not only is Jon carmack not contributing to society, he is causing it's downfall. What was the main reason for the mass murder of dozens of people in columbine? Doom. It's always the same story: Troubled youth plays doom or quake, he arms himself to the teeth, he kills his classmates. This has happened hundreds of times in the US alone. Carmack is not only wasting his talents and intelligence; he is single-handedly causing the deaths of many young men and women. How does he sleep at night?

    Carmack is a classic example of a very talented and intelligent human being that is bent on total world destruction. Incredibly, he has made millions of dollars getting people hooked on psychotic games where they compete on the internet to see who can dismember the most people. I believe there is something morally wrong when millions of people have computerized murder fantasies, and we have Jon Carmack to thank. Carmack has used his superior intellect to create mayhem in society. Many people play games such as quake so much that their minds are permanently warped. A cousin of mine has been in therapy for 6 months after he lost a 'death match' and became catatonic.

    It is unfortunate that most people do not realize how much this man has damaged all the things we have worked hard for in America. Jon has wasted his intelligence, caused the deaths of innocent children, and warped this country forever. To top it off, he got rich in the process and is revered by millions of computer users worldwide. Perhaps one day the US government will see the light and confine Jon Carmack somewhere with no computers so he can no longer use his intelligence to wreak havoc on society.

    I'm Australian, and this comment hits the nail right on the head. Telstra is a govenment approved monopoly - they can and do get away with anything.

    We have tiny amounts of bandwidth given to us - nevermind more bandwidth costs them almost nothing. A typical plan is one gigabyte a month. I cry when I here people from other countires casually mentioning they downloaded a few .ISO's.

    Einar Stefferud, a longtime net hand, reports that DEC announced a new DEC-20 machine in 1978 by sending an invite to all ARPANET addresses on the west coast, using the ARPANET directory, inviting people to receptions in California.
