IANAL, but couldn't we almost claim entrapment in that case? I'm wondering if the RIAA/CRIA has the legal right to actually take part in pirating it's own product, and then suing for it. Makes no sense to me.

I have to agree. I'm a power user, and decided one day to make the switch over to Linux (getting 10 'oh-my-god-you're-computer's-gonna-die security updates from MS set me off). I went out and bought a copy of Suse 8.2 Pro cause I wanted something as friendly as possible. I thought to myself while I used it for the first time since KDE 1.0 that wow, Linux has come a long way... But in the end I had to dump it. I'm sorry, the whole OS is stable, fast, and powerful, but beautiful it is not. All the apps look like they've been designed by programmers. I don't mind using the command line... truth is, when it comes to certain tasks I prefer it. But there was barely an application that I actually enjoyed using because none of them were very intuitive. Just my 2 cents.

  6. Is he infringing on a trademark though? on Microsoft to sue Mike Rowe for Copyrights · · Score: 1

I mean, Mike Rowe is his name, is that a trademark violation? Can he register any domain name that contains his legal name without having Microsoft come after him? "MikeRoweSoftware.com", "MikeRoweSucks.com", etc.... Wasn't there a case similar to this a few years back about a kid named Kevin Mart who registered a domain name with his first initial and last name in it, and K-Mart tried to sue him for Trademark Infringement, but lost?

  7. He's perfectly entitled to make a counter offer... on Microsoft to sue Mike Rowe for Copyrights · · Score: 2

IANAL, but if somebody makes you an offer on something, are you not allowed to make a counter offer? I don't see how he can get nailed for trying to profit off a domain name when all he's trying to do is recoup costs. They offer him 10 bucks, he says no, and counter offers with 10,000$. I just thought that was called "negotiating"...

Because the U.S. was at the forefront of the best phone service on the planet, NOW we have about a billion miles (literally, if I understand) of copper to dig up and replace with fiber or wireless.
Are you sure? I thought Canada was always way ahead of the states in terms of phone service... we've had fiber from coast to coast for years andyears and years now... crystal clear sound. Also, I wouldn't quite say that the US is a world leader in cellular services by any means... I was in Hungary and Croatia for about 3 weeks this past spring, and the cell service there is beyond anything I've ever experienced... try being 75 feet below ground in a metro, in another country, and receiving a phone call. It's quite something. In north america, I lose the signal if I simply step into "a bad area" in my apartment... it's a joke.

  10. With all your knowledge and fancy terms... on Replace Your Music....Again · · Score: 1

I still think vinyl, when I listen to it, sounds better. I have a few albums which I own on both vinyl and cd. At the end of the day, I prefer listening to vinyl more than the digital recording. Is there a word for that? Or can it be explained scientifically? You'd probably know... All I said is as far as I'm concerned, vinyl sounds better. And, even though your post was a good essay in length, all you said was that you thought cd's sounded better. The only difference between you and I is that I'm not telling you you're wrong or trying to belittle you.

  11. I seem to be going backwards... on Replace Your Music....Again · · Score: 1

The more I listen to music, and the more money I spend on music, the ratio of cd's to vinyl is quickly teetering the other direction. I buy more vinyl than anything now because I feel the sound quality is just superior and overall I get a better value (liner notes, funky looking records, booklets, etc.). It almost seems as though that with all this technology in the world, the RIAA keeps getting things backwards and making stuff worse than original. I've yet to hear a cd which sounds better than vinyl... but hey... that's just my opinion. in 5 years, I'll still be buying vinyl.

  15. I would actually pay... on Will Legal P2P Music Distribution Succeed? · · Score: 1

if they made the price cheaper. Honestly, at 99 cents USD a song, and me living in Canada, that is not cheap. In fact, I'd still be paying the same price and I'd have less freedom to do what I want with it. Also, a couple of the bands I really like (such as Olivia Tremor Control and Circulatory System) have 20+ tracks on an album... some of them being less than a minute long. Why would I pay 26$ CAD for 20 songs when I don't have the original cd, cover art, etc. and DRM restricts what I can do with it? Now, that in mind, I do buy a lot of albums... it's pretty much my hobby... however, I mostly buy vinyl. I would love to have the ability to download the vinyl in electronic format... but at a dollar a song (buck-thirty canadian), it's simply not worth it. Perhaps if it was something like 25 - 50 cents a song, for 2.50$ an album... well, I'd be all over it.

