There have been a crapload of laws trying to enforce some kind of age limit, every single one was struck down. There was a list on Wikipedia I think. One specific case is http://en.wikipedia.org/wiki/Entertainment_Software_Association_v._Foti but I can't find a comprehensive list at the moment. I wasn't referring to stores deciding not to sell to minors BTW, only laws forcing them to obey any ratings. Why it's legal for porn to be restricted but not violence I don't know.

play donkey kong and compare it to Mario Galaxy.

Donkey Kong had a great spinoff in the '94 SGB version. That had a sequel in Mario vs Donkey Kong for the GBA which IMO didn't live up entirely to the standard of its predecessor since the way switches worked in it kinda limited what was possible in the level design compared to DK '94. The new switches were a nice idea but should have been in addition to the old system instead of replacing it. Also I think MvDK was missing the placeable elements (in DK'94 there were items that would let you place ladders, platforms, walls, etc with a cursor). Overall I'd say both DK'94 and MvDK are pretty good games by modern standards (except DK'94 looks dated, doesn't play that much different from MvDK though).

Of course you meant the original arcade game but I think the '94 one compares reasonably with SMG.

If you want another game that didn't hold up at all, try Metroid. That game is horrible if you've played Super Metroid or Zero Mission (which has the advantage of the quick missile button but the disadvantage of less interesting level design compared to SM) before trying it.

Additionally there is no law that prevents selling M rated games to minors and it has been ruled unconstitutional to enforce that.

It's simply a requirement by the HD media license, the DRM must be built into the OS otherwise no playback software running on it can comply with the license requirements. MS didn't want to end up with an OS that cannot play back HD movies when Apple could put it into OSX and leave MS behind in that respect. Sure, there is no law requiring MS to implement (except maybe laws regarding the need of a corporation to maximize its profits) but there are features they simply cannot offer without that DRM. MS chose to let you choose if you want to play DRMed media on your system, if you don't want to the DRM won't affect you.

While they may have medical uses now, leeches were "state of the art" when they were used. Doctors were convinced of the science behind them... and killed one of our Founding Fathers in doing so. It's all science, right?

Yeah and once we learned it doesn't work right the idea was abandoned. Again, we do things to the best of our knowledge and if we learn new facts we stop doing things we might have done before. That is not a bad thing, sometimes we have to act with limited knowledge because we can't just sit idly until we have all the facts together but if we fail to adjust our plan once the facts become known we are just thickheaded. "Staying the course" is not a positive attribute, it can mean your original plan was good enough that it didn't need adjustment or it can mean that you fail to make the necessary adjustments and are progressing towards an avoidable error. ...which is what I'm asking for... If I happen to believe that a Master Engineer started the whole shebang off, fine. I'm asking for evidence otherwise.

The problem with that claim is that it's unsubstantiated. You're faking knowledge where there is none. The biggest problem is that people who have such unfounded claims often pass them on to other people in order to make those believe the same claim (while often neglecting to mention that it's just a wild guess, many state unfounded claims as if they were facts) and especially children are very vulnerable to such influence. Sometimes this is so strong that even once the unknown becomes known through new evidence the person will still cling to his beliefs.

I will not make a claim about the unknown, rather I question the need for such a claim. I don't see a benefit to making wild guesses about something. If we know nothing about it that's it, we know nothing. We shouldn't create an illusion of knowledge* because an illusion is at best useless and at worst harmful. I cannot prove or disprove your beliefs but I can prove that they are useless, if they had a use that use could be shown or fail to be shown which would support or disprove your claim. The lack of anything that can disprove a hypothesis implies the lack of anything the hypothesis is good for.

*= It's an illusion of knowledge because, no matter how true or false it is, you don't actually know it is, you just picked one option and chose to believe in it.
