I was absolutely the same way. The girlfriend snuck rhapsody on my PC though, and after explaining that I had asked her to NEVER EVER EVER install anything Real on my PC (she didn't realize it was Real), I found it to be quite nice. Its still installed a few months later and we are paying customers.
Id say have a more open mind, but I found out about the new Real by accident myself. So I won't. But consider it. People learn from mistakes sometimes.

Many Wal-marts have significant grocery sections, so much so that other grocery stores often lobby to keep Wal-mart from moving into their markets. They aren't even in Southern California yet and the mere threat of their presence had a major impact on the result of the recent grocery workers strike. They sure are a major force in the food industry. Your own analogy is weak if not outright ignorant.
So whats your play here liquidsin? You are running up and down these threads making excuses and lobbying for Apple Computers. What is your interest? Apple broke a contract they willingly signed pure and simple. Honoring one's agreements is really the ground floor for being considered honest and fair and there is plenty of room to be an even better citizen from there. What do you have to gain by trying to make Apple look innocent?

Your new assumption not withstanding (and not the case I was discussing since it has nothing to do with the grandparent's hypothetical) they would merely proceed with the suit. You would have to prove to them your assumption was true immediately, at which point in time the thing would be dropped and nothing would happen, or you would be successfully sued. Good luck.
And when they calmly explain that they haven't checked and have only sent a C&D letter but if you fail to comply will be happy to file an actual lawsuit including subpeonas, warrants, attorneys, et al, allowing them to check the file under the watchful eye of the court and you are actually infringing, what will your course of action be?
Anyone in LA or OC remember when they were shitty local band Kara's Flowers and used to open for bands like the Aquabats? Congrats on graduating to shitty huge band with a new name and keyboard player. I guess.

Not unobservant, but you have oversimplified. Whats close in price? If the difference is 10 of course you pay the little bit more for new and shiny. If the difference is only 30-90 dollars, this is the number that forces the consumer to choose. Do I spend the extra cash on the gamble that the DS will live up to the hype and that games will actually be developed for it, it will actually be durable, and will actually have the battery life of the GBA SP, or do I go with what everyone I know already has and save that cash to buy another game right now? Creating the significant seperation of 100 dollars or more neatly seperates the two, creating the two distinct and most importantly predictable markets. It forces the consumer's hand. Note that the lower of these two is really just a mirage. The amount of consumers willing to pay 80 but not 100 is insignificant and not worth repricing a whole product line towards, and that niche is not really the target anyway, since if they are that cheap they will not likely be making considerable purchases of any type. Also consider that traditionally once a system drops below 100 in price, the manufacturer is getting out of that business. There is little incentive to move GBA SP's as they have moved all-in on the DS with this price drop. Running back to the GBA SP would amount to forfeit. When the Virtual Boy failed, it was not at the hands of a competitor...
The cut is designed to create fully distinct markets for the DS and SP. If they were anywhere close in price non-bleeding edge consumers would choose the SP everytime due to its familiarity and broad range of titles. Nintendo does not want the DS to appear to be a one-trick side project in the marketplace. Only time will determine if that is true or not. With the PSP turning out to be significantly more powerful and having the PlayStation name, wow, this is going to be fun!

Hell even the GBA vanilla launched only 3 years ago. The abandonment of the GBA so quickly, IMHO, is really a slap in the face to everyone who bought a GBA.