  16. Re:And in other astounding news... on Canada Immune From RIAA? · · Score: 1

Don't kid yourself. The US military has the ability to attack virtually any point on the globe with any amount of military force.

This doesn't make them militarily dominant, it makes them militarily mobile... I classify "dominance" on the grounds of "who comes out on top" at the end of the day... and as I've stated before (look a few threads up) the USA picks on poor, farily defenseless 3rd world countries... I'd like to see what would happen if they attacked N. Korea, or Russia, or India... countries that actually have available defenses such as nukes.

The EU may be a competitor one day, but today it can hardly be called more than a free trade area...

But look at what the GATT and NAFTA have done for the US economy... if they weren't around I question if the US would have been the economic power that it is... which, when you look at the fine print, isn't as nice as we might think. Anyways, my point here is you can't dismiss the EU as simply a Free Trade Area... it's much, much more than that. It standardizes environmental laws, currency, economics, etc. It's essentially a new state.

...and many Europeans are understandably resistant to the idea of surrendering their country...

This is flat out bogus. I was actually in Hungary the day of the national referendum in which over 3 million people voted. The results: 89% Yes. Seems hardly resistant. In fact, the majority of the countries in Europe (Eastern Europe especially) wish to be part of the EU... the only REAL country that I've heard of so far in which there is a massive uprising by the people to stay out of the EU is Sweden... and hence Sweden has stayed away.

to the Fourth Reich. Besides, Brussells, Paris, and Berlin can be counted on to stifle growth with excessive bureacracy.

The Fourth Reich... Since the passing of the Homeland Security Act and The Department of Homeland Security, and The PATRIOT ACT, and soon to come The PATRIOT ACT II, I believe the USA is the definitive to what you defined above... literally. These 3 acts define laws which are as draconian as the laws passed in Nazi Germany (c'mon, the legalization of torture against suspected terrorists? puh-lease....)

  17. Just my quick 2 cents here.... on Canada Immune From RIAA? · · Score: 1

  18. I'm not sure if I agree.... on Canada Immune From RIAA? · · Score: 1

Who is (for better or worse) the most culturally influential power in the world today?
The USA is the exact opposite of "culturally influential"... it's a culture melting pot. Yea, there are "American" transnational corps all over the world, but that doesn't make the USA "culturally influential", that makes you "economically influential"... however, because there is such a lack of Culture in North America (minus Mexico... mostly Canada and USA), the line between "culture" and "the mall" is extremely blurred. I just got back from Hungary and Croatia, and the only "culture" you've "influenced" on them is "Burger King" and "McDonald's"... which goes back to my point... it's not culture, it's business. Big difference.

Who is the dominant military power in the world today?
This is interesting if we actually think about it... I haven't seen the USA get into war with an actual big mighty country since WW2... all I've seen the USA do militarily speaking is pick on 3rd world countries that don't really have (or should not have had) much of a chance... I'd like to know what the results would be if the USA went to war against a real competitor... but as it stands, the don't, and won't... so for the lack of evidence, we'll have to assume the USA is the dominant military power in the world today.

Who is the dominant economic power in the world today? Certainly not the USA right now... Bush has completely screwed the USA's economy... I might actually have to say the EU is the dominant economic power.

Who is the dominant political power in the world today? Hint: if you answered the same for military and economic it must be that power here.
This is also interesting... I would have to say the USA because recently they've showed us that they'll play by their rules and only by their rules. Screw the UN, or the World Court, or any other international political figure... if you play only by your rules, sure, of course you'll be the most dominant political power.

I think you're right about China and India though...
