So let me get this straight you're basing the fact that Sony won the marketshare the "first" time and Nintendo winning it the second time as a sign that Microsoft shouldn't keep trying? The fact you don't mention if they lost to the PS3 is telling. It also means that Microsoft could win the 3rd time.
Also what's more important then "winning" is improving. If they keep improving, its quite possible they'll win in the future.
But don't let these things get in the way of your anti-Microsoft bias.
I actually avoided the whole "make a new years resolution" mistake by being determined to lose weight several months ago. I hope Steve did a similar thing, or else he may be doomed to failure.

If you've paid for a service that is not provided you should be able to sue them, regardless of how much fine print there is.
That's why in Australia changes to our services are always advertised in advance (through mail or e-mail) with the customer given the option to pull out before the change.
I visit a random website in Firefox under XP, I count how long it takes to load. I do this several times. I then visit the same pages under a Linux distro. It is demonstratively 5 times slower (sometimes as much as 10 times slower, although there are times when its less then 5 times slower, so I take the average).

Doesn't work on mine, and its 2 years old, and it wasn't exactly cutting edge then (closer to 3-5 years old).
Alright, I'll admit it does work after some fiddling and tweaking to get things to work (like speakers), if you don't mind your internet being 5x slower then on XP.
At the moment they're being sued in Australia by AFACT for failing to stop filesharers.
Which lets face it, ISPs have been profiting from file-sharers for years now. They'd be unable to sell their high download-limit packages anywhere near as often without them.
I wasn't commenting on Australian, Canadian, New Zealandan or Anyoneelsean because the parent was American so I was assuming they were talking about biofuel in America not being kept alive only because of government subsidies.
If you pay for a license to do X, Y and Z with the song, you get to do X, Y and Z. They're offering students to be able to do X, Y, Z and V. Not exactly a loophole and well within their rights as the copyright holder.
If I got offered a yearly license fee to download any music I want (at the rate that the article was talking about), I'd take it.

The whole industry needs to be scrapped and would die an immediate brutal death except for subsidies which keep it alive.
One could say the same about many American industries which are getting bailouts.
