I'm not asking about the motivation as that is a seperate and uninteresting topic... thats left as an exercise (aka flamewar) for the various fans and anti-fans of Apple/MS. I'm not saying I want to go do this, in fact i probly wouldnt even if i could... and yes the reason is probably because there are lot more windows (or Wintel X86 linux users) users who wish they either werent, or would like to have access to OS X things then mac users who would want windows in any way shape or form on their machine. Obviously not 'bound' by jewish law, but it always seemed erie to me how they'd pick certain things from the OT and embrace them, but ignore others. If you'd like a better example, what about the ten commandments? I don't read and memorize the new testament, but where exactly do they fit in there?

have you ever considered that people such as myself, dont want to have to bring my ipod to work everyday, when i can just store my music on my computer there? thats 100% legal... or maybe i want to avoid wear and tear on the ipods battery because whenever i plug in it recharges and i dont want it to recharge while im at work.... or even better consider that I want to have my headphones plugged into the computer so that i can hear important noises and such on it, such as mail arrived, or an alarm for a meeting...
or maybe i just want to consolidate all of my music onto one computer to back it up so i can reset my ipod and not have to connect to all of my different laptops to upload various songs to it..
i dont know about you but i dont like the command line in windows, it sux. yes i dont use winamp and wont use this tool, but thats because i can acomplish this inside itunes, but get this, i can see that others may find it useful regardless of whether i find it usefull..
and before you say no one in their right mind would bother, perhaps you should try thinking a little bit first.. many of us nerds have MULTIPLE repeat MULTIPLE computers with music files scattered across each... I have a central musicbox, but on my two laptops i have a bunch of music as well becuase when on my laptops often dont have access to my server (since my server is only in my home, and my laptops are mainly used away from home) i like to have music on them to listen to so that i dont always have to break out my ipod while im on the computer.

It feels like you miss several of the key points to this lawsuit, why it is a lawsuit, and why it is a valid one. For starters the key contrast between the MS products you mention and the iPod is that they are replacable pieces of equipment. The battery on the ipod was not replaceble without voiding the warranty, and their answer was you need to buy a new ipod. That coupled with the advertising claims, and the large amount of battery problems that exist is the reason for the lawsuit. Given the nature of the suit as targeting the false claim of battery life, it shuold be irrelevant whether your ipod is suffering now or not, because how do you know that next week it wont be suffering and no longer achieve the desired length? Are there people with iPods who dont have these problems? certainly. are there people who dont think they do but just dont realize they do, you bet.. and are there people who have been conditioned not to give a damn and just accept it as life, you and the parent to this DAMMIT thread are perfect examples of them.
Another of your main points is the first gen iPod people suffering problems.. there is one fatal flaw with your reasoning, you assume that none of them had problems back when their ipod was only a year or two old (or three), could it be that they just lived with it, gave up after attempting to get it resolved, or already bought a new ipod?? Its irrellevant in my opinion because there was no course of action for them to take, think of it as a case where they havent reached the 'statute of limitations' and maybe that would make sense to you.

When theres a part recall or warranty work done to your car are charged for it? no, its WARRANTY work; "As I stated, when my PowerBook 190 had a damaged power connector because of poor design, for which they eventually offered a replacement system at a reduced price," if you ask me that isnt a good experience. They should have offered the replacement system free.. to me thats like saying oh the computer i sold you the hard drive has a problem and will fail in 2 months, we'll replace it then for free, probably with another defective one that lasts two months, but for only $$$$ you can buy one from us at a special discount that wont break.
draw the parallel to laptop use, they also have a very speculatory battery life side to them.. to me the key difference is that A. the batteries perform as guarenteed for a longer period
I don't know what all the commotion is about, and how any of you claim you cant get music off of your ipod onto your computer but who ever thinks so is sadly mistaken... Not only can it be easily accmplished without ANY SOFTWARE AT ALL, but you can do it inside itunes, and in under 6 mouse clicks (depending on how your prefernces are set)....
If you turn on the option to have iTunes automatically copy music into your itunes music folder all you have to do is plug in your ipod, click file->add folder to library, and then browse to your ipod and add the control folder to the library... In a matter of minutes (depends on how much you have on there obv) everything will be copied physically onto your hard drive.. thats it
Suppose your on linux or windows and dont wanna use itunes for whatever reason, just make sure that hidden folders are visible and copy the folder/ipod_control/music to desired location. Done that's it. Heck if you're on linux its even easier you should be able to deduce the two commands needed to do the entire job... (a mount command.. and

