    From www.copyright.gov/legislation/dmca.pdf

    Section 1204 of DMCA has:

    First offense: up to $500,000 or five years imprisonment

    Second and subsequent offenses: up to $1,000,000 or ten years

    From what I can gather, this applies to commercial copying. Also, non-profit libraries, archives, and educational institutions are not subject to criminal sanctions.

    If the entire drive is encrypted, then either you encrypted it (which means that you should be able to decrypt it) or you didn't encrypt it (which is pretty much a sign of foul play).

    The lack of DRM is what is creating these headaches. The world is a better place when content creators and distributors can work within some established, standardized API or hardware spec to enforce their license terms rather than having to resort to things which are totally proprietary, hackish, and incompatible.

    And by what means do you prevent breaking of a standardized API?

    Hey, if everyone wants to bag on Microsoft not making a next generation file system, what is stopping Linux and the Open Source community from doing it? Oh, that's right- it's easier to just complain about MS than to actually get your hands dirty. Nevermind then, carry on.

    On the other hand, what FOSS programmers have promised and failed to deliver on file systems?

    So ext3 was a clean sheet re-do? Isn't it backward compatible with ext2? Indeed, isn't it just ext2 with journaling?
