My biggest question in all of this is, who's to say someone didn't deliberately contribute supposidly IP code just to start this upheaval in the first place? What's the best way to take down an open source community? You can't buy them out, you can run them out of business...
I'm sure competition would love to put their proprietary source code into Linux that would allow them to sue, and thereby ruin all the work that has been done to date, just to take out, what they realize, is the greatest threat to their business.