i dunno it seems to me like a lot of the open source development going on in the open source community is being done on peoples own machines, part of the reason it happens if you ask me, people right things which will be of use to them and release them to share with others etc.. so if the only way to get a "cell" is to get one custom built and designed for you, who gives a crap if its "open" if someone builds you a custom processor and wont give you the details of how it works why in the world would you buy it? and if no one else has it without getting it custom built again, why would i want to write anything on it?

hardly... you can be uneducated but a master programmer, and you can be educated but hardly qualified. Example? lets say i didnt go to college but programmed all day and night.. the world would consider me uneducated but with enough experience i could be considred qualified.
on the other hand perhaps daddy bought my way into an IVY and i have a bs in CS from some fancy school, but i have never done significant work on my own, and aside from decent enough grades lack any real skills in programming, very possible mind you. i now am educated but am unqualified..
ever read job specs, just about every job ever posted in software or cs reads: qualified candidates should have 3-5 or 5-10 years expereience in development in such and such...
you wouldn't believe how many pages on a companies so called college recruiting / new grad oppurtunities require over 5 years of experience developing software... and unless the stuff we develop for our college projects counts how is a new grad supposed to have that kind of experience?
the problem is that big companies are often pigeon holing themselves into believing a quality candidate will be the best "educated" and "qualified" and not looking for the best programmers or even people for the job. more often it seems the definition of qualified is the problem. The real problem may be the entry level positions and their publication. The quality candidates and future employees are definately out there, perhaps the real question is who is sifting them and determing who knows what?
on another note i wonder how many of those CEO's and or their main hiring people read/.

im not saying that you cant afford a computer (and I was not referring to a new computer, but rather to this fancy box that was stolen) clearly to anyone who frequents this site, having a computer is a neccesity, I'm just surprised that while you are busy putting together what many would consider a "luxury box" to do all sorts of fancy stuff, your daughter feels that she has to steal cds. which i consider ironic does she lack the money because she wastes hers, or does she just steal to steal? granted with things she has done its understandable that she has a very small amount of spending money; but in some regard its like seeing your father buy a bmw and then tell you sorry hun, moneys tight right now while im out of work and youll just have to go with out a cd.... again im not implying that that is your case, but when you are busy going on about all of your gear its hard not for you to come across like that

Although If i was unemployed the last thing i would be doing is building such a system and tying up my money.. after all if shes 17 college cant be too far off, and not to be a cynic or in anyway reflect on your personal situation, but one never knows when employment will come again in this silly economy.

if your solution is to unplug the computer to prevent shutdown writing... than among other things you aren't removing it properly; and IMHO you shouldnt be giving anyone any advice,
my magic answer for this stuff, msconfig; you can temp disable any service you want, and reboot until you find exactly which service is the "mal" service. without moving or deleting anything either important or unimportant. once you find and disable the correct startup services youll be able to remove the entirety of the malware.. occasionally youll have to go to safe mode as well.. the other thing i like about msconfig is that it will tell you exactly where in the registry the service is for you to delete once your ready to remove it from the registry...
and if you pull the plug that fast there is no guarentee that your changes get written to the hard disk either

