  1. Actually the drugs are made by a single company in Italy is barred by EU regulations from selling it. You'd have to find equivalent drugs in the US. The problem is that SCOTUS blessed this cocktail in Baze v. Rees (2008) and all the states raced to switch to that process to reduce appeals. Now that part of that cocktail is unavailable, states are back to square one. Has nothing to do with PR or marketing.

  4. This is going to backfire.... on RIAA Seeks Royalties From Radio · · Score: 5, Interesting

This is great news. There are only like 2 big radio conglomerates out there. They typically replay the same crap that the labels spoon feed them over and over again. Now, let's say they have to PAY to play that crap. Wouldn't it make sense to maybe play local stuff that doesn't cost a dime? Maybe it makes sense to play those albums that are not covered by the RIAA?

The best part is that if this is instituted it must be instituted across the board. They can't give radio stations breaks on a specific song over another. If they do, then this is payola. You can't pay radio stations to play your song. A discount on royalties is the same as paying them. Maybe we might hear some variety on the radio.

Again, another strategy not thought out to the logical conclusion.

  7. It's all about control of distribution channels... on The Other Side of BitTorrent · · Score: 5, Insightful
What people sometimes fail to grasp is that the entertainment industry (RIAA & MPAA) aren't really concerned about piracy. They will bitch and moan about decreasing revenue but those are a drop in the bucket. Most revenue lost due to piracy wasn't real revenue anyways. The people infringing on the copyright would have never bought the product in the first place.

What the RIAA and MPAA are most afraid of is that there is now a free distribution mechanism for artists. they don't need someone to label and distribute their art, they can just push up on a bit torrent. They can by-pass the leeches that only exist to take more from the talented people producing great work. They also can't control what we listen to and what we watch. they make their money by pumping out the same crap month after month and taking a small percentage from the artists.

If they lose control of the mechanism for distributing art, then they can kiss their racket goodbye.

  8. IP case for the investors, not the real meat on SCO Names 1st Lawsuit Target: AutoZone [Updated] · · Score: 3, Insightful

The meat of SCO's case will not be the IP Infringment. They are also trying to catch AutoZone for a contract violation in the contract they signed when they bought SCO Unix. They might be able to win a breach of contract suit. The problem is that they will do their best to spin it to the press as a Linux IP infringement suit. Just another pump and dump scheme.

  14. Re:Indy Musicians on Replace Your Music....Again · · Score: 1

Great Point. This is why the RIAA wants to control the mechanism for popular music distribution. Not becuase they might lose 1 or 2% of sales due to piracy, but so they don't lose their strangle hold on the industry.

As long as an Indy Artist can't distribute their music directly to me in a easy format (i.e. mp3 files), then the RIAA gets to take a piece of the profit. They also get to choose what gets released and what doesn't.

There needs to be a grass roots movement to support Indy artist and boycott RIAA artists.

  15. Re:Improperly done blacklist on Why Blacklisting Spammers Is A Bad Idea · · Score: 1

I agree. I am behind a cable modem and find that I am on several blacklist because I run my own mail server.

The point is that large spammers are going to get around black listing by switching domain names, IP addresses and the like. The only people you will stop with blacklisting are those people without the resources to move around. That isn't going to make a dent in the amount of spam flaoting around the ether.

  16. The point that most miss.... on Who Needs Radio? · · Score: 1

This is the entire point of the RIAA's hatred of digital music. They could care less about a little piracy. Of course it cuts into their profit margins, but that isn't the scary part for them. The scary part is they might no longer control the distribution mechanism for emerging artists. If any artist hase the ability to produce his own digital art, then distribute it to millions of people, he or she can become a star and not need the RIAA. This cuts them out of the loop and they stand to lose control of the industry.

That's why you should support emerging arists through that mechanism. It gives you the choice to listen to whatever you want, not just the stuff on the radio. If you hear something and buy it directly from the artist, it cuts out the RIAA creeps who are leeching off a percentage. That's the power of digital media, and that is what the RIAA fears.