upon reading the actual article, it seems pretty clear that right now the only place you'll find the cell is inside a ps3, "The IBM Corp. fellow who led the design team said his company currently has no plans to make Cell-based chips for its own systems or for the merchant market." at least thats what i get from the article.. and they arent making it for the market... so why does it matter whether its open or not, why / how am i going to develeop anything for the cell processor if i dont have a system thats using it? and if the market isnt going to be using it? i dunno it seems to me like a lot of the open source development going on in the open source community is being done on peoples own machines, part of the reason it happens if you ask me, people right things which will be of use to them and release them to share with others etc.. so if the only way to get a "cell" is to get one custom built and designed for you, who gives a crap if its "open" if someone builds you a custom processor and wont give you the details of how it works why in the world would you buy it? and if no one else has it without getting it custom built again, why would i want to write anything on it? i must be missing something
hardly... you can be uneducated but a master programmer, and you can be educated but hardly qualified. Example? lets say i didnt go to college but programmed all day and night.. the world would consider me uneducated but with enough experience i could be considred qualified. on the other hand perhaps daddy bought my way into an IVY and i have a bs in CS from some fancy school, but i have never done significant work on my own, and aside from decent enough grades lack any real skills in programming, very possible mind you. i now am educated but am unqualified.. ever read job specs, just about every job ever posted in software or cs reads: qualified candidates should have 3-5 or 5-10 years expereience in development in such and such... you wouldn't believe how many pages on a companies so called college recruiting / new grad oppurtunities require over 5 years of experience developing software... and unless the stuff we develop for our college projects counts how is a new grad supposed to have that kind of experience? the problem is that big companies are often pigeon holing themselves into believing a quality candidate will be the best "educated" and "qualified" and not looking for the best programmers or even people for the job. more often it seems the definition of qualified is the problem. The real problem may be the entry level positions and their publication. The quality candidates and future employees are definately out there, perhaps the real question is who is sifting them and determing who knows what? on another note i wonder how many of those CEO's and or their main hiring people read /.

im not saying that you cant afford a computer (and I was not referring to a new computer, but rather to this fancy box that was stolen) clearly to anyone who frequents this site, having a computer is a neccesity, I'm just surprised that while you are busy putting together what many would consider a "luxury box" to do all sorts of fancy stuff, your daughter feels that she has to steal cds. which i consider ironic does she lack the money because she wastes hers, or does she just steal to steal? granted with things she has done its understandable that she has a very small amount of spending money; but in some regard its like seeing your father buy a bmw and then tell you sorry hun, moneys tight right now while im out of work and youll just have to go with out a cd.... again im not implying that that is your case, but when you are busy going on about all of your gear its hard not for you to come across like that thats what i was trying to get at. Although If i was unemployed the last thing i would be doing is building such a system and tying up my money.. after all if shes 17 college cant be too far off, and not to be a cynic or in anyway reflect on your personal situation, but one never knows when employment will come again in this silly economy. and while its great that shes still drug free.. if shes just turning 17, the ordeal is just beginning and again i only wish you the best of luck. but the reality i have seen is that no matter where you go, the more you think there isnt a drug presence the more likely it is there... but in your case i hope i'm wrong.. have a good one

if your solution is to unplug the computer to prevent shutdown writing... than among other things you aren't removing it properly; and IMHO you shouldnt be giving anyone any advice, my magic answer for this stuff, msconfig; you can temp disable any service you want, and reboot until you find exactly which service is the "mal" service. without moving or deleting anything either important or unimportant. once you find and disable the correct startup services youll be able to remove the entirety of the malware.. occasionally youll have to go to safe mode as well.. the other thing i like about msconfig is that it will tell you exactly where in the registry the service is for you to delete once your ready to remove it from the registry... and if you pull the plug that fast there is no guarentee that your changes get written to the hard disk either
i'd say either you are a horrid parent, lack common sense, or are just an asshat disguised as a geek.. for god sakes get a handle on your kids.. if you know your daughter was involved do something about it. You dont need the police's OK to ground her indefinately, or to speak to the other persons parents. How is it that you are able to afford such luxuries for computers, while out of work, and while your daughter is compelled to steal, and of all places from walmart.... and saying that your neighborhood isnt a drug neighborhood is THE single most proposterous thing you could ever say. I suggest you spend a little less time on your computer and a little more time on planet earth.
